Notice requiring the preparation and implementation of pollution prevention plans with respect to bisphenol A in industrial effluents
Pursuant to section 91 of the Canadian Environmental Protection Act, 1999 (hereinafter referred to as the “Act”), the Minister of the Environment published in the Canada Gazette, Part Ⅰ, on October 16, 2010, a Proposed notice requiring the preparation and implementation of pollution prevention plans with respect to bisphenol A in industrial effluents.
Whereas persons were given the opportunity to file comments with respect to the proposed Notice for a comment period of 60 days; and
Whereas the Minister of the Environment has considered all comments received.
Notice is hereby given that, under subsection 56(1) of the Act, the Minister of the Environment requires any person or class of persons described in section 2 of the Notice to prepare and implement a pollution prevention plan in respect of the substances listed in this Notice which are specified on Schedule 1 of the Act.

NOTICE REQUIRING THE PREPARATION AND IMPLEMENTATION OF POLLUTION PREVENTION PLANS WITH RESPECT TO BISPHENOL A IN INDUSTRIAL EFFLUENTS
Notice is hereby given that, pursuant to the provisions of Part 4 of the Act, the Minister of the Environment requires any person or class of persons described in section 2 of the Notice to prepare and implement a pollution prevention plan in respect of bisphenol A in industrial effluents.
1. Definitions
The definitions in this section apply to the Notice.
“Act” means the Canadian Environmental Protection Act, 1999 (CEPA 1999).
“Bisphenol A or BPA” means Phenol, 4,4′ -(1-Methylethylidene)bis-, Chemical Abstracts Service (CAS) (see footnote 1) Number 80-05-7.
“Calendar year” refers to a complete year beginning January 1 and ending December 31.
“Final discharge point” is an identifiable discharge point beyond which the industrial facility owner or operator no longer exercises control over quality of the effluent.
“Effluent” means process wastewater from an industrial facility released into the off-site wastewater system or to surface water.
“Minister” means the Minister of the Environment.
“Normal operating conditions” means representative of regular or typical operating conditions related to the manufacture or use of bisphenol A or mixture containing bisphenol A which results in an effluent containing bisphenol A at the final discharge point.
“Notice” means the Notice requiring the preparation and implementation of pollution prevention plans with respect to bisphenol A in industrial effluents.
“Plan” means a pollution prevention plan.
2. Person or class of persons required to prepare and implement a plan
(1) The Notice applies to any person or class of persons who owns or operates an industrial facility which, during the calendar year prior to the date of publication of the Notice, or any calendar year thereafter meets any of the following criteria:
- (a) Manufactures bisphenol A in a quantity greater than 100 kg and, as a result of manufacture, the effluent at the final discharge point of the facility contains bisphenol A;
- (b) Uses bisphenol A in a quantity greater than 100 kg and, as a result of use, the effluent at the final discharge point of the facility contains bisphenol A; or
- (c) Uses a mixture containing bisphenol A in a quantity greater than 100 kg and, as a result of use, the effluent at the final discharge point of the facility contains bisphenol A.
(2) The Notice applies to any person or class of persons who is the successor or assign of the persons identified in subsection 2(1).
(3) Despite subsection 2(1), the Notice does not apply to any person or class of persons who releases an effluent containing bisphenol A resulting exclusively from pulp and paper recycling, scientific research or laboratory testing.
3. Activities in relation to which the plan is to be prepared
(1) The Minister requires any persons or class of persons identified in section 2 of the Notice to prepare and implement a plan in relation to the release of bisphenol A in effluents through
- (a) the manufacture of bisphenol A; or
- (b) the use of bisphenol A or a mixture containing bisphenol A during processing or manufacturing activities.
(2) Despite subsection 3(1), a plan does not have to be prepared and implemented in relation to effluent containing bisphenol A resulting exclusively from pulp and paper recycling, scientific research or laboratory testing.
4. Factors to consider in preparing the plan
The Minister requires any person or class of persons identified in section 2 of the Notice to consider the following factors when preparing their plan:
(1) Bisphenol A was declared toxic under section 64 of the Act and was added to the List of Toxic Substances in Schedule 1 of the Act. The final Screening Assessment Report concluded that bisphenol A is entering or may be entering the environment in a quantity or concentration or under conditions that have or may have an immediate or long-term harmful effect on the environment or its biological diversity or constitute or may constitute a danger in Canada to human life or health. Bisphenol A is acutely toxic to aquatic organisms and is a known endocrine disruptor.
(2) The risk management objective of this Notice is continual improvement towards reaching the lowest level of bisphenol A in the environment. This is to be accomplished by achieving and maintaining the lowest total bisphenol A concentration that is economically and technically feasible and is less than 1.75 µg/L in the effluent released at the final discharge point of the facility through methods other than dilution.
(3) In preparing a plan, any person or class of persons subject to the Notice is to give first consideration to pollution prevention activities prior to considering pollution control activities. “Pollution prevention,” as defined in section 3 of the Act, means “the use of processes, practices, materials, products, substances or energy that avoid or minimize the creation of pollutants and waste and reduce the overall risk to the environment or human health.”
(4) The use of alternatives to bisphenol A should be considered to reduce or minimize environmental and human health risks. The chosen alternatives should not have, through their degradation, the potential to produce bisphenol A.
(5) Sampling and analysis should be completed as described below:
- (a) Effluent samples should be collected in such a way that they are representative of the effluent containing bisphenol A released at a final discharge point under normal operating conditions;
- (b) Effluent samples should be collected and analyzed a minimum of four times per year;
- (c) Sampling and analysis of the samples should be performed in accordance with what are generally accepted standards of good scientific practice at the time of the analysis; and
- (d) Analysis of the samples should be performed by a laboratory that is accredited by a Canadian accrediting body under the International Organization for Standardization standard ISO/IEC 17025 titled General Requirements for the Competence of Testing and Calibration Laboratories, as amended from time to time.
(6) The following documents should be kept with the plan:
- (a) a description and the location of all final discharge points; and
- (b) a description of the factors (e.g. type of technology, human factor, accidental releases, type of manufacturing, daily use) that could increase the quantity or concentration of bisphenol A in the facility’s effluent.
(7) Monitoring of the plan should include one year of sampling and analysis at the final discharge point(s) after the risk management objective set in subsection 4(2) of the Notice is met. Sampling and analysis should be conducted as specified in subsection 4(5) of the Notice.
(8) The Minister will evaluate the effectiveness of the Notice with respect to the risk management objective set out in subsection 4(2) of the Notice in order to determine whether other measures, including regulations, are needed to further prevent or reduce negative impacts of bisphenol A on the environment or human health.
5. Period within which the plan is to be prepared
(1) For a person or class of persons subject to the Notice on the date of publication in the Canada Gazette, Part Ⅰ, the Minister requires that the plan be prepared and that its implementation be initiated no later than December 31, 2012.
(2) For a person or class of persons becoming subject to the Notice after the date of publication in the Canada Gazette, Part Ⅰ, the Minister requires that the plan be prepared and that its implementation be initiated no later than six months from becoming subject to the Notice.
6. Period within which the plan is to be implemented
(1) For a person or class of persons subject to the Notice on the date of publication in the Canada Gazette, Part Ⅰ, the Minister requires that the plan be implemented no later than December 31, 2016.
(2) For a person or class of persons becoming subject to the Notice after the date of publication in the Canada Gazette, Part Ⅰ, the Minister requires that the plan be implemented no later than 24 months from becoming subject to the Notice.
7. Content of the plan
A person or class of persons identified in section 2 of the Notice is to determine the appropriate content of that person’s plan; however, the plan must meet all the requirements of the Notice. The plan must also contain the information required to file the Declaration of Preparation referred to in section 9 of the Notice, the information required to file the Declaration of Implementation referred to in section 10 of the Notice, and the information to file the Interim Progress Reports referred to in section 12 of the Notice.
8. Requirement to keep the plan and related records
(1) Under section 59 of the Act, any person or class of persons identified in section 2 of the Notice must keep a copy of the plan at the place in Canada for which the plan is prepared. Where a single plan is prepared for more than one facility, a copy of that plan must be kept at each location.
(2) Any person or class of persons identified in section 2 of the Notice must keep the plan and any records pertaining to the plan for a minimum of five years following the date set out in section 6 of the Notice.
9. Declaration of Preparation
Under subsection 58(1) of the Act, any person or class of persons identified in section 2 of the Notice must file, within 30 days after the end of the period for the preparation of the plan specified in section 5 or extended under section 14 of the Notice, a written “Declaration That a Pollution Prevention Plan Has Been Prepared and Is Being Implemented — Notice Requiring the Preparation and Implementation of Pollution Prevention Plans with Respect to Bisphenol A (BPA) in Industrial Effluents (Subsection 58(1) of CEPA 1999).” This Declaration must be submitted to the Minister, using the form that the Minister provides and that contains the information set out in Schedule 1 of the Notice. Where a person or class of persons has prepared a single plan for several facilities, a separate Declaration of Preparation must be filed for each facility.
10. Declaration of Implementation
Under subsection 58(2) of the Act, any person or class of persons identified in section 2 of the Notice must file within 30 days after the end of the period for the completion of the implementation of the plan specified in section 6 or extended under section 14 of the Notice, a written “Declaration That a Pollution Prevention Plan Has Been Implemented — Notice Requiring Preparation and Implementation of Pollution Prevention Plans with Respect to Bisphenol A (BPA) in Industrial Effluents (Subsection 58(2) of CEPA 1999).” This Declaration must be submitted to the Minister, using the form that the Minister provides and that contains the information set out in Schedule 5 of the Notice. Where a person or class of persons has prepared a single plan for several facilities, a separate Declaration of Implementation must be filed for each facility.
11. Filing of amended declarations
Under subsection 58(3) of the Act, where a person or class of persons identified in section 2 of the Notice has filed a written Declaration of Preparation or a written Declaration of Implementation, referred to in sections 9 and 10 of the Notice, and the Declaration contains information that, at any time after the filing, has become false or misleading, the person or class of persons must file an amended Declaration to the Minister within 30 days after the time that the information became false or misleading, using the appropriate form referred to in section 9 or 10 of the Notice.
12. Interim progress reports
A person or class of persons identified in section 2 of the Notice must file to the Minister, on or before each of the dates below, a written “Interim Progress Report — Pollution Prevention Planning Notice with Respect to Bisphenol A (BPA) in Industrial Effluents,” using the form that the Minister provides and that contains the information set out in Schedule 4 of the Notice. If a Declaration of Implementation is submitted before an Interim Progress Report is due, the requirement to submit the Interim Progress Report is nullified.
(1) For a person or class of persons subject to the Notice on the date of publication in the Canada Gazette, Part Ⅰ,
- — Interim Progress Report No. 1 — January 31, 2014;
- — Interim Progress Report No. 2 — January 31, 2015; and
- — Interim Progress Report No. 3 — January 31, 2016.
(2) For a person or class of persons becoming subject to the Notice after the date of publication in the Canada Gazette, Part Ⅰ,
- — No interim progress reports are required.
(3) For a person or class of persons who has been granted a time extension in accordance with section 14 of the Notice for longer than one year, an Interim Progress Report is required on an annual basis on or before January 31 each year for the length of the time extension.
13. Use of a plan prepared or implemented for another purpose
Under subsection 57(1) of the Act, a person or class of persons may use a plan prepared or implemented for another purpose to satisfy the requirements of sections 2 to 8 of the Notice. Under subsection 57(2) of the Act, where a person or class of persons uses a plan that does not meet all the requirements of the Notice, the person or class of persons must either amend the plan so that it meets all of those requirements or prepare an additional plan that meets the remainder of those requirements. A person or class of persons using existing plans must still file the Declaration of Preparation referred to in section 9 of the Notice, the Declaration of Implementation referred to in section 10 of the Notice, any amended declarations referred to in section 11 of the Notice where applicable, and any Interim Progress Reports required under section 12 of the Notice.
14. Extension of time
Under subsection 56(3) of the Act, where the Minister is of the opinion that further time beyond the period referred to in section 5 of the Notice is needed to prepare the plan, or that further time beyond the period referred to in section 6 of the Notice is needed to implement the plan, the Minister may extend the period for a person or class of persons who submits a written “Request for Time Extension Notice Requiring the Preparation and Implementation of Pollution Prevention Plans with Respect to Bisphenol A (BPA) in Industrial Effluents (Subsection 56(3) of the Act).” The written request must use the form that the Minister provides, contain the information set out in Schedule 3 of the Notice, and be made before the expiry of the date referred to in the applicable section 5 or section 6 of the Notice or before the expiry of any extended period.
15. Application for waiver of factors to consider
Under subsection 56(5) of the Act, the Minister may waive the requirement for a person or class of persons to consider a factor in preparing the plan specified in section 4 of the Notice where the Minister is of the opinion that it is neither reasonable nor practicable to consider a factor on the basis of reasons provided by that person or class of persons when submitting a written “Request for Waiver of the Requirement to Consider a Factor or Factors — Notice Requiring the Preparation and Implementation of Pollution Prevention Plans with Respect to Bisphenol A (BPA) in Industrial Effluents (Subsection 56(5) of the Act).” The written request must use the form that the Minister provides and contain the information set out in Schedule 2 of the Notice. Such a request must be made before the expiry of the period within which the plan is to be prepared as referred to in section 5 of the Notice or before the expiry of any extended period.

18. Public disclosure of information and forms
The Minister of the Environment intends to publish the information submitted in response to the Notice in Schedules 1, 4 and 5 in the Pollution Prevention Planning section of Environment Canada’s Web site.
Under section 313 of the Act all persons submitting information to the Minister are entitled to submit a request that specific information be treated as confidential. Persons submitting such a request should include the reasons for that request.
The Notice includes the following documents:

This is to be accomplished by achieving and maintaining the lowest total bisphenol A concentration that is economically and technically feasible and is less than 1.75 µg/L in the effluent released at a final discharge point of a facility through methods other than dilution.

(2) The risk management objective of this Notice is the continual improvement towards reaching the lowest level of bisphenol A in the environment.
