Call for comments on amendments to the Exemption order for terrestrial broadcasting distribution undertakings serving fewer than 20,000 subscribers

The Commission calls for written comments on proposed amendments to the Exemption order respecting terrestrial broadcasting distribution undertakings serving fewer than 20,000 subscribers, set out in Exemption order for terrestrial broadcasting distribution undertakings serving fewer than 20,000 subscribers, Broadcasting Order CRTC 2009-544, August 31, 2009.

The proposed amendments, which are set out in the appendix to the notice, are a result of Commission determinations set out in Community Television Policy, Broadcasting Regulatory Policy CRTC 2010-622, August 26, 2010. In particular, the Commission determined that it would be appropriate to (1) reintroduce the requirement that exempt terrestrial broadcasting distribution undertakings (BDUs) serving more than 2 000 subscribers contribute to Canadian programming; and (2) establish criteria whereby exempt BDUs would be allowed to form zone-based community channels.

The deadline for submitting comments in regard to the proposed amendments is May 20, 2011. The deadline for submitting replies is June 10, 2011.

At the April 4, 2011 hearing, the Commission indicated that parties in the proceeding would have an opportunity to file final written submissions following the hearing. In the present notice, the Commission announces that it will provide applicants until April 20, 2011, to respond to questions raised in the final phase of the oral proceeding. In addition, the Commission will accept final written submissions from interveners in this proceeding provided that they send a copy to the applicants and submit their comments on or before April 29, 2011. The applicants may file a final reply, with a copy sent to concerned interveners, by May 6, 2011.

Final submissions of interveners should be no more than 10 pages, excluding information requested by the Commission during the oral phase of the proceeding. Parties are reminded that no new evidence should be introduced in their final submissions or replies with the exception of information requested by the Commission.
