CANADIAN INTERNATIONAL TRADE TRIBUNAL

DETERMINATION

Steel piling pipe

Notice is hereby given that, on July 3, 2012, pursuant to paragraph 35(1)(b) of the Special Import Measures Act (SIMA) the Canadian International Trade Tribunal (the Tribunal) concluded that the evidence did not disclose a reasonable indication that the dumping and subsidizing of the carbon steel welded pipe that it found to be subject to the finding that it made in Inquiry No. NQ-2008-001 had caused injury or retardation or was threatening to cause injury to the domestic industry (Preliminary Injury Inquiry No. PI-2012-002). Therefore, pursuant to paragraph 35(3)(a) of SIMA, the Tribunal terminated its preliminary injury inquiry with respect to those goods.

Pursuant to subsection 37.1(1) of SIMA, the Tribunal also determined that there was evidence that disclosed a reasonable indication that the dumping and subsidizing of the above-mentioned goods, in respect of which the preliminary injury inquiry had not been terminated under section 35 of SIMA, had caused injury or were threatening to cause injury.
