Review of the final determinations of dumping regarding oil country tubular goods and hot-rolled steel plate — Decisions
On August 7, 2020, pursuant to paragraph 76.1(2)(b) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) continued the final determination of dumping with respect to certain oil country tubular goods originating in or exported from South Korea and Turkey with the following amendments: the CBSA terminated the dumping investigation regarding oil country tubular goods exported from South Korea by Hyundai Steel Company (formerly Hyundai Hysco Co. Ltd.) and oil country tubular goods exported from Turkey by Borusan Mannesmann Boru Sanayi ve Ticaret A.Ş. (Borusan).
Pursuant to paragraph 76.1(2)(b) of SIMA, the CBSA also continued the final determination of dumping with respect to certain hot-rolled steel plate originating in or exported from South Korea with the following amendment: the CBSA terminated the dumping investigation regarding hot-rolled steel plate exported from South Korea by Hyundai Steel Company (Hyundai Steel).
The Canadian International Trade Tribunal (CITT) is continuing its reviews into the question of injury to the domestic industry. The CITT will make its decisions by September 23, 2020, respecting oil country tubular goods and by October 14, 2020, respecting hot-rolled steel plate.
If the CITT reaffirms its threat of injury findings, oil country tubular goods (excluding those goods exported by Hyundai Steel and Borusan) and hot-rolled steel plate (excluding those goods exported by Hyundai Steel) will continue to be subject to anti-dumping duties. If the CITT rescinds its threat of injury findings in whole or in part, such imports will no longer be subject to anti-dumping duties.
The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of antidumping duty.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-019) from K’(Prime) Technologies Inc. (KPrime), of Calgary, Alberta, concerning a procurement (Solicitation No. E60PV-20WTMD/A) by the Department of Public Works and Government Services (PWGSC). The solicitation was for conveyer X-ray machines and walk-through metal detectors. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on July 31, 2020, to conduct an inquiry into the complaint.
KPrime alleges that PWGSC failed to evaluate its bid in accordance with the terms of the solicitation, and that the winning bidder was ineligible to be awarded the contract.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2020-021) from 1091847 Ontario Ltd., of Ottawa, Ontario, concerning a procurement (Solicitation No. BPM010162-01) by Shared Services Canada (SSC). The solicitation was for the supply and delivery of Cisco-branded networking products. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on August 4, 2020, to conduct an inquiry into the complaint.
1091847 Ontario Ltd. alleges that SSC improperly conducted the above-noted procurement by notably limiting the procurement to products of a particular manufacturer and refusing to provide information to allow suppliers of equivalent products to submit bids.
