Certain container chassis — Decision
On June 10, 2021, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated investigations into the alleged injurious dumping and subsidizing of certain container chassis from China.
The subject goods are usually classified under the following tariff classification number: 8716.39.30.90.
To a lesser extent, the subject goods may be classified under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigations will be terminated.

Representations
Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping and subsidizing. During the COVID-19 pandemic, written submissions must be sent electronically to simaregistry-depotlmsi@cbsa-asfc.gc.ca. To be given consideration in these investigations, the CBSA should receive this information by October 15, 2021.
Any information submitted by interested persons concerning these investigations will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

Issues | The first issue is whether 4 of the 20 types of goods in issue are properly classified under the tariff items determined by the President of the Canada Border Services Agency, or should be classified under different tariff items, as claimed by Hawthorne Canada Ltd. and SLS Runout Holdings ULC. The President of the Canada Border Services Agency, Hawthorne Canada Ltd. and SLS Runout Holdings ULC have indicated that they now agree on the tariff classification of the other 16 types of goods in issue. The second issue is whether 12 of the 20 types of goods in issue are entitled to the benefit of tariff item No. 9903.00.00 as articles that enter into the cost of manufacture or repair of "[a]gricultural or horticultural machinery for soil preparation or cultivation" or "[a]gricultural or horticultural machines of heading 84.36", as claimed by Hawthorne Canada Ltd. and SLS Runout Holdings ULC. |

COMMENCEMENT OF PRELIMINARY INJURY INQUIRY (E-REGISTRY SERVICE PILOT PROJECT)
Certain container chassis
The Canadian International Trade Tribunal hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2021-002) to determine whether there is evidence that discloses a reasonable indication that the dumping and subsidizing of container chassis and container chassis frames, whether finished or unfinished, assembled or unassembled, regardless of the number of axles, for the carriage of containers, or other payloads (including self-supporting payloads) for road, marine roll-on/roll-off and/or rail transport, and certain subassemblies of container chassis originating in or exported from the People's Republic of China (the subject goods), have caused injury or retardation, or are threatening to cause injury, as these words are defined in SIMA.
The subject goods include the following complete or substantially complete major subassemblies, when imported, purchased or supplied with, or for assembly with, subject container chassis frames:
- (i) running gear assemblies for connection to the container chassis frame, whether fixed in nature or capable of sliding fore and aft, or lifting up and lowering down, which may include suspension(s), wheel end components, slack adjusters, axles, brake chambers, locking pins, tires and wheels;
- (ii) landing gear assemblies, for connection to the container chassis frame, capable of supporting the container chassis when it is not engaged to a tractor; and
- (iii) connection assemblies that connect to the container chassis frame or a section of the container chassis frame, such as B-trains and A-trains, capable of connecting a container chassis to a converter dolly or another container chassis.
The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a Form I — Notice of Participation with the Tribunal, on or before June 23, 2021. Each counsel who intends to represent a party in the preliminary injury inquiry must file a Form II — Notice of Representation and a Form III — Declaration and Undertaking with the Tribunal, on or before June 23, 2021. The forms can be found in English and French on the Tribunal's website.
Submissions by parties opposed to the complaint must be filed not later than noon (ET), on July 8, 2021. The complainant and supporting parties may make submissions in response to the submissions of parties opposed to the complaint not later than noon (ET), on July 15, 2021.
In accordance with section 46 of the Canadian International Trade Tribunal Act, a person who provides information to the Tribunal and who wishes some or all of the information to be kept confidential must, among other things, submit a non-confidential edited version or summary of the information designated as confidential, or a statement indicating why such a summary cannot be made.

Notice is hereby given that, on June 14, 2021, pursuant to subsection 37.1(1) of the Special Import Measures Act, the Canadian International Trade Tribunal determined (Preliminary Injury Inquiry No. PI-2021-001) that the evidence discloses a reasonable indication that the dumping of liquid dielectric transformers having a top power handling capacity equal to or greater than 3 000 kilovolt amperes (kVA) [3 megavolt amperes (MVA)], and less than 60 000 kVA (60 MVA), and having a nominal high voltage rating of greater than 34.5 kilovolts (kV), whether assembled or unassembled, complete or incomplete, originating in or exported from the Republic of Austria, the Separate Customs Territory of Taiwan, Penghu, Kinmen and Matsu (Chinese Taipei), and the Republic of Korea, has caused injury or is threatening to cause injury to the domestic industry.

Project management services
Notice is hereby given that, after completing its inquiry (File No. PR-2020-079), the Canadian International Trade Tribunal made a determination on June 7, 2021, with respect to a complaint filed by The AIM Group (AIM), of Ottawa, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (Solicitation No. 08C39-180460/A) by the Department of Public Works and Government Services on behalf of the Department of Foreign Affairs, Trade and Development. The solicitation was for the provision of project management services.
AIM challenged the evaluation results and argued that there was an unjustifiable difference in contract award amount between the first-ranked bidder and itself as the second-ranked bidder.
Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.
