Certain galvanized steel wire — Decision

On April 22, 2013, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the President of the Canada Border Services Agency (CBSA) made a preliminary determination of dumping in respect of certain galvanized steel wire originating in or exported from the People's Republic of China, the State of Israel and the Kingdom of Spain and made a preliminary determination of subsidizing in respect of the above-mentioned goods originating in or exported from the People's Republic of China.

The subject goods are usually classified under the following Harmonized System classification numbers:

The Canadian International Trade Tribunal (Tribunal) will conduct a full inquiry into the question of injury to the Canadian producers of certain galvanized steel wire and will make an order or finding not later than 120 days after its receipt of the notice of the preliminary determinations of dumping and subsidizing.

Pursuant to section 8 of SIMA, provisional duty is payable on subject goods that are released from the CBSA during the period commencing on April 22, 2013, and ending on the earlier of the day the investigations are terminated, the day on which the Tribunal makes an order or finding, or the day an undertaking is accepted.

The amount of provisional duty payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

Notice is hereby given that, on May 3, 2013, pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal determined that there was evidence that disclosed a reasonable indication that the dumping and subsidizing of unitized wall modules, with or without infill, including fully assembled frames, with or without fasteners, trims, cover caps, window operators, gaskets, load transfer bars, sunshades and anchor assemblies, excluding non-unitized building envelope systems, such as stick systems and point-fixing systems, originating in or exported from the People's Republic of China, had caused injury or were threatening to cause injury (Preliminary Injury Inquiry No. PI-2012-006).

Aluminum extrusions

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice, pursuant to subsection 76.03(2) of the Special Import Measures Act (SIMA), that its findings made on March 17, 2009, in Inquiry No. NQ-2008-003, and as amended on February 10, 2011, in Inquiry No. NQ-2008-003R concerning the dumping and subsidizing of aluminum extrusions produced via an extrusion process of alloys having metallic elements falling within the alloy designations published by The Aluminum Association commencing with 1, 2, 3, 5, 6 or 7 (or proprietary or other certifying body equivalents), with the finish being as extruded (mill), mechanical, anodized or painted or otherwise coated, whether or not worked, having a wall thickness greater than 0.5 mm, with a maximum weight per metre of 22 kg and a profile or cross-section which fits within a circle having a diameter of 254 mm, originating in or exported from the People's Republic of China, excluding the products described in Appendix 1, are scheduled to expire (Expiry No. LE-2013-001) on March 16, 2014. Under SIMA, findings of injury or threat of injury and the associated special protection in the form of anti-dumping or countervailing duties expire five years from the date of the last order or finding, unless an expiry review has been initiated before that date.

The Tribunal's expiry proceeding will be conducted by way of written submissions. Any firm, organization, person or government wishing to participate as a party in these proceedings must file a notice of participation with the Secretary on or before May 13, 2013. Each counsel who intends to represent a party in these proceedings must also file a notice of representation, as well as a declaration and undertaking, with the Secretary on or before May 13, 2013.

On May 14, 2013, no later than noon, the Tribunal will issue a List of Participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an Undertaking with the Tribunal. This information will be included in the List of Participants. Ten copies of all submissions must be served on the Tribunal.

Parties requesting or opposing the initiation of an expiry review of the said findings shall file their written public submissions containing relevant information, opinions and arguments, with the Secretary of the Tribunal, counsel and parties of record, no later than May 17, 2013. Where there are opposing views, each party that filed a submission in response to the notice of expiry will be given an opportunity to respond in writing to the representations of other parties. Parties wishing to respond to the submissions must do so no later than May 28, 2013.

In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

The Tribunal will issue a decision on June 5, 2013, on whether an expiry review is warranted. If the Tribunal decides that an expiry review is not warranted, the findings will expire on their scheduled expiry date. The Tribunal will issue its reasons no later than 15 days after its decision. If the Tribunal decides to initiate an expiry review, it will issue a notice of expiry review.
