Notice is hereby given that, on July 27, 2020, pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal determined (Preliminary Injury Inquiry No. PI-2020-001) that there is evidence that discloses a reasonable indication that the dumping of certain hot-rolled carbon steel plate and high-strength low-alloy steel plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths greater than 72 inches (+/− 1,829 mm) to 152 inches (+/− 3,860 mm) inclusive, and thicknesses from 0.375 inches (+/− 9.525 mm) up to and including 4.5 inches (+/− 114.3 mm) [with all dimensions being plus or minus allowable tolerances contained in the applicable standards], originating in or exported from the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), the Federal Republic of Germany, the Republic of Korea, the Federation of Malaysia and the Republic of Turkey (the subject goods), but excluding

has caused or is threatening to cause injury to the domestic industry. For greater certainty, the subject goods include steel plate which contains alloys greater than required by recognized industry standards, provided the steel does not meet recognized industry standards for an alloy grade steel plate.

EXPIRY REVIEW OF ORDER (E-REGISTRY PILOT PROJECT)

Certain whole potatoes

The Canadian International Trade Tribunal hereby gives notice that it will, pursuant to subsection 76.03(3) of the Special Import Measures Act (SIMA), initiate an expiry review (Expiry Review No. RR-2020-002) of its order made on September 9, 2015, in Expiry Review No. RR-2014-004, concerning the dumping of certain whole potatoes, excluding seed potatoes, excluding imports during the period from May 1 to July 31, inclusive, of each calendar year, and excluding red potatoes, yellow potatoes and the exotic potato varieties, regardless of packaging, and white and russet potatoes imported in 50-lb cartons in the following count sizes: 40, 50, 60, 70 and 80, and excluding whole potatoes certified as organic by a recognized certification agency, imported from the United States of America, for use or consumption in the province of British Columbia (the subject goods).

The Tribunal’s order in Expiry Review No. RR-2014-004 had continued, without amendment, its order made on September 10, 2010, in Expiry Review No. RR-2009-002, continuing, without amendment, its order made on September 12, 2005, in Expiry Review No. RR-2004-006, continuing, with amendment, its order made on September 13, 2000, in Review No. RR-99-005, continuing, without amendment, its order made on September 14, 1995, in Review No. RR-94-007, continuing, with amendment, its order made on September 14, 1990, in Review No. RR-89-010, which continued, without amendment, (1) the finding of the Anti-dumping Tribunal made on June 4, 1984, in Inquiry No. ADT-4-84, concerning whole potatoes with netted or russeted skin, excluding seed potatoes, in non-size A, also commonly known as strippers, originating in or exported from the state of Washington, United States of America, for use or consumption in the province of British Columbia, and (2) the finding of the Canadian Import Tribunal made on April 18, 1986, in Inquiry No. CIT-16-85, concerning whole potatoes, originating in or exported from the United States of America, for use or consumption in the province of British Columbia, excluding seed potatoes, and excluding whole potatoes with netted or russeted skin in non-size A, originating in or exported from the state of Washington.

In this expiry review, the Canada Border Services Agency (CBSA) will first determine whether the expiry of the order in respect of the subject goods is likely to result in the continuation or resumption of dumping of the subject goods. If the CBSA determines that the expiry of the order in respect of any goods is likely to result in the continuation or resumption of dumping, the Tribunal will then conduct an expiry review to determine if the continued or resumed dumping is likely to result in injury. The CBSA will provide notice of its determination on December 24, 2020. The Tribunal will issue its order and its statement of reasons no later than June 2, 2021.

Each person or government wishing to participate in this expiry review must file a notice of participation with the Tribunal on or before January 11, 2021. Each counsel who intends to represent a party in the expiry review must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before January 11, 2021.

The Tribunal will hold a hearing relating to this expiry review during the week of March 22, 2021. Given the current COVID-19 situation, the type of hearing, the place and the exact date will be communicated at a later date.
