Guidelines for the Notification and Testing of New Substances: Chemicals and Polymers

Notice is hereby given, pursuant to subsection 69(3) of the Canadian Environmental Protection Act, 1999, that the Minister of the Environment and the Minister of Health have developed the Guidelines for the Notification and Testing of New Substances: Chemicals and Polymers for the interpretation and application of the provisions of Part 5 of that Act.

EXPLANATORY NOTES

The Guidelines for the Notification and Testing of New Substances: Chemicals and Polymers provide assistance for complying with the New Substances Notification Regulations (Chemicals and Polymers portion) regulations made under the Canadian Environmental Protection Act, 1999. The Guidelines explain the information that a notifier manufacturing or importing a new substance into Canada must provide to the Minister of the Environment under subsection 81(1) of the Act, before manufacturing or importing a chemical, a biochemical, a polymer or a biopolymer that is not on the Domestic Substances List. This information is required so that the Minister of the Environment and the Minister of Health may determine whether the substance is suspected to meet any of the criteria set out in section 64 of the Act. The Guidelines also explain the obligations of the Minister of the Environment and the Minister of Health respecting assessment periods, and those of the Minister of the Environment with respect to the addition of a chemical or polymer to the Domestic Substances List under section 87 of the Act.

Interim Marketing Authorization

Provision currently exists in Table V to section B.16.100 of the Food and Drug Regulations for the use of the amylase enzyme in the production of brewers' mash, distillers' mash, dextrins, maltose, dextrose, glucose (glucose syrup) and glucose solids (dried glucose syrup), at levels consistent with good manufacturing practice. This enzyme is derived from a variety of sources, including several Bacillus organisms.

Health Canada has received a submission to permit the use of the alpha-amylase enzyme derived from a genetically modified Bacillus licheniformis organism, the Bacillus licheniformis MOL2083 (pCA164-LE399), that carries a hybrid gene from Bacillus amyloliquefaciens and Bacillus licheniformis coding for this enzyme. This alpha-amylase will be used in the production of brewers' mash, distillers' mash, dextrins, maltose, dextrose, glucose (glucose syrup) and glucose solids (dried glucose syrup). Evaluation of available data supports the safety and effectiveness of this alpha-amylase enzyme derived from the genetically modified Bacillus licheniformis MOL2083 (pCA164-LE399).

The use of this alpha-amylase enzyme derived from this modified micro-organism will benefit the consumer through the availability of quality food products. It will also benefit industry through more efficient and improved manufacturing conditions.

Therefore, it is the intention of Health Canada to recommend that the Food and Drug Regulations be amended to permit the use of this alpha-amylase enzyme derived from the genetically modified micro-organism specified above in the production of brewers' mash, distillers' mash, dextrins, maltose, dextrose, glucose (glucose syrup) and glucose solids (dried glucose syrup) at levels consistent with good manufacturing practice.

As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of the alpha-amylase enzyme, as indicated above, while the regulatory process is undertaken to formally amend the Regulations.

Health Canada has received a submission to permit the use of an invertase enzyme derived from a conventional strain of Aspergillus japonicus in the production of short-chain fructooligosaccharides. Evaluation of available data supports the safety and effectiveness of the invertase enzyme derived from the above-cited source.

The use of this invertase enzyme to produce short-chain fructooligosaccharides will benefit both the consumer and industry by providing a wider choice of bodying and texturing agents for use in the production of quality energy-reduced foods.

Therefore, it is the intention of Health Canada to recommend that the Food and Drug Regulations be amended to permit the use of this invertase enzyme derived from the micro-organism specified above, in the preparation of short-chain fructooligosaccharides, at levels consistent with good manufacturing practice.

As a means to improve the responsiveness of the regulatory system, an Interim Marketing Authorization (IMA) is being issued to permit the immediate use of this invertase enzyme, as indicated above, while the regulatory process is undertaken to formally amend the Regulations.

Interim Marketing Authorization

Provision currently exists in Table V to section B.16.100 of the Foods and Drug Regulations for the use of the enzyme lipase derived from various micro-organisms in the production of various food products, including cheese, at levels consistent with good manufacturing practice. The permitted sources of the lipase enzyme include the micro-organisms Aspergillus niger, Aspergillus oryzae, Penicillium camembertii, Rhizomucor miehei, Rhizopus niveus and Rhizopus oryzae.

Health Canada has received a submission to permit the use of a phospholipase enzyme derived from a genetically modified Aspergillus oryzae organism, Aspergillus oryzae (PFJo142), that carries the gene from Fusarium venenatum coding for this enzyme. Phospholipase enzymes are classified under the broad class of lipase enzymes. This phospholipase enzyme will be used in the production of Cheddar, Mozzarella and Pizza cheese, at levels consistent with good manufacturing practice. Evaluation of the available data supports the safety and effectiveness of this phospholipase derived from the genetically modified Aspergillus oryzae (PFJo142).

The use of this phospholipase enzyme derived from this new source will benefit the consumer through the availability of quality food products. It will also benefit industry through more efficient and improved manufacturing conditions.

Therefore, it is the intention of Health Canada to recommend that the Food and Drug Regulations be amended to permit the use of this phospholipase enzyme derived from the micro-organism specified above in the production of Cheddar, Mozzarella, and Pizza cheese, at levels consistent with good manufacturing practice.

Notice No. DGTP-006-06 — Proposed Spectrum Utilization Policy, Technical and Licensing Requirements for Wireless Broadband Services (WBS) in the Band 3 650-3 700 MHz

Intent

The purpose of this notice is to announce the release of the above-mentioned document which proposes to establish the spectrum policy, technical and licensing provisions to accommodate new Wireless Broadband Services (WBS) in the band 3 650-3 700 MHz.

Background

In September 2003, the Department released the Policy and Licensing Procedures for the Auction of Spectrum Licences in the 2 300 MHz and 3 500 MHz Bands and later auctioned 175 MHz in the band 3 475-3 650 MHz. At the time, the Department noted that there was a strong possibility that the United States would deploy licence-exempt devices in the band 3 650-3 700 MHz.

In October 2004, the Department released Revisions to Spectrum Utilization Policies in the 3-30 GHz Frequency Range and Further Consultation (DGTP-008-04). In this paper the Department requested comments on whether to make the band 3 650-3 700 MHz available for licence-exempt applications. Comments were also sought on the types of systems and services that could be implemented in the band and, noting the availability of licensed spectrum in the adjacent bands, whether there was a requirement to continue the designation for licensed services.

Comments supported general harmonization with the United States as being in the best interest of Canadians. In fact, the Department was urged to undertake a full consultative review of the band during which time the specific questions raised could be addressed more adequately.

In March 2005, the Federal Communications Commission adopted rules, different from their original plans of deploying licence-exempt devices, to open access to new spectrum for wireless broadband applications in the band 3 650-3 700 MHz.

Consequently, the Department is proceeding with this consultation which proposes to establish the spectrum policy, technical and licensing provisions to accommodate new WBS in the band 3 650-3 700 MHz. Interested parties are invited to submit comments on the proposals outlined in the consultation.

Respondents are requested to submit their comments no later than October 27, 2006, in electronic format (WordPerfect, Microsoft Word, Adobe PDF or ASCII TXT), along with a note specifying the software, version number and operating system used, to the following email address: wireless@ic.gc.ca.
