Regulations Amending the Contraventions Regulations (Miscellaneous Program)

His Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to section 8 (see footnote a) of the Contraventions Act (see footnote b), makes the annexed Regulations Amending the Contraventions Regulations (Miscellaneous Program).

AMENDMENTS

1. The portion of paragraph 24(b) of Part II of Schedule II.1 to the French version of the Contraventions Regulations (see footnote 1) in column II is replaced by the following:

Issues

The Standing Joint Committee for the Scrutiny of Regulations (SJCSR) has advised that miscellaneous minor amendments be made to a number of regulations (the regulations). In addition, the need for a number of additional minor technical amendments to the regulations has been identified.

These amendments, which are being brought forward by a number of government departments and agencies, have been collected together in this omnibus Regulatory Impact Analysis Statement (RIAS).

Objective

The amendments have the following objectives:

Description

Contraventions Regulations (Ontario Fishery Regulations, 2007) — Contraventions Act — Department of Justice

The amendments to Part II of Schedule II.1 of the Contraventions Regulations will correct the following discrepancies:

  1. Paragraph 24(b) [French]: This paragraph should refer to “limite prévue,” as opposed to “limite fixée,” in order to reflect more adequately the language used in paragraph 20(a) of the Ontario Fishery Regulations, 2007.
  2. Item 30 [English]: The word “fishing” should be added before “vessel” for consistency with the French version.
  3. Second item 35 — Item preceding item 37 [English]: This item should be numbered 36.
  4. Items 40 and 41 [French and English]: The fine of $50 for the offence, plus $50 per hook exceeding the permitted limit, seems justifiable for items related to the number of hooks being used, such as item 37 (Angling with a line having more than four hooks) and item 39 (Angling using a line having more than one barbless hook). However, it was not clear that this fine structure was adequate for other angling offences that do not relate to the number of hooks permitted, such as items 40 (Angling using a hook other than a barbless hook) and 41 (Angling using a hook other than a barbless hook during specified period). Offences in items 40 and 41 relate to the type of hook being used, and not their numbers. Therefore, the fine amount for both of these items should be $50 for the offence.
  5. Item 74 [French]: This item should refer to “piège à poisson-appât,” as opposed to “piège à appât,” to be consistent with the terminology of the French version of subsection 41(1) of the Ontario Fishery Regulations, 2007 and to be consistent with items 57 through 59 of Part II of the Schedule.
  6. Item 76 [French]: This item should refer to “une ligne munie d’un hameçon,” as opposed to “une ligne,” to be consistent with the terminology of the French version of section 42 of the Ontario Fishery Regulations, 2007.
Canadian Aviation RegulationsAeronautics Act — Transport Canada
  1. Subsection 302.206(2) [French]: The terms “d’autre document” has been replaced with “d’autres documents.
  2. Subsection 302.303(2) ([French and English): Amended to clarify meaning of provision.
  3. Paragraph 302.307(1)(a) [French and English]: The French version is amended to correct a grammatical mistake by adding a comma before the words “au moins une fois tous les cinq ans;” and the English version is amended to clarify the provision and to correct a grammatical structure.
  4. Subsection 305.37(1) (French]: In the passage preceding paragraph a), a comma is added after the words “aires de mouvement.
  5. Subparagraph 305.55(b)(viii) [French]: The words “à l’effet que” are replaced by “indiquant que” to address an anglicism in the French version.
  6. Subsection 602.131(1) [French]: The words “lorsque aucun” are replaced by “lorsqu’aucun” to correct a grammatical error.
  7. Heading of Division XI of Subpart 5 of Part VII [English]: The heading “Division XI - Interence With a Crew Member” is replaced by “Division XI – Interference With a Crew Member.”
  8. Section 705.171 [French and English]: The definition “interference with a crew member” is amended to correct a grammatical structure.
  9. Subsection 705.172(2) [French]: The term “leur” is replaced with “son” to correct a grammatical error.
  10. Subsection 705.174(2) [French]: the term “leur” is replaced with “son” to correct a grammatical error.
  11. Column I of Subpart 5 of Part III of Schedule II to Subpart 3 of Part I [French and English]: The references to subsec-tions 305.47(1) and (2) have been replaced by “section 305.47,” as the list of designated provisions wrongly states that section 305.47 has two subsections.
  12. Paragraph 305.18(1)(a) [French and English]: The reference to “paragraph 305.10(b)” is replaced by “paragraph 305.08(1)(c) to correct an improper numbering reference.
  13. Section 705.173 [French and English]: The reference to “subsection 725.124(54)” in the portion of section 705.173 before paragraph (a) is replaced by “subsection 725.124(56)” to correct an improper numbering reference.

  28. Paragraph 705.175(a) [French and English]: In describing a level 1 incident, the words “effectively and” are removed in the English version, and the words “et avec succès” are removed in the French version, as they add nothing to the provision.
  29. Paragraph 408.17(c) [French]: The words “test en vol subséquent” are replaced by “test en vol suivant” to harmonize with the introductory paragraph of section 408.17.
  30. Subsection 601.01(4) [French and English]:
    • The wording of the introductory paragraph in the English version is amended from “The Designated Airspace Handbook shall specify the geographical location and the horizontal and vertical limits of” to read “The geographical location and the horizontal and vertical limits of the following items are those specified in the Designated Airspace Handbook:” to harmonize with the wording of paragraph 601.01(3)(b) of the Regulations.
    • The wording of the introductory paragraph in the French version is amended from “Le Manuel des espaces aériens désignés précise la position géographique et les limites horizontales et verticales des aires, zones, régions et points suivants :” to read “La position géographique et les limites horizontales et verticales des aires, zones, régions et points ci-après sont celles précisées dans le Manuel des espaces aériens désignés :” to harmonize with the wording of paragraph 601.01(3)(b) of the Regulations.
  31. Subparagraph 705.175(b)(ii) [French and English]:
    • The wording of the English version will be changed from “the continuation of a level 1 incident by a passenger after being warned by a crew member,” to read “the continuation of a level 1 incident that was unresolved,” to harmonize with another provision in the Regulations.
    • The wording of the French version will be changed from “la poursuite d’un incident de niveau 1 par un passager malgré l’avertissement d’un membre d’équipage” to read “la poursuite d’un incident de niveau 1 non réglé,” to harmonize with another provision in the Regulations.
  32. Paragraph 305.31(2)(n) [French]: The words “marque d’information” will be changed to “marque d’indication” to harmonize with the wording used in the standard.
  33. Section 302.201 [French and English]:
    • The English version of the definition of “emergency coordination centre” is amended to add the words “and whose location is specified under paragraph 302.203(1)(r)” to clarify the provision.
    • The French version of the definition “centre de coordination des urgences” is amended to add the words “et dont l’emplacement est précisé en application de l’alinéa 302.203(1)r)” to clarify the provision.
  34. Section 406.14 [French and English]: Amended by adding the words “the requirements of section 426.14 of” after the word “meets” in the English version and by replacing the word “conserver” with “maintenir” and by adding the words “exigences de l’article 426.14 des” after the word “aux” in the French version to clarify the meaning of the provision.
  35. Item 10 of Schedule I of Subpart 5 of Part VI, Column I [French and English]: The wording will be changed from “Except where an equivalent technical dispatch procedure is in place” to read “Except where a technical dispatch procedure is in place” to clarify the meaning of the provision.

  46. Paragraph 406.71(2)(d) [French and English]: Amended by removing the words “the following exercises” in the English version and by removing the words “effectuer avec succès les exercices ci-après” and replacing them with “réussir,” and by adding the words “à la fois” after the term “l’instructeur- vérificateur” in the French version to harmonize with wording used in the English and French versions.
  47. Subsection 101.01(1) [French and English]: Paragraph (c) of the definition of “maintenance” is amended to remove the word “any” in the English version and by removing the words “le cas échéant,” in the French version as they add nothing of substance to the provision.
  48. Paragraph 406.13(h) [French and English]: Repealed, as the provision does not add any value nor does it set out any new obligation.
  49. Subparagraph 406.71(2)(d)(iii) [French]: Amended to remove the words “effectuer avec succès” to harmonize with wording used in the French version.
  50. Section 406.75 [French and English]: Amended to remove the words “all the instructional stages shall be completed in one continuous course of training” in the English version and by removing the words “toutes les étapes de l’instruction doivent être effectuées sous la forme d’un cours de formation continu qui a été” in the French version, as these words merely repeat what the definition of “integrated course” in subsection 400.01(1) already states.
  51. Schedule I of Subpart 3 of Part I [French and English]: In Schedule I of subsection 103.06(4), in the English version, the words “may be filed with the Registrar, Transportation Appeal Tribunal of Canada” and the words “from the Registrar” are replaced with “may be filed with the Transportation Appeal Tribunal of Canada” and “from the Tribunal,” respectively. In the French version, the words “greffier du Tribunal” et “greffier” are replaced with “Tribunal,” respectively.
Life Saving Equipment RegulationsCanada Shipping Act, 2001 — Transport Canada

Subsections 16(2), 16(2.1), 17(2) and 17(2.1) of Part II of Schedule IX to the Life Saving Equipment Regulations are amended to clarify the existing requirement that new ships equipped with a lifeboat or a rescue boat, other than free fall boats, must be deployable by a single person from a position on the boat’s deck or within the lifeboat or rescue boat itself.

Administrative Monetary Penalties and Notices (CSA 2001) RegulationsCanada Shipping Act, 2001 — Transport Canada

Paragraph 40(1)(c) of the Canada Shipping Act, 2001 creates an offence for contravening subsection 20(7) [failure to return suspended or cancelled Canadian maritime document]. However subsection 20(7) was repealed in 2003. As a result, the fine set out in the Administrative Monetary Penalties and Notices (CSA 2001) Regulations for a violation of paragraph 40(1)(c) is not authorized by the enabling statute.

Consequently, item 4 of Part 1 of the Schedule to the Administrative Monetary Penalties and Notices (CSA 2001) Regulations is repealed.

Vessel Operation Restriction Regulations — Canada Shipping Act, 2001 — Transport Canada

The following amendments to the Vessel Operations Restrictions Regulations are part of a three-phase approach to address issues contained in the correspondence Transport Canada received from the Standing Joint Committee for the Scrutiny of Regulations As sections of these Regulations were opened up to address issues identified by the Committee, technical updates to the language are made where appropriate.

  1. Subsection 15(1) [French and English]: The words “in a safe manner” are removed from the provision, as these words do not add any value nor do they set out any further obligations on the part of the person using the vessel.
  2. Schedule 1, Part 1, items 44 and 45 [French and English]: Under the heading “Northeast Region,” the geographical coordinates are amended to reflect the standardized naming convention found in the Alberta Land Titles Act reference system.
  3. Note 1 in item 20 of Part 2 of Schedule 1 [French and English]: Amended by replacing the reference to “Ontario Hydro” with “Ontario Power Generation” to reflect a name change.
  4. Schedule 1, Part 2, item 19 [French and English]: The reference to “Ontario Hydro Pickering Nuclear Generating Station” is replaced by “Pickering Nuclear Generating Station” to reflect a name change.
  5. Schedule 3, Part 3, item 20 [French and English]: Under the heading “Central Region,” the geographical coordinates are amended to reflect the standardized naming convention found in the Alberta Land Titles Act reference system.
  6. Schedule 2, Part 2, item 61 [French and English]: Geographical coordinates are inserted as found in the Gazetteer of Canada reference system.
  7. Schedule 2, Part 2, items 81, 89 and 91 [French and English]: Amended to remove the “local name” from column 1 and to add it to column 2. These amendments will make these items consistent with the rest of the items in the Schedule.
  8. Schedule 6, Part 2, item 2 [French and English]: The reference to “Ontario Hydro Dam” is amended to reflect a name change to “Arnprior Generating Station.”
  9. Schedule 1, Part 1, item 45 [French and English]: Under the heading “Northeast Region,” the geographical coordinates are amended to correct an error in the coordinates (6-52-31-W4 is replaced by 6-52-21-W4).

Rationale

The amendments are in response to the SJCSR’s review of the regulations and to address additional technical issues. The amendments are non-substantive, help to streamline and simplify the regulatory base, and do not impose any costs on the Government or stakeholders.
