Container chassis — Decisions

On January 19, 2022, pursuant to paragraph 41(1)(b) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) has made final determinations of dumping and subsidizing of container chassis from China.

The subject goods are usually classified under the following tariff classification number:

The above-listed tariff classifications cover both subject and non-subject goods.

The Canadian International Trade Tribunal (CITT) inquiry into the question of injury to the Canadian industry is continuing, and it will issue its decision by February 18, 2022. Provisional duty will continue to be imposed on the subject goods from China until the CITT renders its decision.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, anti-dumping duty and/or countervailing duty will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of anti-dumping and countervailing duties.

Information

The Statement of Reasons regarding these decisions will be issued within 15 days following the decisions and will be available on the CBSA’s website.

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES AS A BORDER ACCOMMODATION

Notice is hereby given that the notice bearing the above-mentioned title published in the Canada Gazette, Part I, Vol. 155, No. 38, Saturday, September 18, 2021, on page 4900, should have been written as follows:

By an application dated 7 September 2021, Windsor Detroit Borderlink Limited (the Applicant) has applied to the Canada Energy Regulator (the CER) under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act) for authorization to export, for a term ending on 30 November 2051, up to 900 kW of power and 8 000 MWh of firm energy in any consecutive 12-month period, as a border accommodation transfer to the Detroit Windsor Tunnel Corp. (DWT) over international power lines authorized by Certificate EC-24. This power constitutes a transfer of power and energy for emergency back-up power for each respective facility in Canada and the United States; therefore, the transfer is a border accommodation transfer pursuant to section 2 of the National Energy Board Electricity Regulations, SOR/97-130. This authorization effectively represents a renewal of existing Permit EPE-26, which ends on 31 March 2022. This export would be in accordance with the terms of the Memorandum of Understanding between Windsor Detroit Borderlink Limited and the Detroit Windsor Tunnel Corp. dated 23 July 2021.

The Commission of the CER wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

  1. The Applicant shall provide a copy of the application by email to any person who requests one by emailing ctremblay@wdbl.ca. The application is also publicly available on the CER website.   2. Written submissions that any interested party wishes to present in respect of the application shall be filed online with the CER in care of the Secretary of the Commission, and emailed to the Applicant by 1 March 2022.
  3. Any answer to submissions that the Applicant wishes to present in response to item 2 of this Notice of Application and Directions on Procedure shall be filed online with the CER in care of the Secretary of the Commission and emailed to the party that filed the submission by 12 March 2022.

DETERMINATION

Communications, photographic, mapping, printing and publication services

Notice is hereby given that, after completing its inquiry, the Canadian International Trade Tribunal made a determination (File PR-2021-043) on January 19, 2022, with respect to a complaint filed by SupremeX Inc. (SupremeX), of Etobicoke, Ontario, pursuant to subsection 30.11(1) of the Canadian International Trade Tribunal Act, R.S.C., 1985, c. 47 (4th Supp.), concerning a procurement (solicitation EN893-220033/A) by the Department of Public Works and Government Services. The solicitation was for the provision of envelopes for the Receiver General for Canada.

SupremeX alleged that the successful bidder should not have been awarded the contract, as it did not meet the Canadian content and corporate experience requirements set out in the solicitation.

Having examined the evidence presented by the parties and considered the provisions of various trade agreements, the Tribunal determined that the complaint was not valid.

INQUIRY

Communication, detection, and coherent radiation equipment

The Canadian International Trade Tribunal has received a complaint (File PR-2021-067) from Thales Canada Inc. (Thales) of Ottawa, Ontario, concerning a procurement (solicitation W6369-20CY06/C) by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of National Defence. The solicitation was an invitation to qualify as a potential supplier for the Cyber Defence — Decision Analysis and Response (CD-DAR) project. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on January 13, 2022, to conduct an inquiry into the complaint.

Thales alleges that it was unable to submit its proposal due to a technical problem with the third-party platform (epost Connect) selected by PWGSC for receiving proposals and that PWGSC’s refusal to enable Thales to submit its proposal was unfair, unjustified, and contrary to its obligations under the Canadian Free Trade Agreement and the Canada-European Union Comprehensive Economic and Trade Agreement.
