CANADA ENERGY REGULATOR

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES

Freepoint Commodities LLC

By an application dated 16 September 2022, Freepoint Commodities LLC (the Applicant) has applied to the Canada Energy Regulator (the CER) under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act) for authorization to export up to 10 000 000 MWh of combined firm and interruptible energy annually, for a period of 10 years. The Applicant does not own or control any power system assets (generation, transmission, distribution) in Canada. Nor do any affiliates of the Applicant own any electric generation, transmission or distribution assets in Canada, or projects related thereto.

The Commission of the Canada Energy Regulator (the Commission) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

  1. The Applicant shall provide a copy of the application by email to any person who requests one by emailing NSwan@freepoint.com. The application is also publicly available on the CER’s website.
  2. Written submissions that any interested party wishes to present shall be filed online with the CER in care of the Secretary of the Commission, and emailed to the Applicant by 17 October 2022.
  3. Pursuant to subsection 359(2) of the Act, the Commission is interested in the views of submitters with respect to
    • (a) the effect of the exportation of the electricity on provinces other than that from which the electricity is to be exported; and
    • (b) whether the Applicant has
      • (i) informed those who have declared an interest in buying electricity for consumption in Canada of the quantities and classes of service available for sale, and
      • (ii) given an opportunity to buy electricity on conditions as favourable as the conditions specified in the application to those who, within a reasonable time after being so informed, demonstrate an intention to buy electricity for consumption in Canada.
  4. Any answer to submissions that the Applicant wishes to present in response to items 2 and 3 of this Notice of Application and Directions on Procedure shall be filed with the CER in care of the Secretary of the Commission and emailed to the party that filed the submission by 1 November 2022.

By an application dated 6 September 2022, Triolith Energy Fund, LP (the Applicant) has applied to the Canada Energy Regulator (the CER) under Division 2 of Part 7 of the Canadian Energy Regulator Act (the Act) for authorization to export up to 8 760 000 MWh of combined firm and interruptible energy annually, for a period of 10 years.

The Commission of the Canada Energy Regulator (the Commission) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

APPLICATION TO EXPORT ELECTRICITY TO THE UNITED STATES AS A BORDER ACCOMMODATION

Twin Rivers Paper Company Inc.

Twin Rivers Paper Company Inc., located at 27 Rice Street, Edmundston, New Brunswick, E3V 1S9, hereby gives notice that it has, under Division 2 of Part 7 of the Canadian Energy Regulator Act, filed an application with the Canada Energy Regulator (“CER”) on 12 September 2022, for an electricity export permit for authorization to export energy to Twin Rivers Paper Co. LLC in the United States as a border accommodation. The export will be for the period of 1 January 2023, through 31 December 2032, up to a maximum of 60 000 kilowatts at any one time and the quantity not to exceed 400,000,000 kilowatt-hours in any consecutive 12-month period.

The Commission of the CER (“Commission”) wishes to obtain the views of interested parties on this application before issuing a permit or recommending to the Governor in Council that the application be designated for a licensing procedure. The Directions on Procedure that follow explain in detail the procedure that will be used.

(Ramida) of Sooke, British Columbia, concerning a procurement (Solicitation 5000067016) made by the Department of the Environment (ECCC). The solicitation was for forestry road rehabilitation. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on September 1, 2022, to conduct an inquiry into the complaint.

Ramida alleges that ECCC improperly evaluated its bid.

Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on August 25, 2022, to conduct an inquiry into the complaint.

Cistel alleges that the awarded contract was improperly cancelled by the Department of Health.

Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on September 6, 2022, to conduct an inquiry into the complaint.

CAE alleges that PWGSC erred in refusing to accept its bid.
