Certain silicon metal — Decisions
On October 21, 2013, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping and a final determination of subsidizing, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), in respect of silicon metal containing at least 96.00% but less than 99.99% silicon by weight, and silicon metal containing between 89.00% and 96.00% silicon by weight that contains aluminum greater than 0.20% by weight, of all forms and sizes, originating in or exported from the People’s Republic of China.
The goods in question are usually classified under the following Harmonized System classification number: 2804.69.00.00.
The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make an order or finding by November 19, 2013. Provisional duties will continue to apply until this date.
If the Tribunal finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping and/or countervailing duty equal to the amount of subsidy on the goods. In that event, the importer in Canada shall pay all such duties. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File Nos. PR-2013-005 and PR-2013-008) on October 23, 2013, with respect to complaints filed by Raymond Chabot Grant Thornton Consulting Inc. (RCGT) and PricewaterhouseCoopers LLP (PwC), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C. 1985 (4th Supp.), c. 47, concerning a procurement (Solicitation No. A0015-12-0040/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Aboriginal Affairs and Northern Development. The solicitation was for forensic audit and investigation services.
RCGT and PwC alleged that PWGSC improperly evaluated their proposals.
Having examined the evidence presented by the parties, the Tribunal determined that the complaints were not valid.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2013-018) from Tiree Facility Solutions Inc. (Tiree), of Ottawa, Ontario, concerning a procurement (Solicitation No. NCR1007) by Defence Construction Canada (DCC). The solicitation is for the provision of professional services specific to the Canadian Forces Housing Agency project, located in Edmonton, Cold Lake and Wainwright, Alberta. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal has decided to conduct an inquiry into the complaint.
Tiree alleges that DCC did not evaluate its bid in accordance with the evaluation criteria contained in the Request for Abbreviated Proposals.
