EXPIRY OF FINDING

Carbon steel welded pipe

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its finding made on August 20, 2008, in Inquiry No. NQ-2008-001, concerning the dumping and subsidizing of carbon steel welded pipe originating in or exported from the People’s Republic of China, is scheduled to expire (Expiry No. LE-2012-003) on August 19, 2013. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.

The Tribunal’s expiry proceeding will be conducted by way of written submissions. Any firm, organization, person or government wishing to participate as a party in these proceedings must file a notice of participation with the Secretary on or before October 31, 2012. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before October 31, 2012.

On November 1, 2012, the Tribunal will issue a List of Participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed an undertaking with the Tribunal. This information will be included in the List of Participants. Ten copies of all submissions must be served on the Tribunal.

Parties requesting or opposing the initiation of an expiry review of the said finding shall file their written public submissions containing relevant information, opinions and arguments with the Secretary of the Tribunal, and on counsel and parties of record, no later than November 5, 2012. Where there are opposing views, each party that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other parties. Parties wishing to respond to the submissions must do so no later than November 19, 2012.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

The Tribunal will issue a decision on December 5, 2012, on whether an expiry review is warranted. If the Tribunal decides that a review is not warranted, the finding will expire on its scheduled expiry date. The Tribunal will issue its reasons no later than 15 days after its decision. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2012-020) from C3 Polymeric Limited (C3), of Brampton, Ontario, concerning a procurement (Solicitation No. NGC 12-C011) by the National Gallery of Canada (NGC). The solicitation is for the replacement of the insulating glass units enclosing the Great Hall and the reconstruction of 13 small roofs. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.

C3 alleges that the NGC improperly and unfairly evaluated its proposal.

Broadcasting licence fees — Part Ⅱ

  1. The Broadcasting Licence Fee Regulations, 1997, SOR/97-144, as amended by SOR/2010-157 dated July 7, 2010 (the Regulations), provide for the payment of a Part Ⅱ licence fee by certain licensed broadcasting undertakings. The revised Regulations were announced by the Commission in Amendments to the Broadcasting Licence Fee Regulations, 1997, Broadcasting Regulatory Policy CRTC 2010-476, July 14, 2010 (Broadcasting Regulatory Policy 2010-476).
  2. Subsections 11(1) and 11(2) of the Regulations set out the components for the calculation of the Part Ⅱ licence fees. As per these sections of the Regulations, the total annual amount to be assessed by the Commission is the lesser of the following:
    • (a) $100,000,000 which, starting in 2011, is adjusted annually on a compound basis in accordance with the percentage increase or decrease, as the case may be, to the Consumer Price Index (CPI) for the calendar year prior to the year of the adjustment. The CPI is the annual average all-items CPI for Canada (not seasonally adjusted) that is published by Statistics Canada. As noted in Broadcasting Regulatory Policy 2010-476, the Commission will use the CPI set out in Statistics Canada Catalogue No. 62-001-XWE, Table 5, CANSIM vector number v41690973. Part Ⅱ licence fees assessed in 2011 totalled $101,800,000. For 2011, the annual average CPI was 2.9%. Thus, the adjusted value of this component for 2012 is $104,752,200.
    • (b) 1.365% multiplied by the aggregate fee revenues for the return year terminating during the previous calendar year of all licensees whose fee revenues exceed the applicable exemption levels, less the aggregate exemption level for all those licensees for that return year (i.e. $11.855 billion). In 2012 this amounts to $161,819,385.
  3. Pursuant to subsection 11(3) of the Regulations, the Commission announces in the public notice that the total amount of Part Ⅱ licence fees to be assessed by the Commission in 2012 is $104,752,200, which is the lesser of the two amounts referred to in paragraph 2 above.
