Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-04390 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

1. Permittee: Coastal Seafoods Inc., Bonne-Espérance, Rivière-Saint-Paul, Quebec.

2. Waste or other matter to be disposed of: Fish waste and other organic matter resulting from industrial fish processing operations.

2.1. Nature of waste or other matter: Fish waste and other organic matter consisting of fish and shellfish waste.

3. Duration of permit: Permit is valid from July 11, 2012, to July 10, 2013.

4. Loading site(s): Chevalier Bay Harbour, Quebec, 51°26.09′ N, 57°38.15′ W (NAD83).

5. Disposal site(s): Within a 300 m radius of 51°24.72′ N, 57°39.36′ W (NAD83), at an approximate depth of 60 m.

6. Method of loading:

6.1. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

6.2. The loading and transit shall be completed in a manner that ensures that no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee shall also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site.

8. Method of disposal: The Permittee shall ensure that the waste to be disposed of is discharged from the equipment or ship while steaming within the disposal site boundaries and in a manner which will promote dispersion.

9. Total quantity to be disposed of: Not to exceed 150 tonnes.

10. Inspection: By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

10.1. The Permittee shall ensure that records of all loading and disposal activities are kept on site for the duration of the permit and are available for inspection by any enforcement officer or analyst for two years following the expiry of the permit.

11. Contractors:

11.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

11.2. The Permittee shall ensure that all persons involved in the loading, transport or disposal activities authorized by this permit conduct these activities in accordance with the relevant permit conditions.

12. Reporting and notification:

12.1. The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to the Regional Director, Environmental Protection Operations Division, Department of the Environment, Quebec Region, 105 McGill Street, 4th Floor, Montréal, Quebec H2Y 2E7, 514-496-6982 (fax), immersion.dpe@ec.gc.ca (email).

12.2. The Permittee must complete the Register of Disposal at Sea Operations as provided by the Department of the Environment. This register must, at all times, be kept aboard any vessel involved with the disposal operations and be accessible to enforcement officers designated under the Canadian Environmental Protection Act, 1999.

12.3. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of the Environmental Protection Operations Division, Quebec Region, identified in paragraph 12.1, within 30 days of the expiry of the permit. This report shall contain the following information: a list of all work completed pursuant to the permit, including the names of the loading and disposal sites used, the quantity of matter disposed of at the disposal site(s), the dates on which disposal activities occurred and the Register of Disposal at Sea Operations.

12.4. At all times, a copy of this permit, documents and drawings referenced in this permit shall be available at the loading site and on all powered ships directly engaged in the loading and disposal operations.

1. Permittee: Saint John Port Authority, Saint John, New Brunswick.

2. Waste or other matter to be disposed of: Dredged material.

2.1. Nature of waste or other matter: Dredged material consisting of gravel, sand, silt and clay.

3. Duration of permit: Permit is valid from July 1, 2012, to June 30, 2013.

3.1. The loading and disposal at sea activities are restricted to the following periods: from July 1, 2012, to November 11, 2012, and from January 15, 2013, to March 31, 2013.

4. Loading site(s): Saint John Harbour and Courtenay Bay, Saint John, New Brunswick, at approximately 45°16.00′ N, 66°04.00′ W (NAD83). The loading of dredged materials authorized by this permit is restricted to the following locations: Main Channel; Berth Nos. 1/2, and End of Pier 2/3, Navy Island; Berth No. 3, Rodney Slip; Pugsley A/B/C; Lower Cove; Rodney Marginal; Berth No. 12, Terminal No. 12; Long Wharf Marginal and Approach; Courtenay Bay Channel, Basin, and Potash Terminal, as described in Appendix B of the permit application.

5. Disposal site(s): Black Point, Saint John, New Brunswick, bound by 45°12.99′ N, 66°01.58′ W; 45°13.00′ N, 66°01.06′ W; 45°12.26′ N, 66°00.27′ W; 45°11.49′ N, 66°00.23′ W; and 45°11.45′ N, 66°01.50′ W (NAD83).

6. Method of loading: Dredging will be carried out using barge-mounted mechanical dredges and/or a trailing suction hopper dredge.

7. Route to disposal site(s) and method of transport: Most direct route from the loading site to the disposal site via towed or self-propelled scows and/or a trailing suction hopper dredge.

8. Method of disposal: Disposal shall take place in accordance with the dredged material disposal plan required by paragraph 14.2 of this permit.

9. Total quantity to be disposed of: Not to exceed 450 000 m3 place measure.

10. Fees: The fee prescribed by the Disposal at Sea Permit Fee Regulations shall be paid by the Permittee in accordance with those Regulations.

11. Inspection:

11.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11.2. Ships operating under the authority of this permit shall be marked in accordance with the Collision Regulations of the Canada Shipping Act when located on or in the waterway.

12. Contractors:

12.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

12.2. The Permittee shall ensure that all persons involved in the loading, transport or disposal activities authorized by this permit conduct these activities in accordance with the relevant permit conditions.

13.2. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of the Environmental Protection Operations Directorate, Atlantic Region, c/o Ms. Jayne Roma, as identified in paragraph 13.1, within 30 days of the completion of the work. This report shall contain the following information: a list of all work completed pursuant to the permit, including the location of the loading and disposal sites used, the quantity of matter disposed of at the disposal site(s) and the dates on which disposal activities occurred.

13.3. The Canadian Coast Guard, Marine Communication and Traffic Services (MCTS) Sydney (1-800-686-8676) is to be notified in advance of the commencement of work so that appropriate Notices to Shipping/Mariners may be issued.

13.4. At all times, a copy of this permit and of documents and drawings referenced in this permit shall be available at the loading site and on all powered ships directly engaged in the loading and disposal operations.

14. Special precautions:

14.1. The loading and disposal at sea activities referred to under this permit shall be carried out in accordance with the mitigation measures summarized in Table 8.1 of the document titled “Canadian Environmental Assessment Act Screening-Level Environmental Assessment — 2012 Maintenance Dredging Project, Saint John Harbour, Saint John, New Brunswick” (May 2012).

14.2. The Permittee shall submit a dredged material disposal plan to Ms. Jayne Roma, as identified in paragraph 13.1, for approval by Environment Canada prior to commencement of the first dredging operation authorized by this permit. The plan shall address procedures to accurately measure or estimate quantities of dredged material disposed of at the disposal site(s), the release zone, vessel tracking, and a schedule for use of the disposal site. Modifications to the plan shall be made only with the written approval of Environment Canada.

14.3. The Permittee shall submit a total suspended solids (TSS) monitoring plan to Ms. Jayne Roma, as identified in paragraph 13.1, for approval by Environment Canada prior to commencement of the first dredging operation authorized by this permit. Modifications to the plan shall be made only with the written approval of Environment Canada.

2. Waste or other matter to be disposed of: Ships, aircraft, platforms or other structures from which all material that can create floating debris or other marine pollution has been removed to the maximum extent possible if, in the case of disposal, those substances would not pose a serious obstacle to fishing or navigation after being disposed of.

2.1. Nature of waste or other matter: Nine production risers, eight production and gas lift jumpers, and nine weak link jumpers.

3. Duration of permit: Permit is valid from July 2, 2012, to July 1, 2013.

4. Loading site(s): Terra Nova Field, Newfoundland and Labrador, at approximately 46°28.53′ N, 48°28.86′ W (NAD83), and as described in section 17 of the permit application.

5. Disposal site(s):

  1. (a) Terra Nova Northern Disposal Area, Newfoundland and Labrador, bound by 46°30.87 N, 48°28.53 W; 46°30.87 N, 48°27.94 W; 46°30.45 N, 48°27.96 W; and 46°30.47 N, 48°28.54 W (NAD83), and as described in Figure 4 of the permit application; and
  2. (b) Terra Nova Southern Disposal Area, Newfoundland and Labrador, bound by 46°26.61 N, 48°29.49 W; 46°26.59 N, 48°28.90 W; 46°26.19 N, 48°28.92 W; and 46°26.20 N, 48°29.51 W (NAD83), and as described in Figure 4 of the permit application.

6. Method of loading: Loading will be carried out as described in section 20 of the permit application.

7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site as described in section 19 of the permit application.

8. Method of disposal: Disposal will be carried as described in section 20 of the permit application.

9. Total quantity to be disposed of: Not to exceed 474 tonnes.

10. Inspection:

10.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11. Contractors:

11.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

11.2. The Permittee shall ensure that all persons involved in the loading, transport or disposal activities authorized by this permit conduct these activities in accordance with the relevant permit conditions.

2. Waste or other matter to be disposed of: Fish waste and other organic matter resulting from industrial fish processing operations.

2.1. Nature of waste or other matter: Fish waste and other organic matter consisting of fish and shellfish waste.

3. Duration of permit: Permit is valid from August 11, 2012, to August 10, 2013.

4. Loading site(s): New Harbour, Newfoundland and Labrador, at approximately (a) 47°35.35′ N, 53°32.60′ W (NAD83), and (b) 47°35.24′ N, 53°33.10′ W (NAD83).

5. Disposal site(s): New Harbour, within a 250 m radius of 47°37.00′ N, 53°36.00′ W (NAD83), at an approximate depth of 130 m.

6. Method of loading:

6.1. The Permittee shall ensure that the material is loaded onto floating equipment complying with all applicable rules regarding safety and navigation and capable of containing all waste cargo during loading and transit to the approved disposal site.

6.2. The Permittee shall ensure that the waste to be disposed of is covered by netting or other material to prevent access by gulls and other marine birds, except during direct loading or disposal of the waste.

6.3. Material loaded for the purpose of disposal at sea may not be held aboard any ship for more than 96 hours from the commencement of loading without the written consent of an enforcement officer designated pursuant to subsection 217(1) of the Canadian Environmental Protection Act, 1999.

6.4. The loading and transit shall be completed in a manner that ensures that no material contaminates the marine environment, notably the harbour and adjacent beaches. The Permittee shall also ensure that the loading sites are cleaned up and, if necessary, that spilled wastes are recovered.

7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site.

Notice with respect to certain cobalt-containing substances

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether the substances listed in Schedule 1 to this notice are toxic or are capable of becoming toxic, or for the purpose of assessing whether to control, or the manner in which to control the listed substances, any person described in Schedule 2 to this notice who possesses or who may reasonably be expected to have access to the information required in Schedule 3 to this notice, to provide that information no later than October 2, 2012, 5 p.m., Eastern Daylight Saving Time.

Responses to this notice shall be submitted to the Minister of the Environment, to the attention of the Substances Management Coordinator, Chemicals Management Plan, 200 Sacré-Cœur Boulevard, Gatineau, Quebec K1A 0H3. SCHEDULE 2

Persons Required to Provide Information

  1. This notice applies to any person who, during the 2011 calendar year, manufactured a total quantity greater than 100 kg, of a substance listed in Schedule 1 to this notice, at any concentration.
  2. This notice applies to any person who, during the 2011 calendar year, imported
    1. (a) a total quantity greater than 100 kg of a substance listed in Schedule 1 to this notice, at any concentration, whether alone or in a mixture;
    2. (b) a total quantity greater than 100 kg of a substance listed in Schedule 1 to this notice, at any concentration, in a product or in a manufactured item, intended for use by consumers for non-commercial purposes; or
    3. (c) a total quantity greater than 100 kg of a substance listed in Schedule 1 to this notice, at a concentration greater than 0.1% by weight, in a product or in a manufactured item, intended for uses other than those set out in subsection (b).
  3. This notice applies to any person who, during the 2011 calendar year, used a total quantity greater than 1 000 kg of a substance listed in Schedule 1 to this notice, at any concentration, whether the substance is used alone, in a mixture or in a product, in the manufacture of a mixture, product or manufactured item.
  4. This notice does not apply to a substance in Schedule 1, whether alone, in a mixture, in a product, or in a manufactured item that
    1. (a) is in transit through Canada;
    2. (b) is imported within steel or steel alloys;
    3. (c) is imported within other alloys, a paint, plastic or glass that is not intended for use by consumers for non-commercial purposes;
    4. (d) is imported within a battery; or
    5. (e) is, or is contained in, a pest control product within the meaning of subsection 2(1) of the Pest Control Products Act where that pest control product is registered under the Pest Control Products Act.
  5. Respondents to this notice who
    1. (a) manufactured, imported or used a substance listed in Part 1 of Schedule 1 shall complete sections 4 to 10, except for section 8 in Schedule 3; or
    2. (b) manufactured, imported or used a substance listed in Part 2 of Schedule 1 shall complete sections 4, 8 and 9 in Schedule 3.

SCHEDULE 3

Information Required

1. The definitions in this section apply in this notice.

“calendar year” means a period of 12 consecutive months commencing on January 1.

“manufacture” includes to produce or to prepare a substance, and also the incidental production of a substance.

“manufactured item” means an item that is formed into a specific physical shape or design during manufacture and has, for its final use, a function or functions dependent in whole or in part on its shape or design.

“mixture” means a combination of substances that does not produce a substance that is different from the substances that were combined, including prepared formulations, hydrates, and reaction mixtures that are characterized in terms of their constituents.

“product” excludes mixture and manufactured item.

2. If the person subject to the notice is a company that owns more than one facility, a single response to the notice shall be submitted. The single response shall amalgamate the information from all facilities owned by the company for each applicable question in the notice, unless otherwise indicated.

EXPLANATORY NOTE

(This note is not part of the notice.)

On October 8, 2011, the Minister of the Environment and the Minister of Health announced, as part of the second phase of the Chemicals Management Plan (CMP 2), in the Canada Gazette, Part Ⅰ, Vol. 145, No. 41, that approximately 500 substances divided into nine groups have been selected as priorities for action and are planned to be assessed and managed, where appropriate, over the next five years. These substances have been selected for further action based on the categorization exercise completed in 2006, and new information received as part of the first phase of the Chemicals Management Plan.

As part of the CMP 2, certain cobalt-containing substances will be assessed and are part of this notice. The cobalt substance grouping was based on a common moiety of ecological concern, and the substances have been identified both domestically and internationally to be a priority for assessment. A survey conducted for the Domestic Substances ListInventory Update identified that cobalt-containing substances may have a range of consumer applications including paints and coatings, plastic and rubber materials, food packaging, ink toners and colourants that could result in exposure to humans, including children.

The Notice with respect to certain cobalt-containing substances applies to a subset of these substances within this grouping, for which information is required. The information collected from this notice will inform the risk assessment and, if necessary, risk management for this grouping of substances.

Pursuant to subsection 71(3) of the Canadian Environmental Protection Act, 1999, every person to whom this notice applies is required to comply with this notice by the time specified in the notice. The time specified in this notice is October 2, 2012, 5 p.m., Eastern Daylight Saving Time.

Persons who do not meet the requirements to respond and have no commercial interest in the substances covered by this notice may complete a Declaration of Non-Engagement form for the notice. The form is available on the Chemical Substances Web site at www.chemicalsubstanceschimiques.gc.ca.

Persons not subject to this notice who have a current or future interest in a substance listed in Schedule 1 to this notice may identify themselves as a stakeholder for the substance by completing the voluntary Stakeholder Interest Form. The form allows the person to provide information that would be beneficial to inform the risk assessment and management of the substances. The person will be included in future mailings regarding these substances and may be contacted for further information regarding their interest in these substances. This form is available on the Chemical Substances Web site at www.chemicalsubstanceschimiques.gc.ca.

The Minister of the Environment and the Minister of Health are also inviting the submission of additional information that is deemed beneficial by interested stakeholders. Organizations that may be interested in submitting additional information in response to this invitation include those that manufacture, import, export or use this substance whether alone, in a mixture or in a product or a manufactured item.

Compliance with the Act is mandatory. Subsection 272(1) of the Act provides that

272. (1) Every person commits an offence who contravenes

  1. (a) a provision of this Act or the regulations;
  2. (b) an obligation or a prohibition arising from this Act or the regulations;
  3. (c) an order or a direction made under this Act;
  4. . . .

Subsection 272(2) of the Act provides that

272. (2) Every person who commits an offence under subsection (1) is liable

  1. (a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and
  2. (b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) of the Act provides that

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

  1. (a) provides any person with any false or misleading information, results or samples; or
  2. (b) files a document that contains false or misleading information.

Subsection 273(2) of the Act provides that

273. (2) Every person who commits an offence under subsection (1) is liable

  1. (a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;
  2. (b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;
  3. (c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and
  4. (d) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed negligently.

The Environmental Enforcement Act, chapter 14 of the Statutes of Canada, 2009, will amend the above provisions when section 72 of the Environmental Enforcement Act comes into force. PPP CANADA INC.

Chairperson (part-time position)

PPP Canada Inc. is a Crown corporation which reports to the Parliament of Canada through the Minister of Finance and is governed by a board of directors that is accountable for the overall stewardship of the Corporation. Its mandate is to improve the delivery of public infrastructure by achieving better value, timeliness and accountability to taxpayers, through public-private partnerships (P3s).

P3s are an alternative method for delivering large and complex public infrastructure projects. They offer three major benefits: better cost and delay controls, optimization of risk and resources, and innovation. P3s are typically long-term arrangements using financial and contractual incentives to leverage performance and innovation from the private sector and share risks associated with the design, construction, maintenance and operation of infrastructure assets.

PPP Canada Inc.’s operations focus on building P3 procurement knowledge and capacity amongst federal departments, and leveraging greater value for money from federal investments in provincial, territorial, municipal and First Nations infrastructure with the P3 Canada Fund.

The Chairperson leads the Board of Directors and oversees its activities and is primarily responsible for the effective operation of the Board in fulfilling its duties and responsibilities.

The successful candidate will have a degree from a recognized university in a relevant field of study or an acceptable combination of education, job-related training and/or business experience. The position requires the incumbent to possess experience in areas such as project finance, engineering and infrastructure project development, in particular as a senior executive in the public or private sector. Experience serving as a member of a board of directors, preferably as chairperson, is essential. Experience implementing modern corporate governance principles and best practices would be considered an asset.

The ideal candidate should be knowledgeable about PPP Canada Inc.’s mandate and activities. Knowledge of the current best practices in corporate governance as well as corporate and project finance is necessary. He or she will have knowledge of the Canadian financial services and/or infrastructure industries. Knowledge of the roles and responsibilities of the Chairperson and the Board of Directors is required. The selected candidate will have knowledge of the management and approval of capital projects at the federal and/or provincial level, and should also possess strong financial literacy.

The position requires an individual who has the capacity to build constructive relationships, facilitate information sharing and promote meaningful dialogue between Board members, senior management and shareholders. The ability to anticipate emerging issues and develop strategies to enable the Board to seize opportunities or solve problems is essential. The chosen candidate will have the ability to foster debate and discussion among Board members, to facilitate consensus, and to manage conflicts, should they arise. Superior communications skills, both written and oral, and the ability to act as a spokesperson and public champion of public-private partnership, are also important requirements. The qualified candidate will also have the ability to work with both the public and private sectors.

To achieve the Corporation’s objectives and carry out its mandate, the Chairperson should possess strong leadership and interpersonal skills, credibility among the variety of the Corporation’s stakeholders and demonstrated decision-making abilities. He or she will also adhere to high ethical standards, and have sound judgement, integrity and discretion.

The Board of Directors and its Committees meet at least four times per year, normally in the National Capital Region, and the Chairperson sits as an ex-officio member with voting rights on all committees of the Board. The successful candidate should expect to commit to the position an average of 50 days annually and be willing to travel to Ottawa for Board meetings. The Board also meets by teleconference as required.

Proficiency in both official languages would be preferred.
