Certain unitized wall modules — Decision
On March 4, 2013, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the President, Canada Border Services Agency (CBSA), initiated investigations into the alleged injurious dumping and subsidizing of unitized wall modules, with or without infill, including fully assembled frames, with or without fasteners, trims, cover caps, window operators, gaskets, load transfer bars, sunshades and anchor assemblies; excluding non-unitized building envelope systems such as stick systems and point-fixing systems, originating in or exported from the People's Republic of China.
Since January 1, 2012, the goods in question are usually classified under the following Harmonized System subheading numbers:
- 7610.10.00
- 7610.90.10
- 7610.90.90
The Canadian International Trade Tribunal (Tribunal) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The Tribunal will make a decision within 60 days of the date of initiation. If the Tribunal concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

Representations
Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping or subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Anti-dumping and Countervailing Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th Floor, Ottawa, Ontario K1A 0L8. To be given consideration in these investigations, this information should be received by April 11, 2013.
Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY
Unitized wall modules
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), the Tribunal has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2012-006) to determine whether the evidence discloses a reasonable indication that the alleged injurious dumping and subsidizing of unitized wall modules, with or without infill, including fully assembled frames, with or without fasteners, trims, cover caps, window operators, gaskets, load transfer bars, sunshades and anchor assemblies, excluding non-unitized building envelope systems, such as stick systems and point-fixing systems, originating in or exported from the People's Republic of China (the subject goods), have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.
The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Secretary on or before March 20, 2013. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before March 20, 2013.
On March 21, 2013, the Tribunal will issue a List of Participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed an undertaking with the Tribunal. This information will be included in the List of Participants. Ten copies of all submissions must be served on the Tribunal.
Submissions by parties opposed to the complaint must be filed not later than noon, on April 8, 2013. The complainants may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on April 16, 2013. At that time, parties in support of the complaint may also make submissions to the Tribunal.

Hot-rolled carbon steel plate and high-strength low-alloy steel plate
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its order made on January 8, 2009, in Expiry Review No. RR-2008-002, continuing, without amendment, the finding made on January 9, 2004, in Inquiry No. NQ-2003-002, concerning the dumping of hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths in widths from 24 inches (+/-610 mm) to 152 inches (+/-3 860 mm) inclusive and in thicknesses from 0.187 inch (+/-4.75 mm) to 4 inches (+/-101.6 mm) inclusive, originating in or exported from the Republic of Bulgaria, the Czech Republic and Romania, excluding plate produced to American Society for Testing and Materials (ASTM) specifications A515 and A516M/A516 Grade 70 in thicknesses greater than 3.125 inches (+/-79.3 mm), universal mill plate, plate for use in the manufacture of pipe and plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), is scheduled to expire (Expiry No. LE-2012-006) on January 7, 2014. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.
The Tribunal's expiry proceeding will be conducted by way of written submissions. Any firm, organization, person or government wishing to participate as a party in these proceedings must file a notice of participation with the Secretary on or before March 20, 2013. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before March 20, 2013.

Where there are opposing views, each party that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other parties. Parties wishing to respond to the submissions must do so no later than April 10, 2013.

There were no submissions from affected parties to the screening officer with respect to any of the above claims for exemption and related MSDSs or labels.
Each of the claims for exemption listed above was found to be valid. The screening officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations.
Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the respective MSDSs in respect of the claims bearing Registry Numbers 8161, 8201, 8204, 8258, 8305, 8308, 8309, 8310, 8328, 8351, 8363, 8410, 8411, 8417 and 8484 which were filed, complied with the applicable disclosure requirements of the Hazardous Products Act and the Controlled Products Regulations.
In the case of the claim bearing Registry Number 8141, being a claim from an employer with operations in the province of Alberta, the screening officer found that the MSDSs and label in respect of which the claim was filed did not comply with the applicable disclosure requirements of the Occupational Health and Safety Code 2009 of the Province of Alberta.
In all cases where the material safety data sheet or the label was determined not to be in compliance with the relevant legislation, the screening officer offered the claimant the possibility of entering into an undertaking whereby the claimant would voluntarily make the changes necessary to bring the MSDS or the label into compliance. Pursuant to subsection 16.1(1) of the Hazardous Materials Information Act, the claimant was given 30 days to provide the screening officer with a signed undertaking accompanied by the MSDS or the label amended as necessary.
In the case of the following claims, the claimant supplied the screening officer with a signed undertaking accompanied by the MSDS or label amended as necessary within the time frame specified. The screening officer was satisfied that the claimant had taken the measures set out in the undertaking in the manner and within the period specified therein.

Section 20 of the Hazardous Materials Information Review Act affords the opportunity to a claimant or any affected party, within the meaning of subsection 2(2) of the Hazardous Materials Information Review Regulations, to appeal a decision or order of a screening officer. It also affords the opportunity to an affected party to appeal an undertaking.
