SPECIAL IMPORT MEASURES ACT

Certain fabricated industrial steel components — Decisions

On September 12, 2016, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping of certain fabricated industrial steel components originating in or exported from the People's Republic of China (China), the Republic of Korea, the Kingdom of Spain, the United Arab Emirates and the United Kingdom of Great Britain and Northern Ireland, and the alleged injurious subsidizing of certain fabricated industrial steel components from China.

The subject goods are usually classified under the following Harmonized System numbers:

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

Information

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA Web site at www.cbsa-asfc.gc.ca/sima-lmsi or by contacting the SIMA Registry and Disclosure Unit by telephone at 613-948-4605 or by email at simaregistry@cbsa-asfc.gc.ca.

Representations

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th Floor, Ottawa, Ontario K1A 0L8. To be given consideration in these investigations, this information should be received by January 26, 2017.

Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY

Certain fabricated industrial steel components

The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2016-003) to determine whether the evidence discloses a reasonable indication that the alleged injurious dumping of fabricated structural steel and plate-work components of buildings, process equipment, process enclosures, access structures, process structures, and structures for conveyancing and material handling, including steel beams, columns, braces, frames, railings, stairs, trusses, conveyor belt frame structures and galleries, bents, bins, chutes, hoppers, ductwork, process tanks, pipe racks and apron feeders, whether assembled or partially assembled into modules, or unassembled, for use in structures for: 1. oil and gas extraction, conveyance and processing; 2. mining extraction, conveyance, storage, and processing; 3. industrial power generation facilities; 4. petrochemical plants; 5. cement plants; 6. fertilizer plants; and 7. industrial metal smelters; but excluding electrical transmission towers; rolled steel products not further worked; steel beams not further worked; oil pump jacks; solar, wind and tidal power generation structures; power generation facilities with a rated capacity below 100 megawatts; goods classified as “prefabricated buildings” under HS Code 9406.00.90.30; structural steel for use in manufacturing facilities used in applications other than those described above; and products covered by Certain Fasteners (RR-2014-001), Structural Tubing (RR-2013-001), Carbon Steel Plate (III) (RR-2012-001), Carbon Steel Plate (VII) (NQ-2013-005), and Steel Grating (NQ-2010-002); originating in or exported from the People's Republic of China, the Republic of Korea, the Kingdom of Spain, the United Arab Emirates and the United Kingdom of Great Britain and Northern Ireland (the subject goods), and the alleged injurious subsidizing of the subject goods originating in or exported from the People's Republic of China, have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.

The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before September 26, 2016. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before September 26, 2016.

On October 3, 2016, the Tribunal will issue a list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. One photocopy-ready original and six bound copies of all submissions must be served on the Tribunal.

The Eastern Yellow-bellied Racer (Coluber constrictor flaviventris) is a long, smooth scaled, quick moving diurnal snake listed on Schedule 1 of the Species at Risk Act as threatened. In Canada, the extreme northern tip of the species range extends into southwestern Saskatchewan and southeastern Alberta. Distribution of Canadian populations include, among others, hibernacula located within the boundaries of Grasslands National Park of Canada.

The Recovery Strategy for the Eastern Yellow-bellied Racer (Coluber constrictor flaviventris) in Canada (https://www.registrelep-sararegistry.gc.ca/document/default_e.cfm?documentID=1957) previously identified critical habitat for the species. The Multi-species Action Plan for Grasslands National Park of Canada (https://www.registrelep-sararegistry.gc.ca/document/default_e.cfm?documentID=2913) identifies additional critical habitat for the species in Grasslands National Park of Canada.

The species inhabits sparsely vegetated slopes along eroded coulees, canyons, badlands and ravines of the mixed-grass prairie in southwestern Saskatchewan and southeastern Alberta.

Description of critical habitat of the Loggerhead Shrike (excubitorides subspecies), Mormon Metalmark (Prairie population), Mountain Plover, and Swift Fox in Grasslands National Park of Canada

The Loggerhead Shrike (Lanius ludovicianus excubitorides) is a medium-sized songbird protected under the Migratory Birds Convention Act, 1994 and listed on Schedule 1 of the Species at Risk Act as threatened. In Canada, the Loggerhead Shrike (excubitorides subspecies) breeds in the grasslands and aspen parklands of southeastern Alberta, southern Saskatchewan and southwestern Manitoba.

The Mormon Metalmark (Apodemia mormo) Prairie population is a medium-sized butterfly of arid regions that is listed on Schedule 1 of the Species at Risk Act as threatened. In Canada, the Mormon Metalmark Prairie Population is restricted to southwestern Saskatchewan.

The Mountain Plover (Charadrius montanus) is a medium-sized shorebird protected under the Migratory Birds Convention Act, 1994 and listed on Schedule 1 of the Species at Risk Act as endangered. In Canada, this species is at the northern periphery of its range and is restricted to extreme southeastern Alberta and southwestern Saskatchewan. Its habitat is open, flat, dry grasslands with sparse, low vegetation and considerable bare ground.

The Swift Fox (Vulpes velox), North America's smallest canid, is listed on Schedule 1 of the Species at Risk Act as threatened. The Canadian populations occur in the southernmost portion of the Prairies near the Alberta–Saskatchewan border, and in and around Grasslands National Park of Canada in south-central Saskatchewan.

The Multi-species Action Plan for Grasslands National Park of Canada (https://www.registrelep-sararegistry.gc.ca/document/default_e.cfm?documentID=2913) identifies critical habitat for these species in Grasslands National Park of Canada.

The Sprague's Pipit (Anthus spragueii) is a migratory bird protected under the Migratory Birds Convention Act, 1994 and is listed on Schedule 1 of the Species at Risk Act as threatened. The Sprague's Pipit is a small (15–17 cm, 23–25 g), ground-nesting songbird that is endemic to the Canadian Prairies and northern Great Plains of the United States. In Canada, Sprague's Pipit breeds in west-central and southern Manitoba, southern Saskatchewan and southern and central Alberta.

The Multi-species Action Plan for Grasslands National Park of Canada (https://www.registrelep-sararegistry.gc.ca/document/default_e.cfm?documentID=2913) identifies new critical habitat for the species in Grasslands National Park of Canada, replacing the previously identified critical habitat identified in the Amended Recovery Strategy for Sprague's Pipit (Anthus spragueii) in Canada (https://www.registrelep-sararegistry.gc.ca/document/default_e.cfm?documentID=1301).
