FREEZING ASSETS OF CORRUPT FOREIGN OFFICIALS ACT

Regulations Amending the Freezing Assets of Corrupt Foreign Officials (Tunisia and Egypt) Regulations

Whereas Tunisia and Egypt have asserted to the Government of Canada, in writing, that each of the persons listed in the annexed Regulations Amending the Freezing Assets of Corrupt Foreign Officials (Tunisia and Egypt) Regulations have misappropriated property of Tunisia or of Egypt, as the case may be, or have acquired property inappropriately by virtue of their office or a personal or business relationship and have asked the Government of Canada to freeze the property of those persons;

Whereas the Governor in Council is satisfied that each of those persons are politically exposed foreign persons in relation to Tunisia or Egypt, as the case may be;

Whereas the Governor in Council is satisfied that there is internal turmoil, or an uncertain political situation, in Tunisia and Egypt;

And whereas the Governor in Council is satisfied that the making of the annexed Regulations Amending the Freezing Assets of Corrupt Foreign Officials (Tunisia and Egypt) Regulations is in the interest of international relations;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Foreign Affairs, pursuant to subsections 4(1) to (3) of the Freezing Assets of Corrupt Foreign Officials Act (see footnote a), hereby makes the annexed Regulations Amending the Freezing Assets of Corrupt Foreign Officials (Tunisia and Egypt) Regulations.

AMENDMENTS

1. Item 21 of the English version of Schedule 1 to the Freezing Assets of Corrupt Foreign Officials (Tunisia and Egypt) Regulations (see footnote 1) is replaced by the following:

REGULATORY IMPACT ANALYSIS STATEMENT

Issue and objectives

On March 23, 2011, the Governor in Council made, pursuant to the Freezing Assets of Corrupt Foreign Officials Act, the Freezing Assets of Corrupt Foreign Officials (Tunisia and Egypt) Regulations (SOR/2011-78). The Regulations were made in response to written requests from Tunisia and Egypt, which sought to freeze the assets of former leaders and senior officials or their associates and family members suspected of having misappropriated state funds, or obtained property inappropriately as a result of their office or family, business or personal connections. The Freezing Assets of Corrupt Foreign Officials (Tunisia and Egypt) Regulations give effect to these requests.

Since the making of the Regulations, both Tunisia and Egypt have provided Canada with additional names of persons. Tunisia and Egypt both assert that these individuals are accused of misappropriating state property or acquiring property inappropriately by virtue of their office or a personal or business relationship. Both Tunisia and Egypt have asked the Government of Canada to freeze the property of those persons in Canada. Consequently, Schedules 1 and 2 of the Regulations need to be amended to give effect to these additional requests.

Description and rationale

The Freezing Assets of Corrupt Foreign Officials Act permits the freezing of assets or the restraint of property of politically exposed foreign persons upon receipt of a written request from a state, where the Governor in Council has determined that the state is in a state of turmoil or political uncertainty, and where the making of the order or regulation is in the interest of international relations. These Regulations deal specifically with Tunisia and Egypt.

The additional written requests from Tunisia and Egypt pertain to individuals who are politically exposed persons. All of the individuals whose names have been recently submitted by Tunisia and Egypt are designated by those states as being either former senior members of government, business associates of former senior members of government, or family members of such persons.

The situations in both Tunisia and Egypt have improved but a degree of political uncertainty remains. On October 23, 2011, Tunisia elected a Constituent Assembly whose role will be to draft a new constitution within a year, possibly to be approved by referendum, and to select an interim president and government until new presidential and legislative elections can be organised, likely in late 2012. The population remains impatient for tangible socioeconomic improvement, and wants to see their national wealth, which was squandered by the former ruling families, benefit the Tunisian people. It is paramount for the Tunisian government and people to ultimately recover the misappropriated assets of the country to help alleviate poverty.

In Egypt, the Supreme Council of the Armed Forces has dissolved Parliament, suspended the constitution, and constitutional amendments have been approved in a referendum. Parliamentary elections are scheduled to begin on November 28, 2011, and a constitutional drafting committee will be struck from members of this new parliament. A loss of tourism dollars is draining the economy due in part to security concerns. Labour strikes continue across the country with workers demanding higher pay. Protesters have demanded, inter alia, that former President Hosni Mubarak be put on trial, that all of his assets be returned to the national treasury, and that charges be laid against other ex-senior officials, as well as business people implicated in corrupt dealings. The trials of Mr. Mubarak, key former officials and business people are currently underway. While trying to restore order and get the economy back on track, Egypt has been further affected by the unrest in Libya where an estimated one million Egyptians work. Tens of thousands of workers have already fled back and the loss of remittances will be an additional strain on the economy.

Considering the subsequent requests made by Tunisia and Egypt since the Regulations were made and Canada’s continued support for accountability, rule of law and a transition to democracy in both countries, amending the Regulations is in the interest of international relations.

Consultation

The Department of Foreign Affairs and International Trade held consultations with the Departments of Justice and Finance, the Office of the Superintendent of Financial Institutions, the Financial Transactions and Reports Analysis Centre of Canada, the Royal Canadian Mounted Police, Canada Border Services Agency, the Privy Council Office and the Treasury Board Secretariat. All departments were supportive of this initiative.

Implementation, enforcement and service standards

Compliance is ensured by the Royal Canadian Mounted Police. Every person who contravenes provisions of the Regulations is liable, upon conviction, to the punishments set out in section 10 of the Freezing Assets of Corrupt Foreign Officials Act.
