CANADA-COLOMBIA FREE TRADE AGREEMENT IMPLEMENTATION ACT

Whereas, in accordance with subsection 48(2) of the Canada-Colombia Free Trade Agreement Implementation Act, chapter 4 of the Statutes of Canada, 2010, His Excellency the Governor General in Council is satisfied that the Government of the Republic of Colombia has taken satisfactory steps to implement the Canada-Colombia Free Trade Agreement and the related agreements, including providing the Government of Canada with written notification pursuant to Article 3 of the Agreement Concerning Annual Reports on Human Rights and Free Trade Between Canada and the Republic of Colombia and accepting written notification from the Government of Canada pursuant to Article 3 of that Agreement;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of International Trade, pursuant to subsection 48(1) of the Canada-Colombia Free Trade Agreement Implementation Act, chapter 4 of the Statutes of Canada, 2010, hereby fixes August 15, 2011 as the day on which that Act comes into force.

EXPLANATORY NOTE

The Canada-Colombia Free Trade Agreement Implementation Act, chapter 4 of the Statutes of Canada 2010, received Royal Assent on June 29, 2010. The Act implements the Free Trade Agreement and the related agreements on the environment and labour cooperation between Canada and the Republic of Colombia, signed on November 21, 2008, and the Agreement Concerning Annual Reports on Human Rights and Free Trade between Canada and the Republic of Colombia signed on May 27, 2010.

The general provisions of the Act specify that no recourse may be taken on the basis of the provisions of Part 1 of the Act or any order made under that Part, or the provisions of the Free Trade Agreement or the related agreements themselves, without the consent of the Attorney General of Canada.

Part 1 of the Act approves the Free Trade Agreement and the related agreements. It designates the Minister for International Trade as the principal representative of Canada on the Joint Commission and provides for the appointment by the Minister of other persons to represent Canada on any committee or subcommittee referred to in Annex 2001 of the Agreement. It provides for the payment by Canada of its share of the expenditures associated with the operation of the institutional aspects of the Free Trade Agreement and authorizes the Governor in Council to make orders for carrying out the provisions of the Act. It also requires the submission to Parliament of annual reports on the impact of actions taken under the Act on human rights in Canada and the Republic of Colombia.

Part 2 of the Act amends existing laws in order to bring them into conformity with Canada’s obligations under the Canada-Colombia Free Trade Agreement and the related agreement on labour cooperation.

Part 3 of the Act states that the provisions of the Act come into force on a day or days to be fixed by order of the Governor in Council provided that the Governor in Council is satisfied that the Republic of Colombia has taken satisfactory steps to implement the Free Trade Agreement, related agreements on the environment and labour cooperation and the agreement on human rights reporting.
