Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2007-084) on May 5, 2008, with respect to a complaint filed by Cifelli Systems Corporation (Cifelli), of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. W0103-063141/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of computers.

Cifelli alleged that PWGSC improperly evaluated its bid, used criteria that were not specified in the tender documents and, as a result, incorrectly awarded a contract to another bidder.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2008-012) from Cisco Systems Canada Co. (Cisco), of Toronto, Ontario, concerning a procurement (Solicitation No. M2989-084976/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Royal Canadian Mounted Police. The solicitation is for the provision of a telephone system. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

Cisco alleges that PWGSC improperly issued a competitive solicitation for the requirement instead of using existing standing offers and that PWGSC improperly biased the technical specifications in favour of Nortel brand equipment on a no-substitute basis and thereby failed to ensure equal access to the procurement.

Further to Broadcasting Notice of Public Hearing CRTC 2008-5, dated April 25, 2008, the Commission announces the following:

Montréal Hearing, June 2, 2008

The Commission will hold the first day of the hearing on Monday, June 2, 2008, at 9 a.m., at the Hyatt Regency Montréal Hotel, 1255 Jeanne-Mance Street, Montréal, Quebec.

During the hearing in Montréal, the Commission expects TQS inc. (TQS) to present its application seeking authority for a change to its effective control, as well as its licence renewal applications for its network and its Montréal and Sherbrooke stations. This presentation will be followed by questions by the Commission.

The Commission will then hear the presentations by interveners from Montréal, Sherbrooke and the Outaouais and Abitibi-Témiscamingue regions who, in their written comments, requested to appear. Given that the Commission will sit only one day in Montréal, some interveners from Montréal and Sherbrooke may be invited to make their presentations in Québec. The Commission will communicate with the interveners prior to the hearing to confirm the location and date of their appearance.

The Commission will resume the hearing on Tuesday, June 3, 2008, at the Château Laurier Hotel, 1220 Place George-V W, Québec, Quebec.

During the hearing in Québec, TQS is expected to summarize its presentation of the previous day for the benefit of interveners who were not present in Montréal and then focus on the programming issues, as well as any other issues relating to the Québec, Trois-Rivières and Saguenay regional stations. This presentation will be followed by questions by the Commission.

The Commission will then hear the presentations by interveners from Québec, Trois-Rivières and Saguenay who, in their written comments, requested to appear. The Commission will communicate with the interveners prior to the hearing to confirm their appearance.

After these presentations, TQS will have an opportunity to reply to all the interventions filed regarding its applications.
