SPECIAL IMPORT MEASURES ACT
Certain liquid dielectric transformers — Decision
On October 22, 2012, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping, pursuant to paragraph 41(1)(a) of the Special Import Measures Act, in respect of liquid dielectric transformers having a top power handling capacity equal to or exceeding 60 000 kilovolt-amperes (60 megavolt-amperes), whether assembled or unassembled, complete or incomplete, originating in or exported from the Republic of Korea.
The goods in question are usually classified under the following Harmonized System classification number: 8504.23.00.00.
Unassembled or incomplete transformers may also be classified under the following Harmonized System classification numbers:
- 8504.90.90.10
- 8504.90.90.82
- 8504.90.90.90
The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make an order or finding by November 20, 2012. Provisional duties will continue to apply until this date.
If the Tribunal finds that the dumping has caused injury or is threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping on the goods. In that event, the importer in Canada shall pay all such duties. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping duty.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2012-013) on October 25, 2012, with respect to a complaint filed by Team Sunray and CAE Inc., of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. W8476-112965/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of an integrated soldier system.
Team Sunray and CAE Inc. alleged that PWGSC improperly evaluated the proposal.

Samson alleged that PWGSC improperly evaluated its proposal.

The solicitation is for the supply and delivery of radar components and software to the Canadian Coast Guard.
