Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) issued an order on March 17, 2016, with respect to a complaint (File No. PR-2015-038) filed by Eclipsys Solutions Inc., of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement by the Canada Border Services Agency. The solicitation was for the provision of software.

Pursuant to paragraph 10(a) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, the Tribunal ordered the dismissal of the complaint because it had determined that the complaint had no valid basis.

CANADIAN INTERNATIONAL TRADE TRIBUNAL

EXPIRY REVIEW OF ORDERS

Copper pipe fittings

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review of its orders made on February 17, 2012, in Expiry Review No. RR-2011-001, continuing, without amendment, its findings made on February 19, 2007, in Inquiry No. NQ-2006-002, concerning the dumping of solder joint pressure pipe fittings and solder joint drainage, waste and vent pipe fittings, made of cast copper alloy, wrought copper alloy or wrought copper, for use in heating, plumbing, air conditioning and refrigeration applications (copper pipe fittings), originating in or exported from the United States of America, the Republic of Korea and the People's Republic of China, and the subsidizing of such goods originating in or exported from the People's Republic of China, restricted to the products enumerated in the appendix (the subject goods). The orders are scheduled to expire on February 16, 2017.

In this expiry review (Expiry Review No. RR-2015-003), the Canada Border Services Agency (CBSA) will first determine whether the expiry of the orders in respect of the subject goods is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. If the CBSA determines that the expiry of the orders in respect of any goods is likely to result in the continuation or resumption of dumping and/or subsidizing, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping and/or subsidizing are likely to result in injury. The CBSA must provide notice of its determinations within 120 days after receiving notice of the Tribunal's decision to initiate an expiry review, that is, no later than July 20, 2016. The Tribunal will issue its order no later than November 28, 2016, and its statement of reasons no later than December 12, 2016.

Each person or government wishing to participate in this expiry review must file a notice of participation with the Tribunal on or before August 4, 2016. Each counsel who intends to represent a party in the expiry review must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before August 4, 2016.

The Tribunal will hold a public hearing relating to this expiry review in the Tribunal's Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing on October 11, 2016, at 9:30 a.m., to hear evidence and representations by interested parties.
