The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2012-035) from Mistral Security Inc. (Mistral), of Bethesda, Maryland, U.S.A., concerning a procurement (Solicitation No. W8486-136120/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence (DND). The solicitation is for the provision of explosive storage containers. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

Mistral alleges that PWGSC and DND have biased the technical specifications of the solicitation in favour of another supplier. Furthermore, Mistral alleges that PWGSC and DND have failed to provide adequate time to allow suppliers to prepare and submit tenders before the bid closing date, have failed to provide clear criteria for awarding the contract and have failed to provide equal access to procurement to all potential suppliers.

On April 1, 2011, the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure came into force. As indicated in Part 1 of these Rules, some broadcasting applications are posted directly on the Commission's Web site, www.crtc.gc.ca, under “Part 1 Applications.”

FARM PRODUCTS COUNCIL OF CANADA

FARM PRODUCTS AGENCIES ACT

Notice of public hearings as part of an inquiry into the merits of establishing a Canadian pullet marketing agency

The Farm Products Council of Canada (FPCC) has received from the Pullet Growers of Canada a proposal to establish a Canadian pullet marketing agency, to be funded by levies applied to Canadian pullets marketed in interprovincial and export trade markets.

The Council, pursuant to section 8 of the Farm Products Agencies Act (the Act), hereby provides notice that pursuant to the direction of the Chairman, a panel consisting of two members of the Council will hold public hearings to determine the merits of establishing such an agency, pursuant to section 16 of the Act.

The Panel will determine the places and times of the hearings (please see the notice of conference below), which will be published in a subsequent notice. The panellists are Council Vice-Chairman Mr. Brent Montgomery as Panel Chair and Council member Mr. John Griffin.

The Panel will submit the results of its inquiry to the full Council and the Council will make recommendations to the Minister of Agriculture and Agri-Food Canada.

The Panel will inquire into and review

  • (a) the current status of Canadian pullet producers and the degree of support among them for establishing a marketing agency;

  • (b) the potential effects of establishing a national marketing agency on the operations of pullet and egg producers;

  • (c) the means for ensuring that a marketing agency has due regard for the interests of pullet and egg producers, processors and consumers;

  • (d) the Pullet Growers of Canada's proposal for a marketing plan;

  • (e) the degree and nature of federal-provincial cooperation required to implement the proposed marketing plan, including the proposed “phase-in” approach to provincial participation, the efficient dovetailing of levy collection under federal and provincial jurisdictions and its consistency with the Agreement on Internal Trade;

  • (f) the collection of levies on marketed pullets, including its consistency with Canada's rights and obligations under international trade agreements and import controls; and

  • (g) whether any restrictions should be placed on the activities of a pullet marketing agency or on any of the powers to be exercised pursuant to section 22 of the Act.

Parties wishing to attend this conference should notify the Hearing Secretary no later than 8 p.m. (Eastern Standard Time) on March 5, 2013, for the exact location of the conference, call-in information and draft agenda.
