The Minister of Agriculture and Agri-Food, pursuant to subsection 24(1) and section 25 of the Canadian Food Inspection Agency Act, hereby amends the Canadian Food Inspection Agency Fees Notice, published in the Canada Gazette, Part I, on May 13, 2000, in accordance with the annexed notice.

NOTICE AMENDING THE CANADIAN FOOD INSPECTION AGENCY FEES NOTICE

AMENDMENTS

1. The portion of item 3 of the table to Part 6 of the Canadian Food Inspection Agency Fees Notice (see footnote 1) in column 1 is replaced by the following:

EXPLANATORY NOTE

The Canadian Food Inspection Agency Fees Notice (Fees Notice) was made by the Minister of Agriculture and Agri-Food on May 13, 2000, under the authority of the Canadian Food Inspection Agency Act.

Canada’s regulatory framework respecting the marketing of fresh fruit and vegetables compels dealers (persons handling fresh fruit and vegetables) licensed pursuant to the Licensing and Arbitration Regulations to request a commercial quality inspection, otherwise known as destination inspection, from the Canadian Food Inspection Agency (CFIA) when handling a product that is alleged to have arrived in damaged or deteriorated condition.

A destination inspection is intended to provide buyers and sellers of fresh produce with an impartial report on the condition of the product. A destination inspection therefore helps to maintain fair competition and to balance the interests of producers, wholesalers and retailers, dominant players and minor players in a marketplace because there is a third party providing unbiased evidence in situations where disputes occur.

The CFIA is promulgating regulations for a Destination Inspection Service that will make use of service contracts for these inspections, eventually setting out the new fees in the Fees Notice. Amendments to the Licensing and Arbitration Regulations and the Fresh Fruit and Vegetable Regulations will remove the requirements associated with a destination inspection to be provided only by the CFIA in order to permit the use of private commercial quality inspection as well. This will allow the produce industry and CFIA to move to a stronger business model to manage requests for commercial quality inspection service, delivery of destination inspections, and fees.

The attached notice repeals the service and dumping fees associated with destination inspection under the Canadian Food Inspection Agency Fees Notice that are no longer required.

Further to Broadcasting Notices of Consultation 2010-783 and 2010-783-1, in regard to a request from High Fidelity HDTV Inc. relating to the publication of financial information for individual specialty television services, the Commission notes that the aim of the vertical integration hearing is to put in place norms for commercial interaction among interested parties within the broadcasting sector that would provide all players with a fair opportunity to negotiate for such key elements as programming rights and details of carriage. The Commission has announced its intention to discuss what specific measures, if any, should be contemplated to take into account the particular situation of smaller independent broadcasting services. Consequently,

  • the Commission considers that it would be appropriate to include the matter of confidentiality of financial information for individual specialty services under the scope of this proceeding; and
  • the publication of financial information relating to individual category 2 digital pay and specialty services for the broadcast year ended August 31, 2010, will be deferred pending the deliberation and determinations in the vertical integration hearing, which will deal with the confidentiality request submitted by High Fidelity HDTV Inc.

Amendment to the Call for applications for licences to operate a French-language general interest pay television service and call for comments

In Broadcasting Notice of Consultation 2010-860, the Commission expressed its preliminary view that a second French-language pay television service could be viable, provided that it was complementary rather than directly competitive with Super Écran. The Commission added that it considered that there existed a significant repertoire of quality content that was not currently broadcast by Super Écran and that could allow a second general-interest pay television service to support itself and add diversity for the consumer and the broadcasting system.

The Commission is now seeking comments on its preliminary view expressed in Broadcasting Regulatory Policy 2010-861. If the Commission determines that this preliminary view cannot be sustained, it is prepared, in the context of this call, to entertain applications for a second French-language general-interest pay television service that would be directly competitive with Super Écran.

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Noble Americas Gas & Power Corp.

By an application dated February 18, 2011, Noble Americas Gas & Power Corp. (the “Applicant”) has applied to the National Energy Board (the “Board”), under Division II of Part VI of the National Energy Board Act (the “Act”), for authorization to export up to 50 000 MWh of combined firm and interruptible energy annually for a period of 10 years.

The Board wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that a public hearing be held. The directions on procedure that follow explain in detail the procedure that will be used.

1. The Applicant shall deposit and keep on file, for public inspection during normal business hours, copies of the application at its offices located at Stikeman Elliott LLP, 4300 Bankers Hall West, 888 3rd Street SW, Calgary, Alberta T2P 5C5, 403-266-9028 (telephone), Attention: Matthew Synnott, and provide a copy of the application to any person who requests one. A copy of the application is also available for viewing during normal business hours in the Board’s library, at 444 Seventh Avenue SW, Room 1002, Calgary, Alberta T2P 0X8, or online at www.neb-one.gc.ca.

2. Submissions that any party wishes to present shall be filed with the Secretary, National Energy Board, 444 Seventh Avenue SW, Calgary, Alberta T2P 0X8, 403-292-5503 (fax), and served on the Applicant by March 21, 2011.

3. Pursuant to subsection 119.06(2) of the Act, the Board shall have regard to all considerations that appear to it to be relevant. In particular, the Board is interested in the views of submitters with respect to

  • (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported;
  • (b) the impact of the exportation on the environment; and
  • (c) whether the Applicant has
    • (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
    • (ii) given an opportunity to purchase electricity on terms and conditions as favourable as the terms and conditions specified in the application to those who, within a reasonable time of being so informed, demonstrate an intention to buy electricity for consumption in Canada.

4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this notice of application and directions on procedure shall be filed with the Secretary of the Board and served on the party that filed the submission by April 5, 2011.
