SPECIAL IMPORT MEASURES ACT

Certain dry wheat pasta — Decisions

On June 26, 2018, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) made final determinations of dumping and of subsidizing with respect to certain dry wheat pasta from Turkey.

The subject goods are usually classified under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) is continuing its inquiry into the question of injury to the domestic industry and it will make a finding by July 26, 2018. Provisional duties will continue to be applied on imports of dumped and subsidized subject goods until the CITT concludes its inquiry and issues its finding.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, antidumping duty and/or countervailing duty will be applied to future importation of the subject goods. In that event, the importer in Canada shall pay such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duties.

Communication, photographic, mapping, printing and publication services

Notice is hereby given that the Canadian International Trade Tribunal issued an order on June 22, 2018, with respect to a complaint (File No. PR-2018-004) filed by Digital Direct Multimedia, of L'Ange-Gardien, Quebec, under subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 7384143) by the Canadian International Development Agency on behalf of Global Affairs Canada. The solicitation was for general commercial photography services.

Having examined the evidence presented by the parties, the Tribunal found that it did not have jurisdiction to continue its inquiry and, consequently, dismissed the complaint.

Tug, barge and heavy equipment services

The Canadian International Trade Tribunal has received a complaint (File No. PR-2018-010) from West Coast Tug & Barge Ltd. (WCTB), of Campbell River, British Columbia, concerning a procurement (Solicitation No. F1705-180028/A) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation is for tug, barge and heavy equipment services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on June 26, 2018, to conduct an inquiry into the complaint.

WCTB alleges that PWGSC improperly determined that the winning bidder met the requirements of the Invitation to Tender.
