Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-03477 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: 568849 B.C. Ltd., Surrey, British Columbia.

 2. Waste or other matter to be disposed of: Inert, inorganic geological matter.

2.1. Nature of waste or other matter: Inert, inorganic geological matter; all wood, topsoil, asphalt and other debris is to be segregated for disposal by methods other than disposal at sea.

 3. Duration of permit: Permit is valid from May 24, 2009, to May 23, 2010.

 4. Loading site(s): Various approved excavation sites in British Columbia, at approximately 49°16.35′ N, 123°06.70′ W (NAD83).

 5. Disposal site(s):

(a) Point Grey Disposal Site, within a one-nautical mile radius of 49°15.40′ N, 123°21.90′ W (NAD83);

(b) Victoria Disposal Site, within a 0.5-nautical mile radius of 48°22.30′ N, 123°21.90′ W (NAD83);

(c) Watts Point Disposal Site, within a 0.25-nautical mile radius of 48°38.50′ N, 123°14.10′ W (NAD83);

(d) Brown Passage Disposal Site, within a 0.5-nautical mile radius of 54°18.50′ N, 130°45.50′ W (NAD83);

(e) Johnstone Strait-Hanson Island Disposal Site, within a 0.5-nautical mile radius of 50°33.50′ N, 126°48.00′ W (NAD83);

(f) Johnstone Strait-Hickey Point Disposal Site, within a 0.5-nautical mile radius of 50°27.80′ N, 126°04.90′ W (NAD83);

(g) Cape Mudge Disposal Site, within a 0.5-nautical mile radius of 49°57.70′ N, 125°05.00′ W (NAD83);

(h) Comox (Cape Lazo) Disposal Site, within a 0.5-nautical mile radius of 49°41.70′ N, 124°44.50′ W (NAD83);

(i) Five Finger Island Disposal Site, within a 0.5-nautical mile radius of 49°15.20′ N, 123°54.70′ W (NAD83);

(j) Thornbrough Channel Disposal Site, within a 0.25-nautical mile radius of 49°31.00′ N, 123°28.30′ W (NAD83);

(k) Porlier Pass Disposal Site, within a 0.5-nautical mile radius of 49°00.20′ N, 123°29.90′ W (NAD83); and

(l) Malaspina Strait Disposal Site, within a 0.5-nautical mile radius of 49°45.00′ N, 124°27.00′ W (NAD83).

 6. Method of loading: Loading will be carried out using land-based heavy equipment, trucks or conveyor belts.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site via pipeline, hopper scow, towed scow or hopper dredge.

 8. Method of disposal: Disposal will be carried out by bottom dumping or end dumping.

 9. Total quantity to be disposed of: Not to exceed 100 000 m3.

10. Approvals:

10.1. The Permittee shall obtain from the permit-issuing office a letter of approval for each loading and disposal activity prior to undertaking the work.

11. Fees: The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

12. Inspection:

12.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

12.2. The Permittee shall ensure that records of all loading and disposal activities are kept on site for the duration of the permit and are available for inspection for two years following the expiry of the permit by any enforcement officer or analyst.

12.3. Ships operating under the authority of this permit shall carry and display a radar-reflecting device at all times mounted on the highest practical location.

13. Contractors:

13.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

13.2. The Permittee shall ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of the conditions identified in the permit and of possible consequences of any violation of these conditions.

14. Reporting and notification:

14.1. The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to Environment Canada’s Environmental Enforcement Division, Pacific and Yukon Region, by fax to 604-666-9059 or by email at das.pyr@ec.gc.ca.

14.2. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of the Environmental Protection Operations Directorate, Pacific and Yukon Region, 201–401 Burrard Street, Vancouver, British Columbia V6C 3S5, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: a list of all work completed pursuant to the permit, including the names of the loading and disposal sites used, the quantity of matter disposed of at each disposal sites, and the dates on which disposal activities occurred.

Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-04340 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Department of Public Works and Government Services, Quebec.

 2. Waste or other matter to be disposed of: Dredged material.

2.1. Nature of waste or other matter: Dredged material consisting of gravel, sand, silt, clay and colloids.

 3. Duration of permit: Permit is valid from May 25, 2009, to May 24, 2010.

3.1. The loading and disposal at sea activities are restricted to the following periods: from May 25 to May 31, 2009, from July 16 to August 14, 2009, and from October 1, 2009, to April 14, 2010. The Permittee may modify the duration of the permit with the written approval of the Department of the Environment.

 4. Loading site(s): Cap-des-Rosiers Harbour, Quebec, 48°50.35′ N, 64°12.69′ W (NAD83), as defined in Figure 4.2 of the document titled “Examen préalable. Dragage d’entretien du havre de Cap-des-Rosiers (révision 2009)” by Parks Canada Agency and approved by the Department of the Environment.

 5. Disposal site(s): CR-1, 48°50.40′ N, 64°09.40′ W (NAD83). The disposal site is located at approximately 4.3 km east from the loading site.

 6. Method of loading: Dredging will be carried out using a clamshell dredge or a hydraulic shovel.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site using towed scow.

 8. Method of disposal: Disposal will be carried out by bottom dumping and levelling of the seabed by a steel beam, a scraper blade or a hydraulic shovel.

 9. Total quantity to be disposed of: Not to exceed 5 000 m3 scow measure.

10. Fees: The fee prescribed by the Ocean Dumping Permit Fee Regulations (Site Monitoring) shall be paid by the Permittee in accordance with those Regulations.

11. Inspection:

11.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11.2. The Permittee shall ensure that records of all loading and disposal activities are kept on site for the duration of the permit and are available for inspection by any enforcement officer or analyst for two years following the expiry of the permit.

The above-noted information shall be submitted to the Regional Director, Environmental Protection Operations Directorate, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, 514-496-6982 (fax), immersion.dpe@ec.gc.ca (email).

13.2. The Permittee must complete the Register of Disposal at Sea Operations as provided by the Department of the Environment. This register must, at all times, be kept aboard any vessel involved with the disposal operations and be accessible to enforcement officers designated under the Canadian Environmental Protection Act, 1999.

13.3. The Permittee shall submit a written report to the Minister, as represented by the Regional Director identified in paragraph 13.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: a list of all work completed pursuant to the permit, including the names of the loading and disposal sites used, the quantity of matter disposed of at the disposal site, the dates on which disposal activities occurred and the Register of Disposal at Sea Operations.

13.4. The Permittee must keep a written register of the time of departure of the vessel to the disposal site and advise the Canadian Coast Guard station once per day of the departure times entered in the register. The Permittee must record these communications in the register mentioned in the paragraph 13.2.

13.5. At all times, a copy of this permit and of documents and drawings referenced in this permit shall be available at the loading site and on all powered ships directly engaged in the loading and disposal operations.

 1. Permittee: Atlantic Cold Sea Foods Limited, St. Joseph’s, Newfoundland and Labrador.

 2. Waste or other matter to be disposed of: Fish waste and other organic matter resulting from industrial fish-processing operations.

2.1. Nature of waste or other matter: Fish waste and other organic matter consisting of fish and shellfish waste.

 3. Duration of permit: Permit is valid from May 25, 2009, to May 24, 2010.

 4. Loading site(s): St. Joseph’s, Newfoundland and Labrador, at approximately 47°07.10′ N, 53°31.20′ W (NAD83).

 5. Disposal site(s): St. Joseph’s, within a 250-m radius of 47°06.60′ N, 53°34.40′ W (NAD83), at an approximate depth of 70 m.

 6. Method of loading: The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

6.1. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

6.2. Material loaded for the purpose of disposal at sea may not be held aboard any ship for more than 96 hours from the commencement of loading without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

6.3. The loading and transit shall be completed in a manner that ensures that no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee shall also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site.

 8. Method of disposal: The Permittee shall ensure that the waste to be disposed of shall be discharged from the equipment or ship while steaming within the disposal site boundaries and in a manner which will promote dispersion.

 9. Total quantity to be disposed of: Not to exceed 1 400 tonnes.

10. Inspection:

10.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11. Contractors:

11.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

11.2. The Permittee shall ensure that all contractors involved in the loading or disposal activity for which the permit is issued are made aware of the conditions identified in the permit and of possible consequences of any violation of these conditions.

 6. Method of loading: The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

 4. Loading site(s): Witless Bay, Newfoundland and Labrador, at approximately 47°16.74′ N, 52°49.42′ W, (NAD83).

 5. Disposal site(s): Witless Bay, within a 250-m radius of 47°16.34′ N, 52°47.54′ W (NAD83), at an approximate depth of 50 m.

 6. Method of loading: The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-06575 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

 1. Permittee: Hickey & Sons Fisheries Ltd., St. John’s, Newfoundland and Labrador.

 2. Waste or other matter to be disposed of: Fish waste and other organic matter resulting from industrial fish-processing operations.

2.1. Nature of waste or other matter: Fish waste and other organic matter consisting of fish and shellfish waste.

 3. Duration of permit: Permit is valid from May 25, 2009, to May 24, 2010.

 4. Loading site(s): O’Donnell’s, Newfoundland and Labrador, at approximately 47°04.10′ N, 53°34.30′ W (NAD83).

 5. Disposal site(s): O’Donnell’s, within a 250-m radius of 47°04.00′ N, 53°38.00′ W (NAD83), at an approximate depth of 50 m.

 6. Method of loading: The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

6.1. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

6.2. Material loaded for the purpose of disposal at sea may not be held aboard any ship for more than 96 hours from the commencement of loading without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

6.3. The loading and transit shall be completed in a manner that ensures that no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee shall also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

 7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site.

 8. Method of disposal: The Permittee shall ensure that the waste to be disposed of shall be discharged from the equipment or ship while steaming within the disposal site boundaries and in a manner which will promote dispersion.

 9. Total quantity to be disposed of: Not to exceed 1 000 tonnes.

10. Inspections:

10.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11. Contractors:

11.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

11.2. The Permittee shall ensure that all contractors involved in the loading or disposal activities for which the permit is issued are made aware of the conditions identified in the permit and of possible consequences of any violation of these conditions.

12. Reporting and notification:

12.1. The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: the expected period of loading and disposal activities. The above-noted information shall be submitted to Mr. Rick Wadman, Environmental Protection Operations Directorate, Environment Canada, 6 Bruce Street, Mount Pearl, Newfoundland and Labrador A1N 4T3, 709-772-5097 (fax), rick.wadman@ec.gc.ca (email).

12.2. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of the Environmental Protection Operations Directorate, c/o Mr. Rick Wadman, as identified in paragraph 12.1, within 30 days of either the completion of the work or the expiry of the permit, whichever comes first. This report shall contain the following information: the quantity of matter disposed of at the disposal site and the dates on which disposal activities occurred.

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether the substances listed in Schedule 1 to this notice are toxic or are capable of becoming toxic, or for the purpose of assessing whether to control, or the manner in which to control the listed substances, any person described in Schedule 2 to this notice who possesses or who may reasonably be expected to have access to the information required in Schedule 3 to this notice, to provide that information no later than August 25, 2009, 3 p.m. Eastern Daylight Time.

1. This notice applies to any substances that meet the following criteria:

(a) Alternative substances to phosphorus compounds used or considered for use in household laundry detergents; or

(b) Alternative substances to phosphorus compounds used or considered for use in household dish-washing compounds; or

(c) Alternative substances to phosphorus compounds used or considered for use in household cleaners (other than laundry detergents, dish-washing compounds, metal cleaners or degreasing compounds).

2. Despite section (1), this notice does not apply to Glycine, N,N-bis(carboxymethyl)- (NTA), which has a CAS RN (see footnote 1) of 139-13-9.

SCHEDULE 2

Persons Required to Provide Information

1. This notice applies to any person who manufactured and/or imported a total combined quantity of greater than 10 000 kg, for any given calendar year since January 1, 2004, of a household laundry detergent and/or of a household dish-washing compound and/or of a household cleaner (other than laundry detergents, dish-washing compounds, metal cleaners or degreasing compounds) that exceeded a phosphorus compound concentration of 0.5 % by weight, expressed as elemental phosphorus.

1. The definitions in this section apply to this notice.

“calendar year” means a period of 12 consecutive months commencing on January 1.

“import” includes movement into Canada, as well as internal company transfers across the Canadian border.

“manufacture” excludes incidental production.

2. If any of the information being requested in this notice has already been sent to a department, agency or board of the federal government, the supplier of that information is required to provide the name of the person or branch in that department, agency or board to which the information was sent, their affiliate (if applicable), and the date on which the information was sent and to specify, by reference to the sections of this notice, the information sent on that occasion. Please note that the specified information already submitted to the other department, agency or board is not required to be resubmitted under this notice.

3. If the person subject to the notice is a company, response to the notice shall be submitted on a company-wide basis.

(d) Indicate whether an alternative substance to phosphorus compound is currently being used or being considered for use in the product type reported in column (a), by checking the appropriate box;

(e) If reported “Yes” in column (d), provide CAS RN (see footnote 2) of the alternative substance to phosphorus compound which is currently being used or being considered for use in the product type reported in column (a). If the alternative to phosphorus compound which is currently being used or being considered for use is made up of multiple substances, report each alternative substance as a separate entry in the table;

EXPLANATORY NOTE

(This note is not part of the notice.)

This notice has been issued to identify substances that will be or are being considered as alternatives to phosphorus compounds in household laundry detergents, dish-washing compounds and cleaners. This information will be used to determine whether there are hazards associated with these alternatives based on likely levels of exposure to the environment.

The Department of the Environment plans to conduct an assessment of an alternative substance to phosphorus compound, Glycine, N,N-bis(carboxymethyl)- (NTA), which is a substance included in Batch 8 of the Chemicals Management Plan’s “Challenge” initiative. Response on NTA (CAS RN 139-13-9) is excluded from this notice as it is already included in the CEPA 1999 section 71 notice for Batch 8. The Batch 8 notice will capture all import, manufacture and use of NTA, regardless of the product type.

Indicate clearly in writing the parts of your submission that are considered to be Confidential Business Information (CBI) by your company and provide justification for your CBI claims.

This notice is published in the Canada Gazette, Part I, under paragraph 71(1)(b) of the Act. This notice requires the persons to whom it applies to provide certain information on their activities with respect to the substances identified in Schedule 1 to this notice. Pursuant to subsection 71(3) of the Act, every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The time specified in this notice is August 25, 2009, 3 p.m. Eastern Daylight Time.

Compliance with the Act is mandatory. Subsection 272(1) of the Act provides that

272. (1) Every person commits an offence who contravenes

(a) a provision of this Act or the regulations;

(b) an obligation or a prohibition arising from this Act or the regulations;

(c) an order or a direction made under this Act;

Subsection 272(2) of the Act provides that

272. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) of the Act provides that

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

(a) provides any person with any false or misleading information, results or samples; or

(b) files a document that contains false or misleading information.

Subsection 273(2) of the Act provides that

273. (2) Every person who commits an offence under subsection (1) is liable

(a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;

(b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;

(c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and

(d) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed negligently.

The above-noted consultation was published in the Canada Gazette on Saturday, March 28, 2009, as Notice DGRB-002-09. The deadline for the receipt of comments was indicated as April 30, 2009, while the deadline for receipt of reply comments was June 1, 2009.

The purpose of this notice is to advise all interested parties that, based on the merits of a request for additional time by the Canadian Wireless Telecommunications Association (CWTA), the deadline for the receipt of comments has been extended to May 29, 2009. The reply comment period has also been extended to June 30, 2009. All comments received will be posted on Industry Canada’s Spectrum Management and Telecommunications Web site at http://ic.gc.ca/spectrum.

NOTICE OF VACANCY

Chair, Board of Management (part-time position)

The Canada Revenue Agency (CRA) is a large and complex organization that touches the lives of Canadians every day. Its mission is to administer tax, benefits and related programs and to ensure compliance on behalf of governments across Canada, thereby contributing to the ongoing economic and social well-being of Canadians. The CRA has a workforce of up to 44 000 employees located across Canada with an annual budget of over $4 billion. The CRA’s unique governance structure is comprised of a Minister, a Commissioner and Chief Executive Officer, and a Board of Management as defined in the Canada Revenue Agency Act.

The Board of Management was established in 1999 to support the Agency in achieving its mission and mandate. It is composed of 15 appointed members, including the Chair, and the Commissioner and CEO. The Board provides strategic guidance and oversees the organization and administration of the CRA and the management of its resources, services, property, personnel and contracts. It is expected to bring a forward-looking, strategic perspective to the CRA’s operations and foster sound management and service delivery.

The role of the Chair of the Board of Management is to facilitate highly effective Board performance. This is achieved by providing leadership in the management of the Board’s affairs and by ensuring that the Board fulfills its legislated mandate and responsibilities with full transparency and the application of sound governance practices. The Chair is responsible for guiding the Board in the fulfillment of its mandate and convening and presiding over Board meetings. He or she is required to participate in approximately five in-person meetings per year with the Board of Management, as well as participate in regular teleconferences and ad hoc meetings as needed.

The selected candidate must have a degree from a recognized university in a relevant field of study, or an acceptable combination of education, job-related training and/or experience. Training in board governance such as through the Institute of Corporate Directors would be an asset.

The successful candidate must possess the required experience and abilities within the following five core competencies:

  • Organization and leadership: demonstrated leadership and decision-making qualities and organizational abilities to ensure that Board meetings are conducted in an efficient, effective, and focused manner.
  • Communications and public relations: demonstrated communications experience in order to speak on behalf of the Board when required.
  • Corporate governance: extensive experience in corporate governance, including the co-ordination of committees and the selection of committee members; capacity to ensure proper deliberations on all matters requiring the Board’s attention; demonstrated ability to ensure cohesion of direction and purpose at a policy and strategic level.
  • Team- and consensus-building: demonstrated ability for team- and consensus-building; excellent listening skills in order to act as a sounding board for the Commissioner and CEO and other directors, and to build relationships with the members of the Board; ability to foster a constructive and harmonious relationship between the Board and Agency management.
  • Corporate management: demonstrated experience in successfully managing large organizations in order to identify problems, review strategies, and maintain accountability; experience in board capacity development and succession planning.

In addition, knowledge of the roles and responsibilities of the Chair and of the Canada Revenue Agency Board of Management is required. The chosen candidate must also have knowledge of the Canada Revenue Agency’s mandate and of the legislative framework within which it operates. Good knowledge of the current best practices in corporate governance is essential.

The Chair must possess high ethical standards and integrity. He or she will have superior interpersonal skills and sound judgment, tact, as well as discretion and initiative.

Proficiency in both official languages is required.

The qualified candidate must be willing to travel throughout Canada to meetings of the Board of Management.

Pursuant to the CRA’s enabling legislation, the Chair of the Board must be a Canadian citizen or a permanent resident. The incumbent cannot be a member of the Senate or House of Commons or a member of a provincial or territorial legislature, or be employed on a full-time basis in the public service of Canada or of a province or territory.
