Regulations Amending the Apprentice Loans Regulations

The Minister of Employment and Social Development, pursuant to subsection 12(3) of the Apprentice Loans Act (see footnote a), makes the annexed Regulations Amending the Apprentice Loans Regulations.

AMENDMENT

1. Schedule 1 to the Apprentice Loans Regulations (see footnote 1) is amended by adding the following in alphabetical order:

Issues

Pursuant to subsection 12(3) of the Apprentice Loans Act (the Act), the Regulations are designed to amend Schedule 1 to the Apprentice Loans Regulations (ALR), which is required to ensure that all apprentices registered in a Red Seal trade are eligible for apprentice loans.

Background

The Canadian Council of Directors of Apprenticeship (CCDA) split the trade “Heavy Equipment Operator” into three categories: (1) Heavy Equipment Operator (Dozer); (2) Heavy Equipment Operator (Excavator); and (3) Heavy Equipment Operator (Tractor-Loader-Backhoe). As a result, an update to the list of eligible trades in Schedule 1 to the ALR was required by ministerial regulation.

Objectives

Apprentice loans made under the Act provide financial assistance to apprentices registered in a Red Seal trade to help with the costs related to their technical training and complement other financial measures available to apprentices aimed at increasing the rate of completion of apprenticeship training. The objective of these Regulations is to ensure that the list of eligible trades in Schedule 1 to the ALR is the same as the list of trades that are designated as Red Seal in each province.

Description

The list in Schedule 1 to the ALR identifies eligible trades that are designated Red Seal trades by the provinces for the purposes of financial assistance provided under the Act.

These Regulations increase the number of eligible trades from 54 to 57 by adding Heavy Equipment Operator (Dozer), Heavy Equipment Operator (Excavator) and Heavy Equipment Operator (Tractor-Loader-Backhoe) to the list of eligible trades. These were designated by the provinces of British Columbia, Newfoundland and Labrador, Nova Scotia, Ontario, Prince Edward Island and Quebec.

Subsection 12(3) of the Act permits the Minister of Employment and Social Development to amend by regulation the list of eligible trades in Schedule 1 to the ALR.

“One-for-One” Rule

The “One-for-One” Rule does not apply to this proposal, as there is no change in administrative costs to business.

Small business lens

The small business lens does not apply to this proposal, as there are no costs to small business.

Consultation

The Regulations to Schedule 1 to the ALR are an administrative requirement and represent no policy change. No prepublication was required.

Rationale

The Regulations would support the aforementioned objectives by ensuring that the list of all designated Red Seal trades by provinces remains up-to-date. By extension, this would ensure that all apprentices registered in a Red Seal trade can be eligible for an apprentice loan if they meet the other conditions of the Act.

Implementation, enforcement and service standards

If these Regulations are not made, apprentices registered in one of the Heavy Equipment Operator trades will not be considered eligible apprentices for the purposes of financial assistance under the Act.
