Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2012-020) on February 14, 2013, with respect to a complaint filed by C3 Polymeric Limited (C3), of Brampton, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. NGC 12-C011) by the National Gallery of Canada (NGC). The solicitation was for the replacement of the insulating glass units enclosing the Great Hall and the reconstruction of 13 small roofs.

C3 alleged that the NGC improperly and unfairly evaluated its proposal.

Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade and the Agreement on Government Procurement, the Tribunal determined that the complaint was not valid.

These applications involve transfers of ownership and changes in the effective control of broadcasting undertakings, as well as applications for amendments or extensions of deadlines.

Broadcasting licence fees — Part Ⅰ

The Broadcasting Licence Fee Regulations, 1997 (the Regulations) provide for the payment of a Part Ⅰ licence fee by certain broadcasting undertakings. Subsection 9(1) of the Regulations sets out the components for the calculation of the regulatory costs.

Pursuant to section 10 of the Regulations, the Commission hereby announces in this public notice that the estimated total broadcasting regulatory costs of the Commission for the 2013–2014 fiscal year are $30.161 million.

The annual adjustment amount referred to in subsection 8(2) for the 2011–2012 fiscal year is $0.377 million.

A second adjustment pertaining to the 2012–2013 fiscal year in the amount of $0.005 million is being made following the revision of the Part Ⅰ billing for one broadcasting undertaking. Part Ⅰ broadcasting licence fees were recalculated and the adjustment is being invoiced to the other broadcasting undertakings.

The net billing for the Part Ⅰ licence fee for the 2013–2014 fiscal year, taking into account the adjustments in the paragraphs above, is $30.543 million. This is a slight decrease ($0.080 million) from the net billing of $30.623 million in the previous fiscal year.

There were no submissions from affected parties to the screening officer with respect to any of the above claims for exemption and related MSDSs or labels.

Each of the claims for exemption listed above was found to be valid. The screening officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations.

Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the respective MSDSs in respect of the claims bearing Registry Numbers 8152, 8153, 8155, 8157, 8223, 8238, 8239, 8282, 8289, 8312 and 8319 which were filed, complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claims bearing Registry Numbers 7948 and 8151, being claims from an employer in the province of Alberta, the screening officer found that the MSDSs relating to these claims did not comply with the applicable disclosure requirements of the Occupational Health and Safety Code 2009 of the Province of Alberta.

In the case of the claim bearing Registry Number 8098, being a claim from an employer in the province of Ontario, the screening officer found that the MSDS relating to the claim did not comply with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Ontario.

In all cases where the material safety data sheet or the label was determined not to be in compliance with the relevant legislation, the screening officer offered the claimant the possibility of entering into an undertaking whereby the claimant would voluntarily make the changes necessary to bring the MSDS or the label into compliance. Pursuant to subsection 16.1(1) of the Hazardous Materials Information Review Act, the claimant was given 30 days to provide the screening officer with a signed undertaking accompanied by the MSDS or the label amended as necessary.

In the case of the following claims, the claimant supplied the screening officer with a signed undertaking accompanied by the MSDS or label amended as necessary within the time frame specified. The screening officer was satisfied that the claimant had taken the measures set out in the undertaking in the manner and within the period specified therein.

Pursuant to subsection 24(1) of the Controlled Products Regulations, amended MSDSs must be available in both official languages.

Pursuant to subsection 24(3) of the Controlled Products Regulations, amended labels must be available in both official languages.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a screening officer. It also affords the opportunity to an affected party to appeal an undertaking. The above claims seek exemption from the disclosure of supplier confidential business information in respect of a controlled product; such disclosure would otherwise be required under the provisions of the Hazardous Products Act.

Subsection 12(2) of the Hazardous Materials Information Review Act requires that this notice contain a statement offering every affected party the opportunity to make written representations to the screening officer with respect to the claim for exemption and the material safety data sheet to which it relates.

Under the provisions of the Hazardous Materials Information Review Regulations, “affected party,” for purposes of the Hazardous Materials Information Review Act, means, in respect of a controlled product that is the subject of a claim for exemption, a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

  • (a) a supplier of the controlled product;
  • (b) an employee at the work place;
  • (c) an employer at the work place;
  • (d) a safety and health professional for the work place;
  • (e) a safety and health representative or a member of a safety and health committee for the work place; and
  • (f) a person who is authorized in writing to represent
    • (i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or
    • (ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

SPECIES AT RISK ACT

Description of critical habitat of the Maritime Ringlet in Forillon National Park of Canada

The Maritime Ringlet (Coenonympha nipisiquit) is a species listed in Schedule 1 to the Species at Risk Act as endangered. Critical habitat for the Maritime Ringlet is identified within the final Recovery Strategy for the Maritime Ringlet (Coenonympha nipisiquit) in Canada.

Notice is hereby given that, pursuant to subsection 58(2) of the Species at Risk Act, critical habitat of the Maritime Ringlet (Coenonympha nipisiquit) in Forillon National Park of Canada is located within the following site, save and except any anthropogenic structures (e.g. roads, rights-of-way, piers) and any area that does not possess the biophysical attributes of a suitable salt marsh. The parcel number is based on the unique Committee on the Status of Endangered Wildlife in Canada (COSEWIC) species identification number for Maritime Ringlet (304), and critical habitat parcel number. Further details regarding Maritime Ringlet critical habitat (including maps) can be found at the Species at Risk Public Registry Web site.

Generally, critical habitat is located within the salt marsh located in the Baie de Penouille, as identified on the National Topographic Series (NTS) Map 22A/16 (Edition 5, printed 2001). Specifically, within the geographical boundaries identified below, critical habitat includes salt marsh habitat with the following biological and physical attributes:

  • the habitat is located within estuaries or harbours fed by one or more river and stream systems;
  • the habitat contains a mosaic of plants used as hosts for oviposition and larval development (Salt-meadow Grass) as well as nectar sources for adults (Salt-water Cord Grass, Seaside Plantain, Sea Milkwort, Sea Lavender, Seaside Goldenrod, and Eged's Silverweed); and
  • the habitat is separated from adjacent sand dunes, fresh water marshes or forests by a narrow zone of marsh edge vegetation more typical of drier upland habitats, including Common Yarrow (Achillea millefolium), Sow-thistle (Sonchus sp.), Glasswort (Salicornia spp.) and Sweet Gale (Myrica gale).
