Certain unitized wall modules — Decisions
On October 10, 2013, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping and a final determination of subsidizing, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), in respect of unitized wall modules, with or without infill, including fully assembled frames, with or without fasteners, trims, cover caps, window operators, gaskets, load transfer bars, sunshades and anchor assemblies; excluding non-unitized building envelope systems such as stick systems and point-fixing systems originating in or exported from the People’s Republic of China.
Since January 1, 2012, the goods in question are usually classified under the following Harmonized System classification numbers (HS codes):
- 7610.10.00.20
- 7610.90.10.90
- 7610.90.90.90
Certain importers may also be classifying the goods subject to the product definition under the following HS codes:
- 7008.00.00.00
- 7308.30.00.21
- 7610.10.00.10
- 7610.90.90.30
The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make an order or finding by November 12, 2013. Provisional duties will continue to apply until this date.
If the Tribunal finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping and/or countervailing duty equal to the amount of subsidy on the goods. In that event, the importer in Canada shall pay all such duties. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

Notice is hereby given that, on August 20, 2013, further to the issuance by the President of the Canada Border Services Agency of final determinations dated July 22, 2013, that cold-drawn carbon or alloy steel wire, of solid cross section with an actual diameter of 1.082 mm (0.0426 inch) to 12.5 mm (0.492 inch), plated or coated with zinc or zinc alloy, whether or not coated with plastic, excluding flat wire, originating in or exported from the People’s Republic of China, the State of Israel and the Kingdom of Spain, had been dumped and subsidized, and pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal found that the dumping and subsidizing of the aforementioned goods (Inquiry No. NQ-2013-001) had not caused injury or retardation and were not threatening to cause injury.

Notice requesting comments on amending the National Parks of Canada Wilderness Area Declaration Regulations
Notice is hereby given that Parks Canada is proposing to amend the National Parks of Canada Wilderness Area Declaration Regulations (the Regulations) which are made pursuant to the Canada National Parks Act (Act). The proposed amendments would permanently remove the Whistlers Creek bed area and surrounding up-slopes from the Marmot Basin Ski Area (Ski Area) leasehold in Jasper National Park of Canada, and add them to the existing declared wilderness area, thereby enhancing the protection of this ecologically important area. In exchange, a smaller area contiguous to the current leasehold below the Rock Gardens area in Jasper National Park of Canada would be removed from the existing declared wilderness area and would be made available to the Ski Area operator to develop beginner ski terrain and cross-country ski trails. Parks Canada is soliciting written comments from all interested parties on the proposed amendments.
Summary
Parks Canada is proposing to amend the Regulations by adding the Whistlers Creek bed area and surrounding up-slopes as declared wilderness to the Schedule to the Regulations; and by removing the lands below the Rock Gardens area in Jasper National Park of Canada as declared wilderness from the Schedule to the Regulations. This results in a net gain of ecologically sensitive land that would be protected as a declared wilderness area.
This Notice of Intent explains, in general terms, the proposed amendments currently being considered by Parks Canada and requests input on those amendments.
Background
Public concerns about development and use of ski areas in the mountain national parks and the related impact on ecological integrity led to the completion of the Ski Area Management Guidelines in 2000, their update in 2006, and corresponding direction in national park management plans, including the 2010 Jasper National Park management plan. Parks Canada’s primary goal for the management of ski areas, as outlined in the Ski Area Management Guidelines, is to achieve long-term land use certainty that
- ensures ecological integrity will be maintained or restored;
- contributes to facilitating memorable national park visitor experiences and learning opportunities; and
- provides ski area operators with clear parameters for business planning in support of an economically healthy operation.
In 2008, the Marmot Basin Ski Area Site Guidelines for Development and Use (Site Guidelines) were approved following public consultation. They identify permanent, negotiated caps for the amount of development, a range of potential initiatives that would enhance the skiing experience in a national park along with parameters and conditions to ensure development and use do not compromise the ecological health of the national park.
The Regulations first came into force in 2000 to declare wilderness areas within Banff, Jasper, Kootenay and Yoho National Parks of Canada. The Regulations were then amended in 2009 to declare wilderness areas within Waterton, Fundy and Vuntut National Parks of Canada as well as within Nahanni National Park Reserve of Canada.
Wilderness area declarations are a legislative tool; they provide Canadians with assurance that facilities and activities that are inconsistent with the wilderness character of a national park or national park reserve of Canada will be prohibited. Where a region of a national park or national park reserve of Canada is declared a wilderness area by regulation, the activities that can take place in the area are restricted to the following: activities related to park administration, public safety, the provision of basic user facilities including trails and rudimentary campsites, the carrying on of traditional renewable resource harvesting activities authorized under the Act, and access by air to remote wilderness areas where there is no other means of access. The declared wilderness areas are identified by referencing administrative map plan numbers deposited in the archives of Natural Resources Canada. The administrative map plans for those national parks and the national park reserve listed in the Schedule to the Regulations may be consulted on the Natural Resources Canada Web site (www.nrcan.gc.ca), at the National Office of Parks Canada in Gatineau, Quebec, and at the office of the superintendent of the seven national parks and the national park reserve with declared wilderness areas.
The declared wilderness area boundaries listed in the Schedule to the Regulations for the Marmot Basin area in Jasper National Park of Canada were established based on the existing Ski Area leasehold. These leasehold boundaries were established in 1986 based on a review of potential ski terrain suitable at that time and existing environmental information. Since then, Parks Canada’s understanding of the ecological values, ecosystems and the relationship to human activities has significantly increased through both park specific research and broader general research applicable to the national park (e.g. Southern Mountain population of Woodland Caribou has been listed as threatened under the Species at Risk Act since 2002). The reconfiguration of the Ski Area leasehold boundaries and the proposed amendments to the Schedule to the Regulations would provide enhanced protection to sensitive wildlife species, while supporting the continued operation of the Ski Area. Furthermore, it would support implementation of the approved 2010 Jasper National Park of Canada management plan and the Site Guidelines.
Amendments being considered
The proposed amendments to the Regulations would make an adjustment in the location of declared wilderness adjacent to the Ski Area leasehold in Jasper National Park of Canada. It would add the Whistlers Creek bed area and surrounding up-slopes as declared wilderness to the Schedule to the Regulations to better protect valuable food sources and movement routes for the Southern Mountain population of Woodland Caribou (a species at risk). This area also contains an important mineral lick for mountain goats, which is also used by other species including grizzly bears, wolverines and lynxes. In partial exchange for the voluntary removal of this area from the Ski Area leasehold, a smaller parcel of land currently included as declared wilderness in the Schedule to the Regulations would be removed from the Regulations and made available to the Ski Area for potential activities in support of the Ski Area operations. The lands to be removed from declared wilderness under the Schedule to the Regulations, known as the Rock Gardens area, are considered less ecologically sensitive than the Whistlers Creek bed area and surrounding up-slopes. Neither the Southern Mountain population of Woodland Caribou nor mountain goats use this area.
The reconfiguration of the declared wilderness boundaries in Jasper National Park of Canada listed in the Schedule to the Regulations would have the following benefits:
- the addition of the area removed from Ski Area leasehold to the existing declared wilderness area protects important habitat for caribou, an endangered species, and is a positive contribution to Parks Canada’s participation in current and future broad scale ecosystem management initiatives to better protect caribou;
- the Ski Area leasehold reduction and designation of the lands would protect broad ecological values for multiple species associated with the Whistlers Creek valley by ensuring quality habitat for other valued and sensitive species including grizzly bears, wolverines, and lynxes;
- Jasper, Banff, Kootenay and Yoho National Parks of Canada and three adjacent provincial parks in British Columbia make up the UNESCO Rocky Mountain World Heritage Site, reflecting the global community’s recognition of their outstanding universal value. The proposed amendments to the Schedule to the Regulations for Jasper National Park of Canada would provide additional protection of the Rocky Mountains Natural Region. Redefining the boundaries to include the sensitive habitat in the Whistlers Creek bed area and surrounding up-slopes would strengthen the protection of this area and reflects Parks Canada’s commitment to the world heritage site’s values; and
- completing the Ski Area leasehold reduction and amendments to the Schedule to the Regulations would assist the Ski Area to proceed with advancing projects in a long range plan to support their proposed improvements to services for park visitors.
The potential for limited development and use in the Rock Gardens area is provided for in the Site Guidelines and has been assessed in the strategic environmental assessment (SEA) carried out with respect to the Site Guidelines. Specific development proposals for the Rock Gardens area would be advanced through a long range plan and will be subject to the requirements of the Canadian Environmental Assessment Act. The SEA was also subject to peer review. This thorough and rigorous assessment concluded that “the proposed lease reduction will provide greater certainty that the Whistlers Creek bed area and surrounding up-slopes will remain undeveloped. As such, it will provide greater long-term protection of ecological integrity in the area than would be the case if the area remained in the lease, including enhanced protection of valuable caribou habitat and enhanced protection of an important goat mineral lick. This improved level of protection is considered a substantial environmental gain that will contribute meaningfully to Parks Canada’s objective of maintaining or improving ecological integrity in Jasper National Park. The environmental gains associated with Whistlers Creek also extend to other wildlife using the area including grizzly bear, wolverine, lynx and mountain goat.”
The Expansion and Conservation of the Canada’s National Parks Act (S.C. 2013, c. 28) received Royal Assent on June 19, 2013. This new legislation, among other things, amends Schedule 5 to the Act to reconfigure the leasehold boundary of the Marmot Basin Ski Area. The proposed amendments to the Regulations are the required next steps of the process to enhance the protection of the area removed from the leasehold boundary by adding it to an existing declared wilderness area in Jasper National Park.
Coming into force
The Expansion and Conservation of the Canada’s National Parks Act (S.C. 2013, c. 28) will come into force on a date to be fixed by Order in Council. The coming into force of the proposed amendments to the Regulations will be timed to coincide with the coming into force of the amendments to Schedule 5 to the Act.
