SPECIAL IMPORT MEASURES ACT

Certain silicon metal — Decisions

On July 5, 2017, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made a preliminary determination of dumping concerning certain silicon metal originating in or exported from the Federative Republic of Brazil (Brazil), the Republic of Kazakhstan (Kazakhstan), Lao People's Democratic Republic, Malaysia, the Kingdom of Norway (Norway) and the Kingdom of Thailand (Thailand), and made a preliminary determination of subsidizing concerning certain silicon metal originating in or exported from Brazil, Kazakhstan, Malaysia, Norway and Thailand.

On the same date, the President of the Canada Border Services Agency, pursuant to paragraph 35(2)(a) of SIMA, terminated the dumping investigation in respect of certain silicon metal originating in or exported from the Russian Federation.

The subject goods are usually classified under the following Harmonized System number:

The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the domestic industry and will make an order or finding no later than 120 days after its receipt of the notice of the preliminary determinations of dumping and subsidizing.

Pursuant to section 8 of SIMA, provisional duty is payable on subject goods that are released from the CBSA during the period commencing July 5, 2017, and ending on the earlier of the day the investigations are terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.

The amount of provisional duty payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

COMMENCEMENT OF INQUIRY

Silicon metal

Notice was received by the Canadian International Trade Tribunal (the Tribunal) on July 5, 2017, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that preliminary determinations (Inquiry No. NQ-2017-001) had been made respecting the dumping of silicon metal containing at least 96.00% but less than 99.99% silicon by weight, and silicon metal containing between 89.00% and 96.00% silicon by weight that contains aluminum greater than 0.20% by weight, of all forms and sizes, originating in or exported from the Federative Republic of Brazil, the Republic of Kazakhstan, Lao People's Democratic Republic, Malaysia, the Kingdom of Norway and the Kingdom of Thailand, and subsidizing of the above-mentioned goods originating in or exported from the Federative Republic of Brazil, the Republic of Kazakhstan, Malaysia, the Kingdom of Norway and the Kingdom of Thailand.

Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry to determine whether the dumping and subsidizing of the above-mentioned goods have caused injury or retardation or are threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.

Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Tribunal on or before July 20, 2017. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before July 20, 2017.

A public hearing relating to this inquiry will be held in the Tribunal's Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing on October 2, 2017, at 9:30 a.m., to hear evidence and representations by interested parties.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

EXPIRY OF FINDING

Steel piling pipe

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), that its finding made on November 30, 2012, in Inquiry No. NQ-2012-002, concerning the dumping and subsidizing of carbon and alloy steel pipe piles, commonly identified as piling pipe, in outside diameter ranging from 3 1/2 inches up to and including 16 inches (8.9 cm to 40.6 cm) inclusive, in commercial quality and in various forms and finishes, usually supplied to meet ASTM A252, ASTM A500, CSA G.40.21 or comparable specifications or standards, whether single, dual or multiple certified, excluding carbon steel welded pipe, in the nominal size range of 3 1/2 inches up to and including 6 inches (89 mm to 168.3 mm) in outside diameter, in various forms and finishes, usually supplied to meet ASTM A252 or equivalent specifications, other than carbon steel welded pipe in the nominal size range of 3 1/2 inches up to and including 6 inches, dual-stencilled to meet the requirements of both specification ASTM A252, Grades 1 to 3, and specification API 5L, with bevelled ends and in random lengths, for use as foundation piles, originating in or exported from the People's Republic of China, is scheduled to expire (Expiry No. LE-2017-002) on November 29, 2017. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.

The Tribunal's expiry proceeding will be conducted by way of written submissions. Any firm, organization, person or government wishing to participate as a party in these proceedings must file a notice of participation with the Tribunal on or before July 24, 2017. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before July 24, 2017.

On July 25, 2017, the Tribunal will distribute the list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. One electronic copy of all submissions must be served on the Tribunal.

Parties requesting or opposing the initiation of an expiry review of the finding shall file their written public submissions containing relevant information, opinions and arguments with the Tribunal, counsel and parties of record, no later than August 1, 2017. Where there are opposing views, each party that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other parties. Parties wishing to respond to the submissions must do so no later than August 11, 2017.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

The Tribunal will issue a decision on August 28, 2017, on whether an expiry review is warranted. If the Tribunal decides that an expiry review is not warranted, the finding will expire on its scheduled expiry date. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.
