DETERMINATION

General purpose automatic data processing equipment (including firmware), software, supplies and support equipment

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2016-062) on July 18, 2017, with respect to a complaint filed by Slenke Inc. (Slenke), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. INFC-2016-20) by Infrastructure Canada (IC). The solicitation was for the provision of a secure file sharing and storage system.

Slenke alleged that IC improperly concluded that its bid did not meet the requirements of the Request for Proposal and that it used undisclosed criteria in evaluating its bid.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the North American Free Trade Agreement, the Agreement on Government Procurement, the Canada-Chile Free Trade Agreement, the Canada-Peru Free Trade Agreement, the Canada-Colombia Free Trade Agreement, the Canada-Panama Free Trade Agreement, the Canada-Honduras Free Trade Agreement and the Canada-Korea Free Trade Agreement, the Tribunal determined that the complaint was valid.

Architect and engineering services — related to construction

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2017-019) from GBCA-MTBA (joint venture) [GBCA-MTBA], of Ottawa, Ontario, concerning a procurement (Solicitation No. 5P301-16-0006) by the Parks Canada Agency (Parks Canada). The solicitation is for the provision of architectural and engineering services — national parks and historic sites in the province of Ontario. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on July 17, 2017, to conduct an inquiry into the complaint.

GBCA-MTBA alleges that Parks Canada incorrectly determined its response to be non-responsive.

COMPLETION OF PANEL REVIEW

Certain gypsum board originating in or exported from the United States of America

On May 26, 2017, CGC Inc. and USG Corporation withdrew their Complaint filed pursuant to rule 39 of the Rules of Procedure for Article 1904 Binational Panel Reviews and ceased to be participants in these proceedings.

On June 23, 2017, Georgia-Pacific Gypsum LLC and Georgia-Pacific Canada LP each withdrew their Notice of Appearance filed pursuant to rule 40 of the Rules of Procedure for Article 1904 Binational Panel Reviews and ceased to be participants in these proceedings.

On July 13, 2017, CertainTeed Gypsum Canada Inc. filed a Notice of Consent Motion to Terminate Panel Review on behalf of all remaining participants. This Notice of Consent Motion satisfies the requirements of rule 71(2) of the Rules of Procedure for Article 1904 Binational Panel Reviews. Consequently, notice is hereby given, pursuant to subrule 78(a) of the Rules of Procedure for Article 1904 Binational Panel Reviews, that the binational panel review of the final determination made by the Canadian International Trade Tribunal, respecting “Certain Gypsum Board Originating in or Exported from the United States of America”, was terminated effective July 13, 2017, the day on which the Notice of Consent Motion to Terminate Panel Review was filed (Secretariat File No. CDA-USA-2017-1904-01).

EXPLANATORY NOTE

Chapter 19 of the North American Free Trade Agreement establishes a procedure for replacing domestic judicial review of determinations in antidumping and countervailing duty cases involving imports from a NAFTA country with review by binational panels.

These panels are established, when a Request for Panel Review is received by the NAFTA Secretariat, to act in place of national courts to review final determinations expeditiously to determine whether they are in accordance with the antidumping or countervailing duty law of the country that made the determination.

Under Article 1904 of the North American Free Trade Agreement, which came into force on January 1, 1994, the Government of Canada, the Government of the United States and the Government of Mexico established the Rules of Procedure for Article 1904 Binational Panel Reviews. These rules were published in the Canada Gazette, Part I, on January 1, 1994, and as amended, on March 29, 2008.
