Order Amending the List of Tariff Provisions Set Out in the Schedule to the Customs Tariff (Tariff Item No. 9984.00.00)

The Minister of Finance, pursuant to section 13 (see footnote a) of the Customs Tariff (see footnote b), makes the annexed Order Amending the List of Tariff Provisions Set Out in the Schedule to the Customs Tariff (Tariff Item No. 9984.00.00).

Order Amending the List of Tariff Provisions Set Out in the Schedule to the Customs Tariff (Tariff Item No. 9984.00.00)

Amendment

1 The Description of Goods of tariff item No. 9984.00.00 in the List of Tariff Provisions set out in the schedule to the Customs Tariff (see footnote 1) is amended by replacing the reference to “Canada Games Council” with a reference to “True Sport Foundation”.

Coming into Force

2 This Order comes into force on the day on which it is registered.

Issues

The Canada Games Council and True Sport Foundation have jointly requested that the description of tariff item No. 9984.00.00 be amended by replacing the reference to “Canada Games Council” with a reference to “True Sport Foundation.”

Background

Tariff item No. 9984.00.00 allows for the duty-free importation of goods used in high-level sport competitions, under certain conditions, including that the goods are certified as (1) complying with the international competition standards applicable to the sport for which the goods are designed; and (2) being required by an athlete exclusively for the purpose of training for or competing in an amateur competition of international calibre. The Canada Games Council has been the certifying body for the purposes of this tariff item since 1998.

The Canada Games Council and True Sport Foundation have agreed that True Sport Foundation is better placed to undertake the certification process, which will continue to be done on a cost recovery basis.

Objectives

The objective of the Order is to transfer responsibility as the certifying body for tariff item No. 9984.00.00 from the Canada Games Council to True Sport Foundation.

Description

This Order changes the certifying body for the purposes of tariff item No. 9984.00.00 from the “Canada Games Council” to “True Sport Foundation.” There are no other changes to the tariff item.

“One-for-One” Rule

The “One-for-One” Rule does not apply to this Order, as there is no change in administrative costs to business.

Small business lens

The small business lens does not apply to this Order, as there is no change in administrative or compliance costs to small business.

Consultation

The Canada Games Council and True Sport Foundation were engaged by the government and are supportive of the amendment. The amendment is technical in nature and does not have policy or financial implications.

Rationale

An order pursuant to section 13 of the Customs Tariff is the appropriate method of making such technical changes.

Implementation, enforcement and service standards

The Canada Border Services Agency (CBSA) is responsible for the administration of, and compliance with, customs and tariff legislation and regulations. In the course of its administration of this tariff amendment, CBSA will inform the importing community.
