SPECIAL IMPORT MEASURES ACT

Certain copper tube — Decisions

On November 18, 2013, the President of the Canada Border Services Agency (CBSA) made a final determination of dumping, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), in respect of certain copper tube originating in or exported from the Federative Republic of Brazil, the Hellenic Republic (Greece), the People’s Republic of China, the Republic of Korea and the United Mexican States and made a final determination of subsidizing in respect of the above-mentioned goods originating in or exported from the People’s Republic of China.

The subject goods are usually classified under the following Harmonized System classification numbers:

7411.10.00.10

7411.10.00.20

The subject goods may also be classified under the following Harmonized System classification numbers:

7411.10.00.31

7411.10.00.39

The Canadian International Trade Tribunal (Tribunal) is continuing its inquiry into the question of injury to the domestic industry and will make a finding by December 18, 2013. Provisional duties will continue to apply until this date on imports of subject goods from these five countries.

If the Tribunal finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, future imports of subject goods will be subject to anti-dumping duty equal to the margin of dumping and/or countervailing duty equal to the amount of subsidy on the goods. In that event, the importer in Canada shall pay all such duties. The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duty.

Notice is hereby given that the Canadian International Trade Tribunal (the Tribunal) issued an order on November 19, 2013, with respect to a complaint (File No. PR-2013-018) filed by Tiree Facility Solutions Inc., of Ottawa, Ontario, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. NCR1007) by Defence Construction Canada. The solicitation was for the provision of professional services specific to the Canadian Forces Housing Agency project, located in Edmonton, Cold Lake and Wainwright, Alberta.

Having examined the evidence presented by the parties, the Tribunal found that it did not have jurisdiction to continue its inquiry and, consequently, dismissed the complaint.

FINDING

Silicon metal

Notice is hereby given that, on November 19, 2013, further to the issuance by the President of the Canada Border Services Agency of final determinations dated October 21, 2013, that silicon metal containing at least 96.00% but less than 99.99% silicon by weight, and silicon metal containing between 89.00% and 96.00% silicon by weight that contains aluminum greater than 0.20% by weight, of all forms and sizes, originating in or exported from the People’s Republic of China has been dumped and subsidized, and pursuant to subsection 43(1) of the Special Import Measures Act, the Canadian International Trade Tribunal found that the dumping and subsidizing of the aforementioned goods (Inquiry No. NQ-2013-003) had not caused injury but were threatening to cause injury to the domestic industry.
