Notice is hereby given that, pursuant to the provisions of Part 7, Division 3, of the Canadian Environmental Protection Act, 1999, Permit No. 4543-2-06351 is approved.

1. Permittee: Department of Public Works and Government Services, Moncton, New Brunswick.

2. Type of Permit: To load and dispose of dredged material.

3. Term of Permit: Permit is valid from July 17, 2005, to July 16, 2006.

4. Loading Site(s): Robichaud Harbour, New Brunswick: 46°13.64' N, 64°23.01' W (NAD83), as described in the drawing "Dredge Area and Disposal Site Location Robichaud Harbour Westmorland County N.B." (May 6, 2005) submitted in support of the permit application.

5. Disposal Site(s): Robichaud B: 46°13.87' N, 64°22.65' W (NAD83), as described in the drawing "Dredge Area and Disposal Site Location Robichaud Harbour Westmorland County N.B." (May 6, 2005) submitted in support of the permit application.

6. Route to Disposal Site(s): As described in the drawing "Dredge Area and Disposal Site Location Robichaud Harbour Westmorland County N.B." (May 6, 2005) submitted in support of the permit application.

7. Equipment: Suction dredge.

8. Method of Disposal: Suction dredge via pipeline.

9. Rate of Disposal: As required by normal operations.

10. Total Quantity to Be Disposed of: Not to exceed 10 000 m3.

11. Waste and Other Matter to Be Disposed of: Dredged material.

12. Requirements and Restrictions:

12.1. The Permittee shall notify in writing the following individuals at least 48 hours prior to each occasion that dredging equipment is mobilized to a loading site. The notification shall include the equipment to be used, the name of the contractor, the contact for the contractor, and the expected period of dredging.

12.2. The Canadian Coast Guard, Regional Operations Centre, 1-800-565-1633, is to be notified in advance of commencement of work so that appropriate Notices to Shipping may be issued.

12.3. The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations. Proof of payment of the remaining balance of $2,350 shall be submitted to Mr. Scott Lewis, identified in paragraph 12.1, prior to January 16, 2006.

12.4. The Permittee shall prepare an environmental protection plan relating to the dredging and ocean disposal activities authorized by this permit. The plan shall be approved by Environment Canada prior to the commencement of the first dredging operation to be conducted under this permit. Modifications to the plan shall be made only with the written approval of Environment Canada.

12.5. A written report shall be submitted to Mr. Scott Lewis, identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity of material disposed of and the dates on which the loading and disposal activities occurred for each site.

12.6. It is required that the Permittee admit any enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999, to any place, ship, aircraft, platform or structure directly related to the loading or disposal at sea referred to under this permit, at any reasonable time throughout the duration of this permit.

12.7. A copy of this permit and of the documents and drawings referenced in this permit shall be available on-site at all times when dredging operations are under way.

12.8. The dredging and disposal at sea authorized by this permit shall only be carried out by the Permittee or by a person with written approval from the Permittee.

Significant New Activity Notice

(Section 85 of the Canadian Environmental Protection Act, 1999)

Whereas the Ministers of the Environment and of Health have assessed information in respect of the substance Clarified oils (petroleum), catalytic cracked, reaction products with cresol and polymethylene polyphenylene isocyanate, Chemical Abstracts Service No. 68920-56-9,

Whereas the substance is not on the Domestic Substances List,

And whereas the Ministers suspect that a significant new activity in relation to the substance may result in the substance becoming toxic according to the Canadian Environmental Protection Act, 1999,

Therefore the Minister of the Environment indicates, pursuant to section 85 of that Act, that subsection 81(4) of the same Act applies with respect to the substance.

A significant new activity involving the substance is any new activity other than importing it or manufacturing it for use in industrial or commercial sealants and coatings.

A person that proposes a significant new activity set out in this notice for this substance shall provide the Minister of the Environment, at least 90 days prior to the commencement of the proposed significant new activity, with the following information:

(1) A description of the proposed significant new activity in relation to the substance;

(2) All information prescribed by Schedule VI of the New Substances Notification Regulations;

(3) Subitems 3(1) to 3(4) prescribed by Schedule VII of these Regulations;

(4) The concentration of the notified substance in the final product;

(5) A skin sensitization test; and

(6) A repeated dose mammalian toxicity test.

The above information will be assessed within 90 days of its being provided to the Minister of the Environment.

EXPLANATORY NOTE

(This explanatory note is not part of the Significant New Activity Notice.)

A Significant New Activity Notice (SNAc Notice) is a legal document pursuant to subsection 81(4) of the Canadian Environmental Protection Act, 1999 (CEPA 1999) issued by the Minister, that lists the activities for a given substance in Canada for which there has been no finding of toxicity under the CEPA 1999. The SNAc Notice sets out the appropriate information that must be sent to the Minister for assessment prior to the commencement of a new activity as described in the SNAc Notice.

Substances that are not listed on the Domestic Substances List can only be imported or manufactured by the person who has met the requirements under sections 81 or 106 of the CEPA 1999. Under section 86 of the CEPA 1999, in circumstances where a SNAc Notice is issued for a new substance, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with the SNAc Notice and of the obligation to notify any new activity and all other information as described in the SNAc Notice. It is the responsibility of the users of the substance to be aware of and comply with the SNAc Notice and to submit a SNAc notification to the Minister prior to the commencement of a significant new activity associated with the substance.

A SNAc Notice does not constitute an endorsement from Environment Canada of the substance to which it relates nor an exemption from any other laws or regulations that are in force in Canada and that may apply to the substance or activities involving the substance.

RADIOCOMMUNICATION ACT

Notice No. SMSE-006-05 — Amendment of Radio Standards Specification-133 (RSS-133)

Notice is hereby given that Industry Canada is amending Radio Standards Specification-133 (RSS-133), which sets out minimum requirements for the certification of transmitters and receivers in a radiocommunication system to provide Personal Communications Services (PCS) in the 1 850-1 910 MHz and 1 930-1 990 MHz bands.

The RSS was amended in order to include technical requirements for the efficient utilization of the bands 1 850-1 910 MHz and 1 930-1 990 MHz to align with the frequency plan in Industry Canada's Standard Radio System Plan-510 (SRSP-510), Issue 3, for PCS. Also, additional technical specifications were included to account for technology changes of PCS devices. Other changes comprise general reformatting of the document and contact information updates. This revised RSS is

Radio Standards Specifications-133 (RSS-133), Issue 3, 2 GHz Personal Communications.

The above document will come into force as of the date of publication of this notice.

This document has been coordinated with the Radio Advisory Board of Canada (RABC).

The Radio Equipment Technical Standards Lists will be amended to reflect the above change.

Notice of an amendment to the bulk oil cargo fees charged by Western Canada Marine Response Corporation pursuant to an arrangement required by paragraphs 660.2(2)(b) and 660.2(4)(b) of the Canada Shipping Act

Description

Western Canada Marine Response Corporation (WCMRC) is currently a certified response organization pursuant to subsection 660.4(1) of the Act in respect of a rated capability of 10 000 tonnes and a geographic area covering the waters bordering British Columbia (including the shorelines associated with such waters) and excluding waters north of 60° north latitude.

Definitions

1. In this notice of fees

"Act" means the Canada Shipping Act. (Loi)

"asphalt" means a derivate of oil that is commercially described as road or paving asphalt or unblended roofers flux, that has a specific gravity equal to or greater than one, that is solid at 15 degrees Celsius and that sinks to the bottom as a solid when immersed in water. (asphalte)

"BOCF" means bulk oil cargo fee. (droits sur les produits pétroliers en vrac (DPPV))

"designated oil handling facility" means an oil handling facility that is designated pursuant to subsection 660.2(8) of the Act and is located in WCMRC's geographic area. (installation de manutention d'hydrocarbures agréée)

"ship" means a ship within the meaning of section 660.2 of the Act. (navire)

"ship (bulk oil)" means a ship that is constructed or adapted primarily to carry bulk oil in its cargo spaces. (navire (avec produits pétroliers en vrac))

Bulk Oil Cargo Fees

2. The bulk oil cargo fees that are payable to WCMRC in relation to an arrangement required by paragraphs 660.2(2)(b) and 4(b) of the Act are the bulk oil cargo fees set out in Part I of this notice.

3. Nothing in this notice is intended to modify, replace or amend the registration fees established by and payable to WCMRC, and published in the August 21, 1999 edition of the Canada Gazette, Part I.

PART I

4. This Part applies to the loading and unloading of oil within WCMRC's Geographic Area of Response (GAR).

5. In relation to an arrangement with WCMRC, the total BOCF payable by a designated oil handling facility shall be determined by multiplying the total number of tonnes of bulk oil unloaded and (in the case of bulk oil intended for international destinations and destinations north of 60° north latitude) loaded at the designated oil handling facility by the BOCF per tonne for each type of oil set out in sections 7 and 8 of this Part.

6. In relation to an arrangement with WCMRC, the total BOCF payable by a ship (bulk oil) shall be determined,

(a) in the case of bulk oil loaded onto the ship (bulk oil) and intended for international destinations and destinations north of 60° north latitude, by multiplying the total number of tonnes of bulk oil loaded at an oil handling facility that is within WCMRC's geographic area and that does not have an arrangement with WCMRC, by the BOCF per tonne for each type of oil set out in sections 7 and 8 of this Part;

(b) inthe case of bulk oil unloaded from the ship (bulk oil), by multiplying the total number of tonnes of bulk oil unloaded at an oil handling facility that is within WCMRC's geographic area and that does not have an arrangement with WCMRC, by the BOCF per tonne for each type of oil set out in sections 7 and 8 of this Part;

(c) in the case of bulk oil loaded onto the ship (bulk oil) outside WCMRC's geographic area which is transferred within WCMRC's geographic area to another ship for use as fuel by such ship, by multiplying the total number of tonnes of bulk oil transferred by the BOCF per tonne for each type of oil set out in sections 7 and 8 of this Part; and

(d) in the case of bulk oil received by the ship (bulk oil) within WCMRC's geographic area from another ship as cargo where such bulk oil is intended for international destinations and destinations north of 60° north latitude, by multiplying the total number of tonnes of bulk oil received by the BOCF per tonne for each type of oil set out in sections 7 and 8 of this Part.

7. The BOCF applicable in respect of oil (other than asphalt) is

(a) an amended fee of sixty-seven and one-tenth cents ($0.671) per tonne, plus all applicable taxes from July 1, 2005, to December 31, 2005; and

(b) an amended fee of seventy-nine and six-tenths cents ($0.796) per tonne, plus all applicable taxes from January 1, 2006.

8. The BOCF applicable in respect of asphalt is

(a) an amended fee of thirty-four and eight-tenths cents ($0.348) per tonne, plus all applicable taxes from July 1, 2005, to December 31, 2005; and

(b) an amended fee of forty-one and one-tenth cents ($0.411) per tonne, plus all applicable taxes from January 1, 2006.
