CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice is hereby given that, pursuant to section 127 of the Canadian Environmental Protection Act, 1999, Disposal at Sea Permit No. 4543-2-06694 authorizing the loading for disposal and the disposal of waste or other matter at sea is approved.

1. Permittee: Department of Fisheries and Oceans, Small Craft Harbours Branch, Prince Edward Island.

2. Waste or other matter to be disposed of: Dredged material.

2.1. Nature of waste or other matter: Dredged material consisting of gravel, sand, silt and clay.

3. Duration of permit: Permit is valid from July 16, 2012, to July 15, 2013.

4. Loading site(s): New London Entrance Channel, Prince Edward Island, at approximately 46°30.27′ N, 63°28.23′ W (NAD83), as described in Figure 1 of the document titled “Canadian Environmental Assessment Screening Report — Dredging and Disposal at Sea of Dredged Sediments at New London Bay Entrance Channel to Stanley Bridge DFO Small Craft Harbours, Prince Edward Island” (June 2012), submitted in support of the permit application.

5. Disposal site(s): New London Entrance Channel, Prince Edward Island, at approximately 46°30.27′ N, 63°28.23′ W (NAD83), as described in Figure 1 of the document titled “Canadian Environmental Assessment Screening Report — Dredging and Disposal at Sea of Dredged Sediments at New London Bay Entrance Channel to Stanley Bridge DFO Small Craft Harbours, Prince Edward Island” (June 2012), submitted in support of the permit application.

6. Method of loading: Dredging will be carried out using a cutter suction dredge or a barge-mounted excavator.

7. Route to disposal site(s) and method of transport: Most direct route from the loading site to the disposal site via sidecasting.

8. Method of disposal: Disposal will be carried out by pipeline or sidecasting.

9. Total quantity to be disposed of: Not to exceed 10 000 m3 place measure.

9.1. The Permittee shall submit the procedures to measure or estimate quantities of dredged material disposed of at each disposal site to Ms. Jayne Roma, identified in paragraph 13.1. The Department of the Environment shall approve the procedures prior to the commencement of the first dredging operation to be conducted under this permit.

10. Fees: The fee prescribed by the Disposal at Sea Permit Fee Regulations shall be paid by the Permittee in accordance with those Regulations.

11. Inspection:

11.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11.2. Ships operating under the authority of this permit shall be marked in accordance with the Collision Regulations of the Canada Shipping Act when located on or in the waterway.

12. Contractors:

12.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

12.2. The Permittee shall ensure that all persons involved in the loading, transport or disposal activities authorized by this permit conduct these activities in accordance with the relevant permit conditions.

13. Reporting and notification:

13.1. The Permittee shall provide the following information at least 48 hours before loading and disposal activities commence: name or number of ship, platform or structure used to carry out the loading and/or disposal, name of the contractor including corporate and on-site contact information, and expected period of loading and disposal activities. The above-noted information shall be submitted to

13.2. The Canadian Coast Guard, Marine Communication and Traffic Services (MCTS) Sydney (notshipssyd@dfo-mpo.gc.ca) is to be notified in advance of the commencement of work so that appropriate Notices to Shipping/Mariners may be issued.

13.3. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of the Environmental Protection Operations Directorate, Atlantic Region, c/o Ms. Jayne Roma, as identified in paragraph 13.1, within 30 days of the expiry of the permit. This report shall contain the following information: the quantity of matter disposed of at the disposal site(s) and the dates on which disposal activities occurred.

13.4. At all times, a copy of this permit and of documents and drawings referenced in this permit shall be available at the loading site and on all powered ships directly engaged in the loading and disposal operations.

14. Special precautions:

14.1. The loading and disposal at sea activities referred to under this permit shall be carried out in accordance with the mitigation measures summarized in section 3.6 of the document titled “Canadian Environmental Assessment Screening Report — Dredging and Disposal at Sea of Dredged Sediments at New London Bay Entrance Channel to Stanley Bridge DFO Small Craft Harbours, Prince Edward Island” (June 2012), submitted in support of the permit application.

Waste or other matter to be disposed of: Ships, aircraft, platforms or other structures from which all material that can create floating debris or other marine pollution has been removed to the maximum extent possible if, in the case of disposal, those substances would not pose a serious obstacle to fishing or navigation after being disposed of.

2.1. Nature of waste or other matter: Steel bottom plate.

3. Duration of permit: Permit is valid from July 16, 2012, to July 15, 2013.

4. Loading site(s): Not applicable.

5. Disposal site(s): White Rose Disposal Site, Newfoundland and Labrador, bound by 46°45.49′ N, 48°03.21′ W; 46°46.03′ N, 48°03.19′ W; 46°46.00′ N, 48°02.40′ W; and 46°45.46′ N, 48°02.43′ W (NAD83), as described in section 18 of the permit application.

6. Method of loading: Not applicable.

7. Route to disposal site(s) and method of transport: Not applicable.

8. Method of disposal: Disposal will be carried out by the direct release of the plate from the SeaRose FPSO.

9. Total quantity to be disposed of: Not to exceed 260 tonnes.

10. Inspection:

10.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

11. Contractors:

11.1. The loading or disposal at sea referred to under this permit shall not be carried out by any person without written authorization from the Permittee.

11.2. The Permittee shall ensure that all persons involved in the loading, transport or disposal activities authorized by this permit conduct these activities in accordance with the relevant permit conditions.

5. Disposal site(s): White Rose Disposal Site, Newfoundland and Labrador, bound by 46°45.49′ N, 48°03.21′ W; 46°46.03′ N, 48°03.19′ W; 46°46.00′ N, 48°02.40′ W; and 46°45.46′ N, 48°02.43′ W (NAD83), as described in Figure 7 submitted in support of the permit application.

6. Method of loading: Dredging will be carried out using a trailing suction hopper dredge.

7. Route to disposal site(s) and method of transport: Most direct navigational route from the loading site to the disposal site.

8. Method of disposal: Disposal shall take place in accordance with the dredged material disposal plan required in paragraph 14.1 of this permit.

9. Total quantity to be disposed of: Not to exceed 135 000 m3 place measure.

10. Fees: The fee prescribed by the Disposal at Sea Permit Fee Regulations shall be paid by the Permittee in accordance with those Regulations.

11. Inspection:

11.1. By accepting this permit, the Permittee and their contractors accept that they are subject to inspection pursuant to Part 10 of the Canadian Environmental Protection Act, 1999.

13.2. The Permittee shall submit a written report to the Minister, as represented by the Regional Director of the Environmental Protection Operations Directorate, c/o Ms. Jayne Roma, as identified in paragraph 13.1, within 30 days of the expiry of the permit. This report shall contain the following information: a list of all work completed pursuant to the permit, including the location of the loading and disposal sites used, the quantity of matter disposed of at the disposal site(s) and the dates on which disposal activities occurred.

13.3. At all times, a copy of this permit and of documents and drawings referenced in this permit shall be available at the loading site and on all powered ships directly engaged in the loading and disposal operations.

14. Special precautions:

14.1. The Permittee shall submit a dredged material disposal plan to Ms. Jayne Roma, as identified in paragraph 13.1, for approval by Environment Canada prior to commencement of the first dredging operation authorized by this permit. The plan shall, at minimum, address procedures to accurately measure or estimate quantities of dredged material disposed of at the disposal site(s), mitigation measures in relation to loading and disposal activities, and a schedule for use of the disposal site(s). Modifications to the plan shall be made only with the written approval of Environment Canada.

Notice with respect to certain methylenediphenyl diisocyanate and diamine, and phenol, methyl- substances

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether the substances listed in Schedule 1 to this notice are toxic or are capable of becoming toxic, or for the purpose of assessing whether to control, or the manner in which to control the listed substances, any person described in Schedule 2 to this notice who possesses or who may reasonably be expected to have access to the information required in Schedule 3 to this notice, to provide that information no later than October 16, 2012, 5 p.m. Eastern Daylight Saving Time.

SCHEDULE 2

Persons Required to Provide Information

1. This notice applies to any person who, during the 2011 calendar year, manufactured a total quantity greater than 100 kg of a substance listed in Schedule 1 to this notice, at any concentration.

2. This notice applies to any person who, during the 2011 calendar year, imported a total quantity greater than 100 kg of a substance listed in Schedule 1 to this notice at any concentration, whether alone, in a mixture or in a product.

3. This notice applies to any person who, during the 2011 calendar year, imported a total quantity greater than 100 kg of a substance listed in Part 3 of Schedule 1 to this notice, at any concentration, in a manufactured item, intended for use by consumers for non-commercial purposes.

4. This notice applies to any person who, during the 2011 calendar year, used a total quantity greater than 1 000 kg of a substance listed in Part 1 or Part 2 of Schedule 1 to this notice at any concentration, whether the substance is used alone, in a mixture or in a product, or in the manufacture of a mixture, product or manufactured item.

5. This notice applies to any person who, during the 2011 calendar year, used a total quantity greater than 1 000 kg of a substance listed in Part 3 of Schedule 1 to this notice at any concentration, whether the substance is used alone, in a mixture or in a product, in the manufacture of a mixture or product, or in the manufacture of a manufactured item intended for use by consumers for non-commercial purposes.

6. This notice does not apply to a substance listed in Schedule 1, whether alone, in a mixture, in a product, or in a manufactured item that

  • (a) is in transit through Canada; or
  • (b) is, or is contained in, a pest control product within the meaning of subsection 2(1) of the Pest Control Products Act where that pest control product is registered under the Pest Control Products Act.

7. Respondents to this notice who

  • (a) manufactured or used a substance listed in Part 1 of Schedule 1 shall complete sections 4 to 12, except for section 10, in Schedule 3;
  • (b) manufactured or used a substance listed in Part 2 or Part 3 of Schedule 1 shall complete sections 4 to 12 in Schedule 3;
  • (c) imported a substance listed in Part 1 of Schedule 1 shall complete sections 4 to 11, except for section 10, in Schedule 3; or
  • (d) imported a substance listed in Part 2 or Part 3 of Schedule 1 shall complete sections 4 to 11 in Schedule 3.

SCHEDULE 3

Information Required

1. The definitions in this section apply in this notice.

“calendar year” means a period of 12 consecutive months commencing on January 1st.

“manufacture” includes to produce or to prepare a substance, and also the incidental production of a substance.

“manufactured item” means an item that is formed into a specific physical shape or design during manufacture and has, for its final use, a function or functions dependent in whole or in part on its shape or design.

“mixture” means a combination of substances that does not produce a substance that is different from the substances that were combined, including a prepared formulation, hydrate, and reaction mixture that are characterized in terms of their constituents.

“product” excludes “mixture” and “manufactured item.”

2. If the person subject to the notice is a company who owns more than one facility, a single response to the notice shall be submitted. The single response shall amalgamate the information from all facilities owned by the company for each applicable question in the notice, unless otherwise indicated.

3. Where information required under Schedule 3 to this notice was submitted to the Minister of the Environment, after January 1, 2007, it may be relied on as a response to any question in Schedule 3 to this notice if

  • (a) the information previously submitted is applicable to the 2011 calendar year;
  • (b) the information meets the requirements of the specific question;
  • (c) the person agrees that the previously submitted information referred to is their response to the specified provision of Schedule 3 to this notice; and
  • (d) the person provides the following information:

    • (i) the CAS RN of the substance(s) to which the submitted information relates,
    • (ii) the specific section, subsection, or paragraph to this notice to which the submitted information relates,
    • (iii) for each CAS RN, the title or description of the submitted information,

EXPLANATORY NOTE

(This note is not part of the notice.)

On October 8, 2011, the Minister of the Environment and the Minister of Health announced, as part of the second phase of the Chemicals Management Plan (CMP 2), in the Canada Gazette, Part Ⅰ, Vol. 145, No. 41, that nine groupings of substances including approximately 500 substances have been selected as priorities for action, and planned to be assessed and managed, where appropriate, over the next five years. These substances have been selected for further action based on the categorization exercise completed in 2006, and new information received as part of the first phase of the Chemicals Management Plan.

As part of the CMP 2, a grouping of certain methylenediphenyl diisocyanates and diamines substances will be assessed, and are part of this notice. This grouping of substances is based on similarities in structure, toxicological properties and use. Additionally, some of these substances have been added to the Substances of Very High Concern list in the European Union. The Domestic Substances List Inventory Update identified that these substances may have a wide range of consumer applications, including toys, playground sporting equipment, plastics, rubber, food packaging, paints and coatings, adhesives, and foam seating and bedding that could result in exposure to humans, including children. Some of these substances have been reported to be used in high volumes in Canada.

Additionally, another grouping of CMP 2, namely the internationally classified grouping, will also be assessed, and one substance of the grouping will be part of this notice. Substances in this grouping have been identified as having high hazard potential as classified by international agencies. A survey conducted for phase 1 of the Domestic Substances List Inventory Update identified that some of these substances are in commerce in Canada and may have reported uses in consumer products and/or products intended to be used by children.

The Notice with respect to certain methylenediphenyl diisocyanate and diamine, and phenol, methyl- substances applies to this grouping, for which information is required. The information collected from this notice will inform the risk assessment and, if necessary, risk management for this grouping of substances.

Pursuant to subsection 71(3) of the Canadian Environmental Protection Act, 1999 (CEPA 1999), every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The time specified in this notice is October 16, 2012, 5 p.m., Eastern Daylight Saving Time.

Persons who do not meet the requirements to respond and have no commercial interest in the substances covered by this notice may complete a Declaration of Non-Engagement form for the notice. The form is available on the Chemical Substances Web site at www.chemicalsubstanceschimiques.gc.ca.

Persons not subject to this notice, who have a current or future interest in a substance listed in Schedule 1 to this notice, may identify themselves as a “stakeholder” for the substance by completing the voluntary “Stakeholder Interest Form.” The form allows the person to provide information that would be beneficial to inform the risk assessment and management of the substances. The person will be included in future mailings regarding these substances and may be contacted for further information regarding their interest in these substances. This form is available on the Chemical Substances Web site at www. chemicalsubstanceschimiques.gc.ca.

The Minister of the Environment and the Minister of Health are also inviting the submission of additional information that is deemed beneficial by interested stakeholders. Organizations that may be interested in submitting additional information in response to this invitation include those that manufacture, import, export or use this substance whether alone, in a mixture or in a product or a manufactured item.

Compliance with the Act is mandatory. Subsection 272(1) of the Act provides that

272. (1) Every person commits an offence who contravenes

  • (a) a provision of this Act or the regulations;
  • (b) an obligation or a prohibition arising from this Act or the regulations;
  • (c) an order or a direction made under this Act; . . .

Subsection 272(2) of the Act provides that

272. (2) Every person who commits an offence under subsection (1) is liable

  • (a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both; and
  • (b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both.

Furthermore, with respect to providing false or misleading information, subsection 273(1) of the Act provides that

273. (1) Every person commits an offence who, with respect to any matter related to this Act or the regulations,

  • (a) provides any person with any false or misleading information, results or samples; or
  • (b) files a document that contains false or misleading information.

Subsection 273(2) of the Act provides that

273. (2) Every person who commits an offence under subsection (1) is liable

  • (a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed knowingly;
  • (b) on summary conviction, to a fine of not more than $300,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed knowingly;
  • (c) on conviction on indictment, to a fine of not more than $500,000 or to imprisonment for a term of not more than three years, or to both, if the offence is committed negligently; and
  • (d) on summary conviction, to a fine of not more than $200,000 or to imprisonment for a term of not more than six months, or to both, if the offence is committed negligently.

The Environmental Enforcement Act, chapter 14 of the Statutes of Canada, 2009, will amend the above provisions when section 72 of the Environmental Enforcement Act comes into force. The above provisions of the Act have been reproduced for convenience of reference only. If there is any variance between the above provisions and the wording of the Act, the official version of the Act prevails. CANADA PETROLEUM RESOURCES ACT

Issuance of exploration licences in the Beaufort Sea

Pursuant to paragraph 17(1)(b) of the Canada Petroleum Resources Act, R.S.C. 1985, c. 36 (2nd supplement), the Minister of Indian Affairs and Northern Development Canada advises of his intent to issue new exploration licences to replace existing exploration licences in the Beaufort Sea in order to equitably restore the exploration licence term which was adversely affected due to the National Energy Board’s (NEB) Public Review of Arctic Safety and Environmental Offshore Drilling Requirements, and the predecessor Policy Review on Same Season Relief Well Capabilities during which operations were effectively suspended. These hearings were initiated on or about November 1, 2009, and concluded with the publication of the NEB’s final report Filing Requirements for Offshore Drilling in the Canadian Arctic on December 15, 2011. The new exploration licences will be issued in relation to the same frontier lands and all other terms and conditions of the new exploration licence will remain the same as the original exploration licence or as will be included as standard terms and conditions in new exploration licences. The following is a summary of the proposed new exploration licence terms.

Notice No. SMSE-008-12 — Spectrum Utilization Policy, Decisions on the Frequency Bands 71-76 GHz, 81-86 GHz and 92-95 GHz

The intent of this notice is to announce the release of the above-mentioned spectrum document containing decisions on the use of the bands 71-76 GHz, 81-86 GHz and 92-95 GHz by the fixed service.

Background

In October 2004, the Department released SP 3-30 GHz, Revisions to Spectrum Utilization Policies in the 3-30 GHz Frequency Range and Further Consultation, which included a consultation on the utilization of the bands 71-76 GHz, 81-86 GHz and 92-95 GHz for fixed services. Based on the comments received, the Department decided to wait until equipment was more readily available before developing a policy.

With the recent interest and growing demand for short-range backhaul facilities, the Department released SMSE-010-11, Consultation on Spectrum Utilization of Frequency Bands 71-76 GHz, 81-86 GHz and 92-95 GHz by the Fixed Service, in July 2011. This consultation dealt with the possible designation of these bands for the fixed service. Comments were sought on spectrum policy and technical aspects, including band plan, technical characteristics and the licensing mechanisms.

Discussion

In response to the consultation (SMSE-010-11), seven comments were received. These comments reflected general support for the opening of these bands for the fixed service.

Prince Rupert Port Authority — Supplementary letters patent

BY THE MINISTER OF TRANSPORT

WHEREAS Letters Patent were issued by the Minister of Transport (“Minister”) for the Prince Rupert Port Authority (“Authority”) under the authority of the Canada Marine Act (“Act”), effective May 1, 1999;

WHEREAS Schedule C of the Letters Patent describes the real property, other than federal real property, held or occupied by the Authority;

WHEREAS pursuant to subsection 46(2.1) of the Act, the Authority wishes to acquire the real property described below from J.S. McMillan Fisheries Ltd.;

WHEREAS the board of directors of the Authority has requested that the Minister issue Supplementary Letters Patent to authorize the Authority to acquire the real property described below and to amend Schedule C of the Letters Patent to reflect the acquisition of the said real property;

AND WHEREAS the Minister is satisfied that the amendments to the Letters Patent of the Authority are consistent with the Act;

NOW THEREFORE, pursuant to subsections 9(1) and 46(2.1) of the Canada Marine Act, I authorize the Authority to acquire the said real property and I amend the Letters Patent as follows:

1. Schedule C of the Letters Patent is amended by striking out the phrase “(Intentionally deleted)”.

2. Schedule C of the Letters Patent is amended by adding the following after the heading “DESCRIPTION OF OTHER REAL PROPERTY”:
