SPECIAL IMPORT MEASURES ACT

Grinding media — Decisions

On July 29, 2021, pursuant to paragraph 41(1)(b) of the Special Import Measures Act, the Canada Border Services Agency (CBSA) has made final determinations of dumping and subsidizing concerning certain grinding media originating in or exported from India.

The subject goods are usually classified under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) inquiry into the question of injury to the Canadian industry is continuing, and it will issue its decision by August 27, 2021. Provisional duty will continue to be imposed on the subject goods from India until the CITT renders its decision.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, anti-dumping duty and/or countervailing duty will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duties.

Information

The Statement of Reasons regarding the final determinations will be issued within 15 days following the decision and will be available on the CBSA’s website.

Goods in Issue Various brands of coconut milk and coconut cream. The three brands under appeal are Aroy-d Coconut Milk and Cream, Real Thai Coconut Milk and Savoy Coconut Cream.
Issue Whether the goods in issue are properly classified as "[f]ruit, nuts and other edible parts of plants, otherwise prepared or preserved, whether or not containing added sugar or other sweetening matter or spirit, not elsewhere specified or included" under tariff item No. 2008.19.90.90, as determined by the President of the Canada Border Services Agency, or should be classified as "[f]ruit juices (including grape must) and vegetable juices, unfermented and not containing added spirit, whether or not containing added sugar or other sweetening matter" under tariff item No. 2009.89.10.90, as claimed by Thai Indochine Trading Inc. The President of the Canada Border Services Agency has requested that its previous decision to classify the goods in issue under tariff item No. 2008.19.90.90 be set aside, and that the goods should instead be classified as "[f]ood preparations not elsewhere specified or included" under tariff item No. 2106.90.99.

PUBLIC SERVICE EMPLOYMENT ACT

Permission and leave granted (Dykeman, Whitney)

The Public Service Commission of Canada, pursuant to section 116 of the Public Service Employment Act, hereby gives notice that it has granted permission, pursuant to subsection 114(4) of the said Act, to Whitney Dykeman, Information Management Advisor, Public Services and Procurement Canada, to seek nomination as a candidate before and during the election period and to be a candidate before the election period in the federal election in the electoral district of Fundy Royal, New Brunswick. The election is expected to be held on or before October 16, 2023.

The Public Service Commission of Canada, pursuant to subsection 114(5) of the said Act, has also granted a leave of absence without pay during the election period, effective the first day the employee is a candidate during the election period.
