EDP hardware and software
The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2014-019) from Oracle Canada ULC (Oracle Canada), of Ottawa, Ontario, concerning a procurement (Solicitation No. EN578-130092/B) by the Department of Public Works and Government Services (PWGSC). The solicitation is for the provision of common and shared case management software solutions within the federal government. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on July 15, 2014, to conduct an inquiry into the complaint.
Oracle Canada alleges that PWGSC issued a contract for a product that was not initially bid for by the contract awardee and, as a result, awarded a contract to a bidder whose product did not conform to the mandatory requirements of the request for proposal. Oracle Canada also alleges that PWGSC conducted an illegal sole-source procurement by requesting services which ought to have been the subject of a new and separate solicitation.
