Significant New Activity Notice

(Section 85 of the Canadian Environmental Protection Act, 1999)

Whereas the Minister of the Environment and the Minister of Health have assessed information in respect of the substance silane, triethoxy(3,3,4,4,5,5,6,6,7,7,8,8,8-tridecafluorooctyl)-, Chemical Abstracts Service Registry Number 51851-37-7, under section 83 of the Canadian Environmental Protection Act, 1999;

Whereas the Minister of the Environment published on January 28, 2006, Significant New Activity Notice No. 11489 in Part Ⅰ of the Canada Gazette, Vol. 140, No. 4;

Whereas the substance is not specified on the Domestic Substances List;

And whereas the ministers suspect that a significant new activity in relation to the substance may result in the substance becoming toxic within the meaning of section 64 of the Canadian Environmental Protection Act, 1999,

Therefore, the Minister of the Environment hereby varies Significant New Activity Notice No. 11489, pursuant to subsection 85(2) of the Canadian Environmental Protection Act, 1999, in accordance with the following Annex.

Information Requirements
(Section 85 of the Canadian Environmental Protection Act, 1999)

  1. In relation to the substance silane, triethoxy (3,3,4,4,5,5,6,6,7,7,8,8,8-tridecafluorooctyl)-, a significant new activity is the use of the substance in Canada, in any quantity, other than its use as an industrial or commercial surface modification agent or as an industrial or commercial adhesion promoter between inorganic materials and fluoropolymers.
  2. Despite item 1, the use of the substance as a research and development substance, a site-limited intermediate substance or a contained substance as these expressions are defined in subsection 1(1) of the New Substances Notification Regulations (Chemicals and Polymers), is not a new activity.
  3. The following information must be provided to the Minister, at least 90 days before the commencement of each proposed significant new activity:
    • (a) a description of the proposed significant new activity in relation to the substance;
    • (b) the information specified in Schedule 4 to the New Substances Notification Regulations (Chemicals and Polymers);
    • (c) the information specified in item 8 of Schedule 5 to those Regulations;
    • (d) the information specified in item 11 of Schedule 6 to those Regulations;
    • (e) the anticipated annual quantity of the substance to be used in relation to the significant new activity;
    • (f) the identification of every government department or government agency, either outside or within Canada, to which the person proposing the significant new activity has provided information regarding the use of the substance and if known, the department’s or agency’s file number and if any, the outcome of the department’s or agency’s assessment and risk management actions in relation to the substance imposed by the department or agency;
    • (g) if known, the three sites in Canada where the greatest quantity of the substance, in relation to the significant new activity, is anticipated to be used or processed and the estimated quantity by site;
    • (h) the test data and a test report from a 28-day repeated dose inhalation toxicity study in respect of the substance, conducted according to the methodology described in the Organisation for Economic Co-operation and Development (OECD) Test Guideline No. 412 titled Subchronic Inhalation Toxicity: 28-day Study, and in conformity with practices described in the OECD Principles of Good Laboratory Practice (“Principles of GLP”) set out in Annex 2 of the Decision of the Council Concerning the Mutual Acceptance of Data in the Assessment of Chemicals, adopted on May 12, 1981. Both the OECD Test Guideline and Principles of GLP must be current at the time of the test; and
    • (i) all other information or test data in respect of the substance that are in the possession of the person proposing the significant new activity, or to which they have access, and that are relevant to determining whether the substance is toxic or capable of becoming toxic.
  4. The above information will be assessed within 90 days after the day on which it is received by the Minister.

EXPLANATORY NOTE

(This explanatory note is not part of the Significant New Activity Notice.)

A Significant New Activity Notice is a legal instrument issued by the Minister of the Environment pursuant to section 85 of the Canadian Environmental Protection Act, 1999. The Significant New Activity Notice sets out the appropriate information that must be provided to the Minister for assessment prior to the commencement of a new activity as described in the Notice.

Substances that are not listed on the Domestic Substances List can be manufactured or imported only by the person who has met the requirements set out in section 81 of the Canadian Environmental Protection Act, 1999. Under section 86 of the Canadian Environmental Protection Act, 1999, in circumstances where a Significant New Activity Notice is issued for a new substance, it is the responsibility of every person who transfers the physical possession or control of the substance to notify all persons to whom the possession or control is transferred of the obligation to comply with the Significant New Activity Notice and of the obligation to notify the Minister of the Environment of any new activity and all other information as described in the Notice. It is the responsibility of the users of the substance to be aware of and comply with the Significant New Activity Notice and to submit a Significant New Activity notification to the Minister prior to the commencement of a significant new activity associated with the substance. However, as mentioned in subsection 81(6) of the Canadian Environmental Protection Act, 1999, a Significant New Activity notification is not required when the proposed new activity is regulated under an act or regulations listed on Schedule 2 to the Canadian Environmental Protection Act, 1999.

A Significant New Activity Notice does not constitute an endorsement from Environment Canada or the Government of Canada of the substance to which it relates, or an exemption from any other laws or regulations that are in force in Canada and that may apply to this substance or activities involving the substance.

Rescinding Significant New Activity Notice

(Section 85 of the Canadian Environmental Protection Act, 1999)

Whereas the Minister of the Environment has previously imposed Significant New Activity Notice No. 15441 pertaining to the substance 2-Propenoic acid, 2-methyl-, methyl ester, polymer with hydrolyzed poly(vinyl acetate) and polyfluorooctyl acrylate, on April 18, 2009;

Whereas the Minister of the Environment and the Minister of Health have assessed additional information pertaining to the substance;

And whereas the ministers no longer suspect that a significant new activity in relation to the substance may result in the substance becoming toxic within the meaning of section 64 of the Canadian Environmental Protection Act, 1999,

Therefore, the Minister of the Environment hereby indicates pursuant to subsection 85(2) that subsection 81(4) of the Canadian Environmental Protection Act, 1999 no longer applies to the substance and rescinds Significant New Activity Notice No. 15441.

Whereas the Minister of the Environment has previously imposed Significant New Activity Notice No. 16138 pertaining to the substance 2-Propenoic acid, 2-methyl-, 3,3,4,4,5,5,6,6,7,7,8,8,8-tridecafluorooctyl ester, polymer with 1,1-dichloroethene and alkyl 2-propenoate, on December 25, 2010;

Whereas the Minister of the Environment and the Minister of Health have assessed additional information pertaining to the substance;

And whereas the ministers no longer suspect that a significant new activity in relation to the substance may result in the substance becoming toxic within the meaning of section 64 of the Canadian Environmental Protection Act, 1999,

Therefore, the Minister of the Environment hereby indicates pursuant to subsection 85(2) that subsection 81(4) of the Canadian Environmental Protection Act, 1999 no longer applies to the substance and rescinds Significant New Activity Notice No. 16138.

HAZARDOUS MATERIALS INFORMATION REVIEW ACT

Decisions, undertakings and orders on claims for exemption

Pursuant to paragraph 18(1)(a) of the Hazardous Materials Information Review Act, the Chief Screening Officer of the Workplace Hazardous Materials Directorate hereby gives notice of the decisions of the screening officer, respecting each claim for exemption and the relevant material safety data sheet (MSDS) and (where applicable) the label, listed below.

In accordance with section 20 of the Hazardous Materials Information Review Act, a claimant or any affected party may appeal a decision or order of a screening officer. An affected party may also appeal an undertaking in respect of which a notice has been published in the Canada Gazette. “Affected party” means a person who is not a competitor of the claimant and who uses, supplies or is otherwise involved in the use or supply of the controlled product at a work place, and includes

  • (a) a supplier of the controlled product;
  • (b) an employee at the work place;
  • (c) an employer at the work place;
  • (d) a safety and health professional for the work place;
  • (e) a safety and health representative or a member of a safety and health committee for the work place; and
  • (f) a person who is authorized in writing to represent
    • (i) a supplier referred to in paragraph (a) or an employer referred to in paragraph (c), or
    • (ii) an employee referred to in paragraph (b), except where that person is an official or a representative of a trade union that is not certified or recognized in respect of the work place.

To initiate the appeal process, a Statement of Appeal (Form 1) as prescribed by the Hazardous Materials Information Review Act Appeal Board Procedures Regulations must be completed and delivered, along with the fee prescribed by section 12 of the Hazardous Materials Information Review Regulations, within 45 days of the publication of this notice in the Canada Gazette, Part Ⅰ, to the Chief Appeals Officer at the following address: Workplace Hazardous Materials Directorate, 427 Laurier Avenue W, 7th Floor, Ottawa, Ontario K1A 0K9.

There were no written representations from affected parties to the screening officer with respect to any of the above-mentioned claims for exemption and related MSDSs or labels.

Each of the claims for exemption listed above was found to be valid. The screening officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations.

Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that the MSDSs in respect of the claims bearing Registry Numbers 8336, 8339, 8387, 8388, 8389, 8390, 8391, 8392, 8431, 8432, 8433, 8434, 8435, 8437, 8438, 8499, 8504, 8533, 8538, 8542, 8543, 8577 and 8625 complied with the applicable requirements of the Hazardous Products Act and the Controlled Products Regulations.

In the case of the claims bearing Registry Numbers 8251 and 8253, being claims from an employer with operations in the province of Alberta, the screening officer found that the MSDSs and labels in respect of which the claims were filed did not comply with the applicable disclosure requirements of the Occupational Health and Safety Code 2009 of the Province of Alberta.

In the case of the claims bearing Registry Numbers 8424 and 8425, being claims from an employer with operations in the province of Ontario, the screening officer found that the MSDSs in respect of which the claims were filed did not comply with the applicable disclosure requirements of the Occupational Health and Safety Act of the Province of Ontario.

In all cases where the MSDS or the label was determined not to be in compliance with the relevant legislation, the screening officer offered the claimant the possibility of entering into an undertaking whereby the claimant would voluntarily make the changes necessary to bring the MSDS or the label into compliance. Pursuant to subsection 16.1(1) of the Hazardous Materials Information Review Act, the claimant was given 30 days to provide the screening officer with a signed undertaking accompanied by the MSDS or the label amended as necessary.

In the case of the following claims, the claimant supplied the screening officer with a signed undertaking accompanied by the MSDS or label amended as necessary within the time frame specified. The screening officer was satisfied that the claimant had taken the measures set out in the undertaking in the manner and within the period specified therein.

CLAIMS FOR WHICH THE SCREENING OFFICER WAS SATISFIED THAT THE CLAIMANT HAD TAKEN THE MEASURES SET OUT IN THE UNDERTAKING

Pursuant to paragraph 18(1)(b) of the Hazardous Materials Information Review Act, the Chief Screening Officer of the Workplace Hazardous Materials Directorate hereby gives notice of any information that has been disclosed on the relevant MSDS or label in compliance with an undertaking.

Registry Number 8073

Date of notice confirming acceptance: December 17, 2012

The claimant had been advised to amend certain aspects of the content of the MSDS. The claimant had been further advised to amend the MSDS as indicated below.

  1. In relation to the first aid information shown on the MSDS for eye and skin contact, disclose a statement to the effect that the eyes and skin should be washed with gently flowing water for at least 60 minutes.

  2. Disclose an LD50 (oral, male rat) value of 273 mg/kg for the hazardous ingredient “potassium hydroxide”.

  3. Disclose an LD50 (oral, rat) value of 5 119 mg/kg for the hazardous ingredient “dipropylene glycol monomethyl ether”.

  4. Disclose an LD50 (dermal, rabbit) value of 9 480 mg/kg for the hazardous ingredient “dipropylene glycol monomethyl ether”.

  5. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1B.

Registry Number 8100

Date of notice confirming acceptance: March 12, 2013

The claimant had been advised to amend certain aspects of the content, format and wording of the MSDS. The claimant had been further advised to amend the MSDS as indicated below.

  1. Disclose the chemical identity of an additional hazardous ingredient “ethanol”, in the controlled product, together with its CAS registry number, in an acceptable manner.
  2. Disclose the ACGIH TLV–TWA Exposure Limit for the confidential hazardous ingredient “aldehyde” and show that “aldehyde” has been classified as a suspected human carcinogen (A2) by the American Conference of Governmental Industrial Hygienists (ACGIH).
  3. In relation to the first aid information shown on the MSDS for eye contact, disclose a statement to the effect that the eyes should be rinsed continuously with gently flowing water for at least 30 minutes while holding the eyelids open.
  4. In relation to the first aid information shown on the MSDS for ingestion, disclose a statement to the effect that trained personnel should immediately administer artificial respiration or cardiopulmonary resuscitation if breathing has stopped or the heart has stopped.
  5. Disclose a statement to the effect that metal containers should be grounded during the transfer of large quantities of the controlled product; avoid or eliminate ignition sources when working with the controlled product and store the product away from ignition sources and heat, and that if ventilation is inadequate, vapours can spread from open containers of the product and may flash back, causing a fire if they contact an ignition source.
  6. Disclose an LD50 (dermal, rabbit) value of 2.03 mL/kg for the confidential hazardous ingredient “alcohol 2”.
  7. Disclose an LC50 (vapour, rat, 0.5 hours) value of 1 mg/L for the confidential hazardous ingredient “aldedyde”.
  8. Disclose that acute oral exposure to the hazardous ingredient “ethanol” in the controlled product has been shown to cause central nervous system (CNS) effects in humans.
  9. Disclose that acute oral exposure to the hazardous ingredients “ethanol” and “aldehyde” in the controlled product has been shown to cause adverse effects of the digestive system in laboratory animals.
  10. Disclose that acute inhalation of the confidential hazardous ingredient “aldehyde” in the controlled product has been shown to cause nasal cavity effects in laboratory animals.
  11. Disclose that chronic ingestion of the hazardous ingredient “ethanol” in the controlled product has been shown to cause adverse sperm, liver and heart effects in laboratory animals.

  5. Disclose an LD50 (oral, rat) value of 10.5 g/kg for the hazardous ingredient “9,12-octadecadienamide, N,N-bis(2-hydroxyethyl)-”.
  6. Disclose an ACGIH TLV–TWA Exposure Limit of 1 mg/m3 (skin) for the hazardous ingredient “diethanolamine”.
  7. Disclose that an ingredient in the controlled product has been classified Group 2B by the International Agency for Research on Cancer (IARC).
  8. Disclose that an ingredient in the controlled product has been shown to cause mutagenic effects in mammalian cells, in the presence of metabolic activation, in vitro.
  9. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D2A.

  6. Disclose that ingestion of and dermal exposure to an ingredient in the controlled product have been shown to cause central nervous system (CNS) effects in laboratory animals.
  7. Disclose that dermal exposure of an ingredient in the controlled product has been shown to cause kidney effects.
