Certain sucker rods—Decisions
On May 18, 2018, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain sucker rods from China.
The subject goods are usually classified under the following tariff classification number:
- 8413.91.00.10
The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

The Statement of Reasons regarding the decisions will be issued within 15 days following the decisions and will be available on the CBSA website or by contacting the SIMA Registry and Disclosure Unit by telephone at 613‑948‑4605 or by email at simaregistry@cbsa-asfc.gc.ca.
Representations
Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th Floor, Ottawa, Ontario K1A 0L8. To be given consideration in these investigations, this information should be received by September 26, 2018.
Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission also must be provided.

Cold-rolled steel—Decisions
On May 25, 2018, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain cold-rolled steel in coils or cut lengths from China, South Korea and Vietnam.

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY
Sucker rods
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2018-001) to determine whether the evidence discloses a reasonable indication that the dumping and subsidizing of sucker rods, including pony rods, with or without couplings attached and with or without guides attached, manufactured to American Petroleum Institute (API) 11B specifications, equivalent standards or proprietary standards, including in a finished or semi-finished state, made of solid steel, including carbon, alloy and special grades of steel, of 2.5 inches (63.5 mm) or less in diameter of rod body, with stated measurements subject to permissible tolerances, originating in or exported from the People's Republic of China (the subject goods), have caused injury or retardation or are threatening to cause injury, as these words are defined in SIMA.
The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before June 4, 2018. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before June 4, 2018.
On June 11, 2018, the Tribunal will issue a list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record, and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. One complete digital version of all submissions must be filed with the Tribunal.
Submissions by parties opposed to the complaint must be filed not later than noon on June 19, 2018. The complainant may make submissions in response to the submissions of parties opposed to the complaint not later than noon on June 26, 2018. At that time, other parties in support of the complaint may also make submissions to the Tribunal.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

EXPIRY REVIEW OF ORDER
Carbon steel welded pipe
The Canadian International Trade Tribunal (the Tribunal) hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review (Expiry Review No. RR-2018-001) of its order made on August 19, 2013, in Expiry Review No. RR-2012-003, continuing, without amendment, its finding made on August 20, 2008, in Inquiry No. NQ-2008-001, concerning the dumping and subsidizing of carbon steel welded pipe, commonly identified as standard pipe, in the nominal size range of 1/2 inch up to and including 6 inches (12.7 mm to 168.3 mm in outside diameter) inclusive, in various forms and finishes, usually supplied to meet ASTM A53, ASTM A135, ASTM A252, ASTM A589, ASTM A795, ASTM F1083 or Commercial Quality, or AWWA C200-97 or equivalent specifications, including water well casing, piling pipe, sprinkler pipe and fencing pipe, but excluding oil and gas line pipe made to API specifications exclusively and excluding (1) carbon steel welded pipe in the nominal pipe size of 1 inch, meeting the requirements of specification ASTM A53, Grade B, Schedule 10, with a black or galvanized finish, and with plain ends, for use in fire protection applications, (2) carbon steel welded pipe in nominal pipe sizes of 1/2 inch to 2 inches inclusive, produced using the electric resistance welding process and meeting the requirements of specification ASTM A53, Grade A, for use in the production of carbon steel pipe nipples, and (3) carbon steel welded pipe in nominal pipe sizes of 1/2 inch to 6 inches inclusive, dual-stencilled to meet the requirements of both specification ASTM A252, Grades 1 to 3, and specification API 5L, with bevelled ends and in random lengths, for use as foundation piles, originating in or exported from the People's Republic of China (the subject goods).
In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the order in respect of the subject goods is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping and/or subsidizing, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping and/or subsidizing are likely to result in injury. The CBSA will provide notice of its determinations within 150 days after receiving notice of the Tribunal's decision to initiate an expiry review, that is, no later than October 22, 2018. The Tribunal will issue its order and its statement of reasons no later than April 1, 2019.
Each person or government wishing to participate in this expiry review must file a notice of participation with the Tribunal on or before November 5, 2018. Each counsel who intends to represent a party in the expiry review must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before November 5, 2018.

The Tribunal will hold a public hearing relating to this expiry review in the Tribunal's Hearing Room No. 1, 18th Floor, 333 Laurier Avenue West, Ottawa, Ontario, commencing on January 21, 2019, at 9:30 a.m., to hear evidence and representations by interested parties. If there are no opposing parties, the Tribunal may explore the possibility of holding a file hearing, i.e. a hearing through written submissions only, instead of an oral hearing.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2018-004) from Digital Direct Multimedia (DDM), of L'Ange-Gardien, Quebec, concerning a procurement (Solicitation No. 7384143) by the Canadian International Development Agency (CIDA) on behalf of Global Affairs Canada. The solicitation is for general commercial photography services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on May 22, 2018, to conduct an inquiry into the complaint.
DDM alleges that CIDA misapplied the evaluation criteria of the public procurement and that the factual situation raises a reasonable apprehension of bias.
