Certain fabricated industrial steel components — Decisions
On January 25, 2017, pursuant to subsection 38(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made a preliminary determination of dumping concerning certain fabricated industrial steel components originating in or exported from the People's Republic of China (China), the Republic of Korea and the Kingdom of Spain, and made a preliminary determination of subsidizing concerning fabricated industrial steel components from China.
On the same date, the President of the CBSA, pursuant to paragraph 35(2)(a) of SIMA, terminated the dumping investigation in respect of the above-mentioned goods originating in or exported from the United Arab Emirates and the United Kingdom of Great Britain and Northern Ireland.

The Canadian International Trade Tribunal (CITT) will conduct a full inquiry into the question of injury to the domestic industry and will make an order or finding no later than 120 days after its receipt of the notice of the preliminary determination of dumping and subsidizing.
Pursuant to section 8 of SIMA, provisional duty is payable on subject goods that are released from the CBSA during the period commencing January 25, 2017, and ending on the earlier of the day the investigation is terminated, the day on which the CITT makes an order or finding, or the day an undertaking is accepted.
The amount of provisional duty payable is not greater than the estimated margin of dumping and the estimated amount of subsidy. The Customs Act applies with respect to the accounting and payment of provisional duty. Therefore, failure to pay duties within the prescribed time will result in the application of the interest provisions of the Customs Act.

The following is a summary of the terms and conditions of the above-mentioned Exploration Licences:
1. The Exploration Licence confers
- (a) the right to explore for, and the exclusive right to drill and test for, petroleum;
- (b) the exclusive right to develop those portions of the offshore area in order to produce petroleum; and
- (c) the exclusive right, subject to compliance with the other provisions of the Act, to obtain a Production Licence.
2. The Exploration Licence was issued for a nine-year term effective January 15, 2017.
3. Period I is a period of six years commencing on the effective date of the Exploration Licence. The Interest Owner shall commence the drilling of a Validation Well within Period I, and diligently pursue such drilling thereafter, as a condition precedent to obtaining tenure during Period II.
4. The Interest Owner may, at its option, extend Period I for additional years to a maximum total of three one-year extensions by posting a Drilling Deposit with the Board before the end of Period I or any additional year extension of Period I in the following amounts:
Period I A — one-year extension — $5 million
Period I B — one-year extension — $10 million
Period I C — one-year extension — $15 million
If a Drilling Deposit is posted, it will be refunded in full if the Validation Well commitment is met during the respective period of extension. Otherwise, the drilling deposit will be forfeited upon termination of that period extension.
If a Validation Well is not drilled, the Drilling Deposit will be forfeited to the Receiver General for Canada upon the termination of the Exploration Licence at the end of Period I. Allowable Expenditures cannot be applied against the Drilling Deposit.
5. Upon the expiration of Period II, there shall be a deemed surrender of the interest except as it relates to the lands or any portion thereof subject to a Significant Discovery Licence, or a Production Licence.

A credit against the Security Deposit will be made following each anniversary date of the Exploration Licence on the basis of 25% of Allowable Expenditures. Any deposit balance remaining at the end of Period I, or following the termination of a well commenced and being pursued diligently but not terminated within Period I, or upon the surrender of rights, will be forfeited.
7. For these Exploration Licences, rentals will be applicable only in Period II at a rate of $5.00 per hectare in respect of the first year and increasing thereafter by $5.00 per hectare per year, up to and including the third year.

Issuance of exploration licence — Exception to call for bids
Pursuant to paragraph 61(1)(b) of the Canada– Newfoundland and Labrador Atlantic Accord Implementation Act, S.C., 1987, c. 3, and paragraph 60(1)(b) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation Newfoundland and Labrador Act, R.S.N.L., 1990, c. C-2, the Canada–Newfoundland and Labrador Offshore Petroleum Board (CNLOPB) advises that upon receipt of approval of a fundamental decision by the Accord Act ministers, Exploration Licence No. 1153 has been issued effective January 15, 2017, in exchange for a surrender of existing Exploration Licence No. 1105 issued to Corridor Resources Inc. in the Canada– Newfoundland and Labrador Offshore Area.
The issuance of this new exploration licence equitably restores the exploration licence term to four years to afford time to complete the environmental assessment, to seek a drilling operations authorization and to validate the geological prospect commonly referred to as Old Harry.
Offshore safety and environmental protection are paramount in all Board decisions. The CNLOPB will not approve any offshore petroleum-related activity until an operator demonstrates that it has met all legislative and regulatory requirements and has reduced risks to levels that are as low as reasonably practicable.

Certain fabricated industrial steel components
Notice was received by the Canadian International Trade Tribunal (the Tribunal) on January 25, 2017, from the Director General of the Trade and Anti-dumping Programs Directorate at the Canada Border Services Agency (CBSA), stating that a preliminary determination (Inquiry No. NQ-2016-004) had been made respecting the dumping of fabricated structural steel and plate-work components of buildings, process equipment, process enclosures, access structures, process structures, and structures for conveyancing and material handling, including steel beams, columns, braces, frames, railings, stairs, trusses, conveyor belt frame structures and galleries, bents, bins, chutes, hoppers, ductwork, process tanks, pipe racks and apron feeders, whether assembled or partially assembled into modules, or unassembled, for use in structures for 1. oil and gas extraction, conveyance and processing; 2. mining extraction, conveyance, storage, and processing; 3. industrial power generation facilities; 4. petrochemical plants; 5. cement plants; 6. fertilizer plants; and 7. industrial metal smelters; but excluding electrical transmission towers; rolled steel products not further worked; steel beams not further worked; oil pump jacks; solar, wind and tidal power generation structures; power generation facilities with a rated capacity below 100 MW; goods classified as “prefabricated buildings” under HS Code 9406.00.90.30; structural steel for use in manufacturing facilities used in applications other than those described above; and products covered by Certain Fasteners (RR-2014-001), Structural Tubing (RR-2013-001), Carbon Steel Plate (III) (RR-2012-001), Carbon Steel Plate (VII) (NQ-2013-005) and Steel Grating (NQ-2010-002) [the subject goods], originating in or exported from the People's Republic of China, the Republic of Korea, the Kingdom of Spain, and the subsidizing of the subject goods originating in or exported from the People's Republic of China.
Pursuant to section 42 of the Special Import Measures Act (SIMA), the Tribunal has initiated an inquiry to deter-mine whether the dumping and subsidizing of the above- mentioned goods have caused injury or retardation or are threatening to cause injury, and to determine such other matters as the Tribunal is required to determine under that section.
Each person or government wishing to participate in the inquiry and at the hearing as a party must file a notice of participation with the Tribunal on or before February 9, 2017. Each counsel who intends to represent a party in the inquiry and at the hearing must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before February 9, 2017.
A public hearing relating to this inquiry will be held in the Tribunal's Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing on May 1, 2017, at 9:30 a.m., to hear evidence and representations by interested parties.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must submit to the Tribunal, at the time the information is provided, a statement designating the information as confidential, together with an explanation as to why that information is designated as confidential. Furthermore, the person must submit a non-confidential summary of the information designated as confidential or a statement indicating why such a summary cannot be made.

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal (the Tribunal) made a determination (File No. PR-2016-035) on January 26, 2017, with respect to a complaint filed by Agence Gravel Inc. (Agence Gravel), of Québec, Quebec, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. M8500-14R086/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Royal Canadian Mounted Police. The solicitation was for 7.62 mm fast-attach firearm suppressors.
Agence Gravel alleged that PWGSC's decision to cancel the Request for a Standing Order was illegal and contravened the contract binding it to Agence Gravel.
Having examined the evidence presented by the parties and considered the provisions of the Agreement on Internal Trade, the Tribunal determined that the complaint was valid.

The Canadian International Trade Tribunal (the Tribunal) has received a complaint (File No. PR-2016-051) from Marine International Dragage Inc. (MID), of Sorel-Tracy, Quebec, concerning an alleged mutual agreement contract signed between the Canadian Coast Guard (CCG) and an entity bearing the name Le Groupe Saint-Pierre for goods and/or services related to the Kathryn Spirit, moored in Beauharnois, Quebec. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on January 24, 2017, to conduct an inquiry into the complaint.
MID alleges that the CCG entered into a mutual agreement contract instead of initiating a competitive process.
