Notice with respect to certain nanomaterials in Canadian commerce

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether the substances described in Schedule 1 to this notice are toxic or are capable of becoming toxic, or for the purpose of assessing whether to control, or the manner in which to control the listed substances, any person described in Schedule 2 to this notice who possesses or who may reasonably be expected to have access to the information required in Schedule 3 to this notice to provide that information no later than February 23, 2016, 5 p.m., Eastern Standard Time.

Responses to this notice shall be submitted to the Minister of the Environment, to the attention of the Substances Management Coordinator, Chemicals Management Plan, Gatineau, Quebec K1A 0H3. Inquiries concerning the notice may be directed to the Substances Management Coordinator at the above-mentioned address or at 1-800-567-1999 (toll-free in Canada), 819-938- 3232 (outside of Canada) [telephone], 819-938-3231 (fax), or substances@ec.gc.ca (email).

Pursuant to section 313 of the Act, any person who provides information in response to this notice may submit a written request that the information or part of it be treated as confidential.

Pursuant to subsection 71(4) of the Act, the Minister of the Environment may, on request in writing from any person to whom this notice applies, extend the time or times within which the person shall comply with this notice. The person seeking such extension shall submit, prior to the deadline, a request in writing to the Minister of the Environment, to the attention of the Substances Management Coordinator, Gatineau, Quebec K1A 0H3 or at 819-938-3231 (fax), or substances@ec.gc.ca (email).

SCHEDULE 2

Persons Required to Provide Information

  1. This notice applies to any person who, during the 2014 calendar year, manufactured a total quantity greater than 100 kg of a substance set out in Schedule 1 to this notice.
  2. This notice applies to any person who, during the 2014 calendar year, imported a total quantity greater than 100 kg of a substance set out in Schedule 1 to this notice, at any concentration, whether alone, in a mixture or in a product.
  3. This notice does not apply to a substance in Schedule 1, whether alone, in a mixture or in a product, that
    • (a) is in transit through Canada;
    • (b) is naturally occurring;
    • (c) is incidentally produced;
    • (d) is, or is contained in, a hazardous waste or hazardous recyclable material within the meaning of the Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations and that was imported in 2014 pursuant to a permit issued under those Regulations;
    • (e) is, or is contained in, a pest control product within the meaning of subsection 2(1) of the Pest Control Products Act where that pest control product is registered under the Pest Control Products Act;
    • (f) is, or is contained in, a fertilizer or supplement within the meaning of section 2 of the Fertilizers Act where that fertilizer or supplement is registered under the Fertilizers Act;
    • (g) is, or is contained in, a feed within the meaning of section 2 of the Feeds Act where that feed is registered under the Feeds Act; or
    • (h) is mixed with, or attached to, a seed within the meaning of section 2 of the Seeds Act where that seed is registered under the Seeds Act.

SCHEDULE 3

Information Required

1. The definitions in this section apply in this notice.

“manufacture” means to produce or to prepare a substance.

“manufactured item” means an item that is formed into a specific physical shape or design during manufacture and has, for its final use, a function or functions dependent in whole or in part on its shape or design.

“mixture” means a combination of substances that does not produce a substance that is different from the substances that were combined, including a prepared formulation, hydrate and reaction mixture that are characterized in terms of their constituents.

“naturally occurring” means a substance that occurs in nature and has not been processed.

“nanoscale” means a size range from 1 to 100 nanometres, inclusive, in any one external dimension, or internal or surface structure.

“product” excludes “mixture” and “manufactured item”.

2. (1) If the person subject to the notice is a company that owns more than one facility, a single response to the notice shall be submitted. The single response shall amalgamate the information from all facilities owned by the company for each applicable question in the notice.

2. (2) If the person is engaged with a substance in both nanoscale and non-nanoscale form, their response must be based on activities with the substance, taking into account the criteria set out in Schedule 1 to this notice.

3. Where information required under Schedule 3 to this notice has already been submitted to the Minister of the Environment or to the Minister of Health, it may be relied on as a response to any question in Schedule 3 to this notice if

U008 Dyes Substances used to impart colour to other materials or mixtures by penetrating into the surface of the substrate.
U009 Fillers Substances used to provide bulk, increase strength, increase hardness, or improve resistance to impact.
U010 Finishing agents Substances used to impart such functions as softening, static-proofing, wrinkle resistance, and water repellence.
U011 Flame retardants Substances used on the surface of or incorporated into combustible materials to reduce or eliminate their tendency to ignite when exposed to heat or a flame.
U012 Fuels and fuel additives Substances used to create mechanical or thermal energy through chemical reactions, or which are added to a fuel for the purpose of controlling the rate of reaction or limiting the production of undesirable combustion products, or which provide other benefits such as corrosion inhibition, lubrication, or detergency.
U013 Functional fluids (closed systems) Liquid or gaseous substances used for one or more operational properties in a closed system. This code does not include fluids used as lubricants.
U014 Functional fluids (open systems) Liquid or gaseous substances used for one or more operational properties in an open system.
U015 Intermediates Substances consumed in a reaction to produce other substances for commercial advantage.
U016 Ion exchange agents Substances that are used to selectively remove targeted ions from a solution. This code also includes aluminosilicate zeolites.
U017 Lubricants and lubricant additives Substances used to reduce friction, heat, or wear between moving parts or adjacent solid surfaces, or that enhance the lubricity of other substances.
U018 Odour agents Substances used to control odours, remove odours, mask odours, or impart odours.
U019 Oxidizing or reducing agents Substances used to alter the valence state of another substance by donating or accepting electrons or by the addition or removal of hydrogen to a substance.
U020 Photosensitive substances Substances used for their ability to alter their physical or chemical structure through absorption of light, resulting in the emission of light, dissociation, discoloration, or other chemical reaction.
U021 Pigments Substances used to impart colour to other materials or mixtures by attaching themselves to the surface of the substrate through binding or adhesion.
U022 Plasticizers Substances used in plastics, cement, concrete, wallboard, clay bodies, or other materials to increase their plasticity or fluidity.
U023 Plating agents and surface treating agents Substances applied to metal, plastic, or other surfaces to alter physical or chemical properties of the surface.
U024 Process regulators Substances used to change the rate of a reaction, start or stop the reaction, or otherwise influence the course of the reaction.

EXPLANATORY NOTE

Nanotechnology is a rapidly emerging field with the potential for use in a wide variety of applications across a broad range of sectors. Nanomaterials are substances that are manufactured at the nanoscale (1 to 100 nanometres, inclusive), or have internal or surface structures in the nanoscale. Some nanomaterials exhibit unique properties that may give rise to new exposure and effects that need to be assessed for their potential risk to human health and the environment. Presently, as is the case for chemicals and living organisms, nanomaterials that are not listed on the Domestic Substances List (DSL) are subject to the New Substances Notification Regulations (Chemicals and Polymers) under the Canadian Environmental Protection Act, 1999 (CEPA 1999). Nanoscale forms of substances listed on the DSL are considered existing nanomaterials and generally have not been considered in risk assessments conducted under CEPA 1999. Environment Canada and Health Canada want to ensure that nanomaterials currently in commerce in Canada are addressed, as some may require further action to determine if they pose any potential risks to the environment or to human health. This approach is similar to the one used with chemicals and living organisms.

The Notice with respect to certain nanomaterials in Canadian commerce applies to 206 substances. The information collected from this notice will support the development of a list of nanomaterials in commerce in Canada and subsequent prioritization activities for these substances, which may include risk assessment and risk management activities.

Pursuant to subsection 71(3) of the Canadian Environmental Protection Act, 1999 (hereinafter referred to as the “Act”), every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The deadline specified in this notice is February 23, 2016, 5 p.m., Eastern Standard Time.

Persons not subject to this notice who have a current or future interest in a substance set out in Schedule 1 to this notice may identify themselves as a “stakeholder” for the substance by completing the voluntary Declaration of Stakeholder Interest using the online reporting system via Environment Canada's Single Window. The person may be contacted for further information regarding their interest in these substances. The online reporting system is available from the Chemical Substances Web site at www.chemicalsubstanceschimiques.gc.ca.

Persons who do not meet the requirements to respond and have no commercial interest in the substances covered by this notice may submit a Declaration of Non-Engagement for the notice using the online reporting system via Environment Canada's Single Window. The online reporting system is available from the Chemical Substances Web site at www.chemicalsubstanceschimiques.gc.ca.

The Minister of the Environment and the Minister of Health are also inviting interested stakeholders to submit additional information that is deemed beneficial. Organizations that may be interested in submitting additional information in response to this invitation include those that manufacture, import, export or use these substances whether alone, in a mixture, in a product or in a manufactured item.

Compliance with the Act is mandatory pursuant to subsections 272(1) and 272.1(1) of the Act. Amendments to the fine scheme of the Act came into force on June 20, 2012. Subsections 272(2), (3) and (4) and 272.1(2), (3) and (4) of the Act set the penalties for persons who commit an offence under the Act. Offences include failing to comply with an obligation arising from the Act and providing false or misleading information. Penalties for offences can result, upon conviction (either summary conviction or indictment), of fines of not more than $12 million, imprisonment for a term of not more than three years, or both.

Notice with respect to certain polymers on the Domestic Substances List

Pursuant to paragraph 71(1)(b) of the Canadian Environmental Protection Act, 1999, notice is hereby given that the Minister of the Environment requires, for the purpose of assessing whether the substances described in Schedule 1 to this notice are toxic or are capable of becoming toxic, or for the purpose of assessing whether to control, or the manner in which to control the listed substances, any person described in Schedule 2 to this notice who possesses or who may reasonably be expected to have access to the information required in Schedule 3 to this notice to provide that information no later than December 3, 2015, 5 p.m., Eastern Standard Time.

Responses to this notice shall be submitted to the Minister of the Environment, to the attention of the Substances Management Coordinator, Chemicals Management Plan, Gatineau, Quebec K1A 0H3. 1. This notice applies to any person who, during the 2014 calendar year, manufactured a total quantity greater than 1 000 kg of a substance listed in Part 1 or greater than 100 kg of a substance listed in Part 2 of Schedule 1 to this notice.

Information Required

1. The definitions in this section apply in this notice.

“manufacture” includes the incidental production of a substance.

“manufactured item” means an item that is formed into a specific physical shape or design during manufacture and has, for its final use, a function or functions dependent in whole or in part on its shape or design.

“mixture” means a combination of substances that does not produce a substance that is different from the substances that were combined, including a prepared formulation, hydrate, and reaction mixture that are characterized in terms of their constituents.

“product” excludes “mixture” and “manufactured item.”

“use” excludes the extrusion of polymer beads to manufacture a manufactured item.

2. If the person subject to the notice is a company that owns more than one facility, a single response to the notice shall be submitted. The single response shall amalgamate the information from all facilities owned by the company for each applicable question in the notice.

EXPLANATORY NOTE

As part of the Chemicals Management Plan (CMP), Environment Canada and Health Canada have committed to assessing and managing, where appropriate, the potential health and ecological risks of 603 polymer substances identified as priorities for action based on the categorization exercise completed in 2006. Polymers are a unique class of substances in which the same Chemical Abstracts Service registry number (CAS RN) can be used to describe substances that have different molecular weights, toxicity, and physical and chemical properties. Therefore, a tailored approach was developed to address the complexity of the polymers assessment.

Preliminary information was collected for the polymers through the second phase of the Domestic Substances List Inventory Update (DSL IU2) published in the Canada Gazette, Part I, Vol. 146, No. 48, on December 1, 2012. Information submitted in response to the DSL IU2 informed the Government of Canada as to whether a candidate substance was in commerce in Canada in a quantity above the reporting threshold of 1 000 kg in the 2011 calendar year.

The Notice with respect to certain polymers on the Domestic Substances List applies to polymers for which further information is required. The information collected from this notice will inform the risk assessment for these polymers.

Pursuant to subsection 71(3) of the Canadian Environmental Protection Act, 1999 (hereinafter referred to as the “Act”), every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The deadline specified in this notice is December 3, 2015, 5 p.m., Eastern Standard Time.

Persons not subject to this notice who have a current or future interest in a substance set out in Schedule 1 to this notice may identify themselves as a “stakeholder” for the substance by completing the voluntary Declaration of Stakeholder Interest using the online reporting system via Environment Canada's Single Window. The person may be contacted for further information regarding their interest in these substances. The online reporting system is available from the Chemical Substances Web site at www. chemicalsubstanceschimiques.gc.ca.

Persons who do not meet the requirements to respond and have no commercial interest in the substances covered by this notice may submit a Declaration of Non-Engagement for the notice using the online reporting system via Environment Canada's Single Window. The online reporting system is available from the Chemical Substances Web site at www.chemicalsubstanceschimiques.gc.ca.

The Minister of the Environment and the Minister of Health are also inviting interested stakeholders to submit additional information that is deemed beneficial. Organizations that may be interested in submitting additional information in response to this invitation include those that manufacture, import, export or use these substances whether alone, in a mixture, in a product or in a manufactured item.

Compliance with the Act is mandatory pursuant to subsections 272(1) and 272.1(1) of the Act. Amendments to the fine scheme of the Act came into force on June 20, 2012. Subsections 272(2), (3) and (4) and 272.1(2), (3) and (4) of the Act set the penalties for persons who commit an offence under the Act. Offences include failing to comply with an obligation arising from the Act and providing false or misleading information. Penalties for offences can result, upon conviction (either summary conviction or indictment), of fines of not more than $12 million, imprisonment for a term of not more than three years, or both.

Persons Required to Provide Information

  1. This notice applies to any person who, during the 2014 calendar year, imported a total quantity greater than 1 000 kg of a substance listed in Schedule 1 to this notice, at a concentration equal to or above 1% by weight (w/w%), whether alone, in a mixture or in a product.
  2. This notice applies to any person who, during the 2014 calendar year, used a total quantity greater than 1 000 kg of a substance listed in Schedule 1 to this notice, at a concentration equal to or above 1% by weight (w/w%), whether the substance is used alone or in a mixture, to formulate or blend into a mixture or product.
  3. This notice does not apply to the substance bearing CAS RN 64742-14-9 or CAS RN 68131-77-1 that is imported in a product intended to be used by consumers.
  4. This notice does not apply to a substance listed in Schedule 1, whether alone, in a mixture or in a product, that
    • (a) is in transit through Canada;
    • (b) is, or is contained in, a hazardous waste or hazardous recyclable material within the meaning of the Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations and that was imported in 2014 pursuant to a permit issued under those Regulations;
    • (c) is, or is contained in, a pest control product within the meaning of subsection 2(1) of the Pest Control Products Act where that pest control product is registered under the Pest Control Products Act;
    • (d) is, or is contained in, a fertilizer or supplement within the meaning of section 2 of the Fertilizers Act where that fertilizer or supplement is registered under the Fertilizers Act;
    • (e) is, or is contained in, a feed within the meaning of section 2 of the Feeds Act where that feed is registered under the Feeds Act;
    • (f) is mixed with, or attached to, a seed within the meaning of section 2 of the Seeds Act where that seed is registered under the Seeds Act;
    • (g) is imported by a petroleum refining facility, an upgrading facility or a natural gas processing facility for uses other than formulation or blending into a mixture or product;
    • (h) is a fuel or fuel additive or contained in a fuel or fuel additive;
    • (i) is imported within an internal combustion engine;
    • (j) is imported within a closed hydraulic system or closed functional fluid system; or
    • (k) is imported in engine oil, brake fluid, steering fluid or other functional fluids.
  5. If a person submitted information for a substance listed in Schedule 1 as part of the voluntary information-gathering phase under the Chemicals Management Plan conducted in 2015, a response from that person is not required under this notice for that substance.

SCHEDULE 3

Information Required

1. The definitions in this section apply in this notice.

“fuel additive” means a substance which is added to a fuel for the purpose of controlling the rate of reaction or limiting the production of undesirable combustion products, or which provides other benefits such as corrosion inhibition, lubrication, or detergency.

“manufactured item” means an item that is formed into a specific physical shape or design during manufacture and has, for its final use, a function or functions dependent in whole or in part on its shape or design.

“mixture” means a combination of substances that does not produce a substance that is different from the substances that were combined, including a prepared formulation, hydrate and reaction mixture that are characterized in terms of their constituents.

“natural gas processing” means the separation of crude natural gas into clean natural gas and other C2-C5 hydrocarbons.

“natural gas processing facility” means a facility that engages in natural gas processing.

“petroleum refining” means the refining of crude oil or bitumen diluted with a hydrocarbon into petroleum products, and includes storage and processes such as cogeneration, hydrogen generation and sulphur recovery, but excludes the production of synthetic crude oil.

“petroleum refining facility” means a facility that engages in petroleum refining.

“product” excludes “mixture” and “manufactured item.”

“upgrading” means the conversion of bitumen, blends of bitumen, heavy crude oil or blends of heavy crude oil to produce synthetic crude oil or petroleum products and synthetic crude oil.

“upgrading facility” means a facility that engages in upgrading.

2. If the person subject to the notice is a company who owns more than one facility, a single response to the notice shall be submitted. The single response shall amalgamate the information from all facilities owned by the company for each applicable question in the notice.

3. (1) For each substance listed in Schedule 1 that a person imported or used during the 2014 calendar year, for which the criteria set out in Schedule 2 have been met, the person shall provide the following information:

EXPLANATORY NOTE

There are approximately 210 remaining petroleum substances that have been identified as priorities to be assessed by 2020.

The Notice with respect to certain priority petroleum substances on the Domestic Substances List will gather qualitative information about the import and blending/formulation activities of a subset of the 210 remaining priority petroleum substances. This notice will support a triage activity based on exposure potential, as well as help to better identify stakeholders to target for further engagement.

Pursuant to subsection 71(3) of the Canadian Environmental Protection Act, 1999 (hereinafter referred to as the “Act”), every person to whom this notice applies is required to comply with this notice within the time specified in the notice. The deadline specified in this notice is October 20, 2015, 5 p.m., Eastern Daylight Time.

Persons not subject to this notice who have a current or future interest in a substance set out in Schedule 1 to this notice may identify themselves as a “stakeholder” for the substance by completing the voluntary Declaration of Stakeholder Interest using the online reporting system via Environment Canada's Single Window. The person may be contacted for further information regarding their interest in these substances. The online reporting system is available from the Chemical Substances Web site at www.chemicalsubstanceschimiques.gc.ca.

Persons who do not meet the requirements to respond and have no commercial interest in the substances covered by this notice may submit a Declaration of Non-Engagement for the notice using the online reporting system via Environment Canada's Single Window. The online reporting system is available from the Chemical Substances Web site at www.chemicalsubstanceschimiques.gc.ca.

The Minister of the Environment and the Minister of Health are also inviting interested stakeholders to submit additional information that is deemed beneficial. Organizations that may be interested in submitting additional information in response to this invitation include those that manufacture, import, export or use these substances whether alone, in a mixture, in a product or in a manufactured item.

Compliance with the Act is mandatory pursuant to subsections 272(1) and 272.1(1) of the Act. Amendments to the fine scheme of the Act came into force on June 20, 2012. Subsections 272(2), (3) and (4) and 272.1(2), (3) and (4) of the Act set the penalties for persons who commit an offence under the Act. Offences include failing to comply with an obligation arising from the Act and providing false or misleading information. Penalties for offences can result, upon conviction (either summary conviction or indictment), of fines of not more than $12 million, imprisonment for a term of not more than three years, or both.

Description of critical habitat of the Pacific Water Shrew in Widgeon Valley National Wildlife Area

The Pacific Water Shrew (Sorex bendirii) is a small mammal listed on Schedule 1 of the Species at Risk Act. In Canada, the Pacific Water Shrew is typically found in riparian areas in southwestern British Columbia.

The Recovery Strategy for the Pacific Water Shrew (Sorex bendirii) in Canada, available at www.sararegistry.gc.ca/species/speciesDetails_e.cfm?sid=141, identifies critical habitat for the species in a number of areas. A portion of this critical habitat is included in the Widgeon Valley National Wildlife Area, a federally protected area.

Notice is hereby given that, pursuant to subsection 58(2) of the Species at Risk Act, subsection 58(1) of that Act applies, 90 days after publication of this notice, to the critical habitat of the Pacific Water Shrew, as identified in the recovery strategy for that species that is included in the Species at Risk Public Registry, within the following federally protected area: Widgeon Valley National Wildlife Area, the boundaries of which are described in Schedule 1 of the Wildlife Area Regulations made pursuant to the Canada Wildlife Act.

Interested parties are invited to contact Environment Canada to request clarification regarding the location, biophysical attributes and protection of this species' critical habitat. However, some details may be withheld to protect the species and its critical habitat.

Notice to interested parties — Proposal regarding an order amending the schedules to the Controlled Drugs and Substances Act (CDSA) and regulations amending the regulations under the CDSA to exclude the salts of 14 substances that are currently excluded from the CDSA

This notice provides interested stakeholders with the opportunity to provide comments on Health Canada's proposal for the exclusion of the salts of the following 14 substances from the Controlled Drugs and Substances Act (CDSA) and its regulations: apomorphine, cyprenorphine, narcotine, papaverine, carbamethidine, oxpheneridine, ethoheptazine, metethoheptazine, metheptazine, dextromethorphan, dextrorphan, levallorphan, levargorphan, and cyclazocine.

The salts of these 14 substances are not captured within the current exclusions, which explicitly capture only the parent substances. Under this regulatory proposal, the scope of the exclusions for these 14 substances would be extended to include their salts.

The salts of these substances are used for a wide variety of purposes and do not pose a threat to public health or public safety. For most of these substances, the salt form is the most common commercially available form of the substance. Salt forms can often have improved chemical and physical stability (e.g. for storage and transport) and can be easier to process (e.g. forming a salt can turn a viscous oil into a free-flowing powder). They are thus used in lieu of the parent substance. The salts of these substances are contained in a variety of products currently sold in Canada (e.g. cough syrups commonly contain the salt of dextromethorphan).

The publication of this notice in the Canada Gazette, Part I, initiates a 30-day comment period. Pursuant to paragraph 18(1)(a) of the Hazardous Materials Information Review Act, the Chief Screening Officer hereby gives notice of the decisions of the screening officer respecting each claim for exemption and the relevant material safety data sheet (MSDS) and (where applicable) the label listed below.

In accordance with section 20 of the Hazardous Materials Information Review Act, a claimant or any affected party, as defined, may appeal a decision or order of a screening officer. An affected party may also appeal an undertaking in respect of which a notice has been published in the Canada Gazette. On February 11, 2015, the Hazardous Products Act (HPA) was amended, and the Controlled Products Regulations (CPR) and the Ingredient Disclosure List were repealed and replaced with the new Hazardous Products Regulations (HPR). The revised legislation (HPA/HPR) is referred to as WHMIS 2015 and the former legislation (HPA/CPR) is referred to as WHMIS 1988.

Transitional provisions allow compliance with either WHMIS 1988 or WHMIS 2015 for a specified period of time. All claims for exemption in this publication were filed and evaluated in accordance with the provisions of WHMIS 1988.

There were no written representations from affected parties with respect to any of the claims for exemption and related MSDSs or labels mentioned below.

Each of the claims for exemption listed in the table below was found to be valid except for those for Registry Numbers (RNs) 9010, 9011, 9109, 9194, 9258 and 9266, which were found to be partially valid, and RN 9253, which was found to be invalid. The screening officer reached this decision after reviewing the information in support of the claim, having regard exclusively to the criteria found in section 3 of the Hazardous Materials Information Review Regulations.

Having regard for the various data readily available in the literature and any information provided by the claimant, the screening officer found that only the respective MSDSs in respect of the claims bearing RNs 9021, 9022, 9029, 9031, 9081, 9082, 9083, 9084, 9104, 9111, 9118, 9119, 9120, 9170, 9188, 9257 and 9265 complied with the requirements of the relevant legislation.

In all cases where the MSDS or the label was determined not to be in compliance with the relevant legislation, pursuant to subsection 16.1(1) of the Hazardous Materials Information Review Act, the claimant was given 30 days to provide the screening officer with a signed undertaking accompanied by the MSDS or the label amended as necessary.

2. Add “hydrogen chloride” to the list of hazardous combustion products.

3. Disclose the ACGIH–TWA skin notation for the hazardous ingredient “methanol”.

4. Disclose the AIHA WEEL–TWA skin notation for the confidential ingredient “organic sulfur compound”.

5. Disclose an LD50 (dermal, rabbit) value of 8.00 mL/kg for the hazardous ingredient “isopropanol”.

6. If the WHMIS classifications are stated on the MSDS, disclose that the controlled product is also in class D1A.

In the case of the following claim, the screening officer issued the decision that the claim for exemption was invalid.

In accordance with subsection 12(2) of the Hazardous Materials Information Review Act, affected parties, as defined, may make written representations to the screening officer with respect to the claim for exemption and the (material) safety data sheet ([M]SDS) or label to which it relates. On February 11, 2015, the Hazardous Products Act (HPA) was amended, and the Controlled Products Regulations (CPR) and the Ingredient Disclosure List were repealed and replaced with the new Hazardous Products Regulations (HPR). The revised legislation (HPA/HPR) is referred to as WHMIS 2015 and the former legislation (HPA/CPR) is referred to as WHMIS 1988. Transitional provisions allow compliance with either WHMIS 1988 or WHMIS 2015 for a specified period of time.

The claims listed below seek an exemption from the disclosure of supplier confidential business information in respect of a controlled/hazardous product; such disclosure would otherwise be required under the provisions of the relevant legislation.

Notice is hereby given by Industry Canada that the following documents came into force upon their publication on Industry Canada's Web site:

RSS-139 and SRSP-513 were published to include certification and licensing requirements for the recent extension to the AWS bands from 1755 MHz to 1780 MHz and from 2155 MHz to 2180 MHz.

General information

The review of RSS-139 and SRSP-513 has been coordinated with industry through the Radio Advisory Board of Canada (RABC).

The Radio Equipment Standards lists will be amended to reflect the above-mentioned changes.

Submitting comments

Interested parties are requested to provide their comments within 90 days of the date of publication of this notice in electronic format (Microsoft Word or Adobe PDF) to the Manager, Radio Equipment Standards (res.nmr@ic.gc.ca), for matters regarding the RSS, and to the Manager, Mobile Services (srsp.pnrh@ic.gc.ca), for matters regarding the SRSP. Comments received will be taken into consideration in the preparation of the next issue of the RSS and the SRSP.
