Goods in Issue Seamless carbon or alloy steel oil and gas well casings and oil country tubular goods imported by the appellants between 2015 and 2018, and that are subject to the Tribunal’s findings in inquiries NQ-2007-001 and NQ-2009-004.
Issue Whether the normal values of, and the amounts of subsidy on, the goods in issue should be those
  • established by the Canada Border Services Agency (CBSA) on the basis of ministerial specifications, as determined by the President of the CBSA; or
  • previously issued by the CBSA to the exporters that the appellants declared as having exported the goods in issue, and that were in place at the time the goods were released from customs, as claimed by the appellants.

INQUIRY

Vessels, miscellaneous — Repair

The Canadian International Trade Tribunal has received a complaint (File PR-2022-053) from Chantier Davie Canada Inc. (Davie) of Ottawa, Ontario, and Wärtsilä Canada Inc. (Wärtsilä) of Surrey, British Columbia, concerning a procurement (Solicitation F7049-200041/B) made by the Department of Public Works and Government Services (PWGSC) on behalf of the Department of Fisheries and Oceans. The solicitation was for the carrying out of work on the CCGS Terry Fox. The required work includes docking, inspection, repair, maintenance and alterations, and work on major components, including the propulsion system. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is given that the Tribunal made a decision on November 16, 2022, to conduct an inquiry into the complaint.

Davie and Wärtsilä allege that PWGSC incorrectly determined that their bid was non-compliant. They also allege that the successful bid did not meet the mandatory requirements of the solicitation.
