Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2014-040) on March 25, 2015, with respect to a complaint filed by R.P.M. Tech Inc. (R.P.M.), of Laval, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. W7701-155973A) by the Department of Public Works and Government Services (PWGSC). The solicitation was for the provision of a loader-mounted snow blower.

R.P.M. alleged that PWGSC drafted the request for proposal specifying technical elements to the advantage of a particular manufacturer.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade and the North American Free Trade Agreement, the Tribunal determined that the complaint was not valid.

On April 1, 2011, the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure came into force. To be up to date on all ongoing proceedings, it is important to regularly consult “Today's Releases” on the Commission's Web site, which includes daily updates to notices of consultation that have been published and ongoing proceedings, as well as a link to Part 1 applications.

The following documents are abridged versions of the Commission's original documents. RULES AMENDING THE CANADIAN RADIO-TELEVISION AND TELECOMMUNICATIONS COMMISSION RULES OF PRACTICE AND PROCEDURE

AMENDMENTS

1. Section 2 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (see footnote 1) is replaced by the following:

(1) Except if they provide otherwise, these Rules apply to all proceedings before the Commission other than a proceeding arising from an application listed in Schedule 1 or from a contravention of a prohibition or requirement of the Commission for which a person is liable to an administrative monetary penalty under any of sections 72.001 to 72.19 of the Telecommunications Act, unless the penalty is imposed in the course of a proceeding referred to in section 72.003 of that Act.

(2) These Rules do not apply to proceedings before the Commission under sections 6 to 46 of An Act to promote the efficiency and adaptability of the Canadian economy by regulating certain activities that discourage reliance on electronic means of carrying out commercial activities, and to amend the Canadian Radio-television and Telecommunications Commission Act, the Competition Act, the Personal Information Protection and Electronic Documents Act and the Telecommunications Act.

2. The heading before section 53 of the Rules is replaced by the following:

4. These Rules come into force on the day on which they are registered.
