ASSISTED HUMAN REPRODUCTION ACT

Order Fixing December 1, 2007 as the Date of the Coming into Force of Section 8 of the Act

Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to section 78 of the Assisted Human Reproduction Act, assented to on March 29, 2004, being chapter 2 of the Statutes of Canada, 2004, hereby fixes December 1, 2007 as the day on which section 8 of that Act comes into force.

EXPLANATORY NOTE

(This note is not part of the Order.)

The Order fixes December 1, 2007 as the day on which section 8 of the Assisted Human Reproduction Act ("the Act") comes into force.

Section 8 of the Act prohibits making use of human reproductive material for the purpose of creating an embryo without the written consent of the donor and removing human reproductive material from a donor's body after their death without their written consent. Section 8 also prohibits making use of an in vitro embryo for any purpose without the written consent of the donor.

The Act provides for the making of regulations respecting the giving of consent required by section 8 of the Act. The Assisted Human Reproduction (Section 8 Consent) Regulations establish consent requirements based on the principle of free and informed consent. Those Regulations will also come into force on December 1, 2007.
