CANADA ENERGY REGULATOR

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES AS A BORDER ACCOMMODATION

Windsor Detroit Borderlink Limited

By an application dated 7 September 2021, Windsor Detroit Borderlink Limited (the Applicant) has applied to the Canada Energy Regulator (the CER) under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act) for authorization to export up to 5 kV of firm power and up to 800 MWh of firm energy annually, for a period of 30 years commencing 1 December 2021, as a border accommodation. This export would be in accordance with the terms of the Memorandum of Understanding between Windsor Detroit Borderlink Limited and the Detroit Windsor Tunnel Corp. dated 23 July 2021.

The Commission of the CER wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

  1. The Applicant shall provide a copy of the application by email to any person who requests one by emailing ctremblay@wdbl.ca. The application is also publicly available on the CER website. You can access the CER's regulatory electronic document repository, enter the company name and click on “Search.”
  2. Written submissions that any interested party wishes to present in respect of the application shall be filed online with the CER in care of the Secretary of the Commission, and emailed to the Applicant by 18 October 2021.
  3. Any answer to submissions that the Applicant wishes to present in response to item 2 of this Notice of Application and Directions on Procedure shall be filed online with the CER in care of the Secretary of the Commission and emailed to the party that filed the submission by 31 October 2021.

Armament training devices

The Canadian International Trade Tribunal has received a complaint (File No. PR-2021-040) from Cadex Inc. (Cadex) of Saint-Jean-sur-Richelieu, Quebec, concerning a procurement (Solicitation No. W8476-196090/B) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was for the provision of multi-calibre sniper weapon systems. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on August 30, 2021, to conduct an inquiry into the complaint.

Cadex alleges that PWGSC did not conduct testing in accordance with the evaluation procedures of the solicitation, ignored vital information provided by Cadex, and conducted the procurement in a procedurally unfair manner with insufficient transparency.

The Canadian International Trade Tribunal has received a complaint (File No. PR-2021-032) from Anritsu Electronics Ltd. (Anritsu) of Kanata, Ontario, concerning a procurement (Solicitation No. UT255-219841/A) made by the Department of Public Works and Government Services (PWGSC) on behalf of Innovation, Science and Economic Development Canada. The solicitation was for hand-held spectrum analyzers. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on August 6, 2021, to conduct an inquiry into the complaint.

Anritsu alleges that PWGSC did not follow the procedures and guidelines stipulated in the solicitation documents, and that the successful bidder did not meet one or more mandatory requirements of the solicitation.
