EXPROPRIATION ACT
Notice of intention to expropriate — Lac-Mégantic Railway bypass [Temporary servitudes]
NOTICE IS HEREBY GIVEN that Her Majesty in right of Canada requires, for the purposes of the construction and exploitation of a railway bypassing the downtown area of Lac-Mégantic, all the immovable real rights, being real and temporary servitudes, hereinafter described in articles 1, 2, 3 and 4, namely:
ARTICLE 1. SERVITUDE FOR WORKSPACE AND STORAGE AREA
1.1. A real and temporary servitude for workspace and storage area, for a period not exceeding ten (10) years, on, in and over the lands hereinafter designated in paragraph 1.2, as servient land, allowing any activities that are required for the construction of the Lac-Mégantic railway bypass and its related facilities and infrastructures. This servitude includes, but is not limited to, the following rights:
- a. A right to access and circulate on the servient land hereinafter designated in paragraph 1.2 on foot and in vehicles, machinery and equipment of all kinds, including heavy machinery;
- b. A right to temporarily store or deposit on, in and over the servient land hereinafter designated in paragraph 1.2 any type of materials, tools, construction materials, machinery, equipment, soil, and other substances or materials;
- c. A right to construct and install on, in and over the servient land hereinafter designated in paragraph 1.2 any facilities of a temporary nature, such as mobile offices, construction trailers, shelters, lighting and heating systems, power supply systems and others, that would be necessary and useful for the exercise of the servitude for workspace and storage area;
- d. A right to cut, trim, remove and destroy, in any manner and at all times, all trees, shrubs, branches, bushes and roots that are located on, in and over the servient land hereinafter designated in paragraph 1.2 and that may interfere with the exercise of the servitude for workspace and storage area;
- e. A right to move from the servient land hereinafter designated in paragraph 1.2 any objects, furniture, constructions, materials, snow, works or structures that are located on, in or over the servient land hereinafter designated in paragraph 1.2 and that may interfere with the exercise of the servitude for workspace and storage area, specifying therefore that all objects, furniture, constructions, materials, works or structures so moved will, insofar as practicable, be replaced or relocated;
- f. A right to carry out and execute on, in and over the servient land hereinafter designated in paragraph 1.2 any works of improvement, lowering or raising of the ground that would be necessary and useful for the exercise of the servitude for workspace and storage area;
- g. A right to take all necessary, useful or expedient measures, including the right to install temporary fences and barriers, to protect, secure and limit access to the servient land hereinafter designated in paragraph 1.2 to authorized persons only;
- h. A right to give access to any persons, servants, employees, security services, corporations, directors, officers, agents, consulting firms, contractors, suppliers, subcontractors and guests to the servient land hereinafter designated in paragraph 1.2 if their presence is required for the purposes of the construction work and activities of the Lac-Mégantic railway bypass and its related facilities and infrastructures. In particular, the entity responsible for carrying out the construction works and activities of the Lac-Mégantic railway bypass, namely Central Maine and Québec Railway Canada Inc., as well as its directors, officers, agents, employees, consulting firms, contractors, suppliers, subcontractors and guests, shall have the right to exercise the servitude for workspace and storage area;
- i. A right prohibiting the owner of the land constituting the servient land hereinafter designated in paragraph 1.2 from accessing and circulating, or permitting the access or the circulation, on, in and over such servient land, unless previously authorized in writing by Her Majesty in right of Canada;
- j. A right prohibiting the owner of the land constituting the servient land hereinafter designated in paragraph 1.2 from erecting or installing, or permitting the erection or the installation of any building, construction, work or structure on, in or over such servient land; from altering or permitting the alteration of the existing elevation thereof; and to place or to allow to place, any object thereon that could in any way interfere with the exercise of the servitude for workspace and storage area, unless previously authorized, in writing, by Her Majesty in right of Canada.
All subject to the following conditions:
- k. Her Majesty in right of Canada shall indemnify and save harmless the owner of the land constituting the servient land hereinafter designated in paragraph 1.2 from and against all claims, demands, actions, suits or other proceedings arising out of the exercise of the servitude for workspace and storage area.
- l. Upon completion of the activities for which the servitude for workspace and storage area is required, the lands constituting the servient land hereinafter designated in paragraph 1.2 shall be restored to a good state of cleanliness and to a condition similar to that prior to the exercise of the said servitude, including their environmental condition. In the event of damage to the owners’ property from the exercise of the servitude for workspace and storage area, Her Majesty in right of Canada shall have the option of either repairing such damage or compensating the owners.
1.2. The lands required as servient land for the servitude for work and storage area referred to in paragraph 1.1. are known and designated as:

ARTICLE 2. SERVITUDE OF WORKS IN HYDRIC ENVIRONMENTS
2.1 A real and temporary servitude of works in hydric environments, for a period not exceeding twenty (20) years, on, in and over the lands hereinafter designated in paragraph 2.2 as servient lands, allowing any works and activities in hydric environments that are required for the construction of the Lac-Mégantic railway bypass and its related facilities and infrastructures, including the deviation (permanent or temporary) of the existing watercourses as well as the establishment and implementation of subsequent environmental monitoring. This servitude of works in hydric environments includes, but is not limited to, the following rights:
- a. A right to access and circulate on the servient lands hereinafter designated in paragraph 2.2 with any materials, equipment, vehicles and machinery of any kind, including heavy machinery, that would be necessary and useful to carry out and execute the works and activities of deviation of the existing watercourses and the subsequent environmental monitoring;
- b. A right, on, in and over the servient land hereinafter designated in paragraph 2.2, to excavate, clear, backfill, revegetate and take any other action that would be necessary and useful to carry out and execute the works and activities of deviation of the existing watercourses and the subsequent environmental monitoring;
- c. A right to carry out and execute on, in and over the servient land hereinafter designated in paragraph 2.2 all road development, alignment, lowering, raising or connection work, including the digging of ditches and the installation of culverts;
- d. A right to cut, trim, remove and destroy, in any manner and at all times, all trees, shrubs, branches, bushes and roots that are located on, in and over the servient land hereinafter designated in paragraph 2.2 and that may interfere with the exercise of the servitude of works in hydric environments;
- e. A right to move from the servient land hereinafter designated in paragraph 2.2 any objects, furniture, constructions, materials, snow, works or structures that are located on, in or over the servient land hereinafter designated in paragraph 2.2 and that may interfere with the exercise of the servitude of work in hydric environments, specifying therefore that any objects, furniture, constructions, materials, works or structures so moved will be, to the extend that it is practically feasible, replaced or relocated.
- f. A right to take all necessary, useful or expedient measures, including the right to install temporary fences and barriers, to protect, secure and limit access to the servient land hereinafter designated in subsection 2.2 to authorized persons only;
- g. A right prohibiting the owner of the land constituting the servient land hereinafter designated in paragraph 2.2 from accessing and circulating, or permitting the access or the circulation, on, in and over such servient land, except in such places and at such times and under such conditions as Her Majesty in right of Canada may determine and communicated in writing to the landowner;
- h. A right prohibiting the owner of the land constituting the servient land hereinafter designated in paragraph 2.2 from erecting or installing, or permitting the erection or the installation of, any building, construction, work or structure on, in or over such servient land; from altering or permitting the alteration of the existing elevation thereon; and from placing or permitting the placement of any object thereon which would in any way interfere with the exercise of the servitude of works in hydric environments, unless previously authorized in writing by Her Majesty in right of Canada;
- i. A right to authorize any persons, servants, employees, security services, companies, directors, officers, agents, consulting firms, contractors, suppliers, subcontractors and guests to access the servient land hereinafter designated in paragraph 2.2 if their presence is required for the purposes of the construction works and activities of the Lac-Mégantic railway bypass and its facilities and related infrastructures. In particular, the entity responsible for carrying out the construction work and activities of the Lac-Mégantic railway bypass, namely Central Maine and Quebec Railway Canada Inc., as well as its directors, officers, agents, employees, consulting firms, contractors, suppliers, subcontractors and guests, shall have the right to exercise the servitude of works in hydric environments.
All subject to the following conditions:
- j. Her Majesty in right of Canada shall indemnify and save harmless the owners of the lands constituting the servient land hereinafter designated in paragraph 2.2 from and against all claims, demands, actions, suits or other proceedings arising out of the exercise of the servitude of works in hydric environments.
- k. Upon completion of the water works and activities, the lands constituting the servient land hereinafter designated in paragraph 2.2 shall be restored to a good state of cleanliness and to a condition similar to that which existed prior to the exercise of the said easement, taking into account, however, the permanent watercourse detour works. In the event of any damage to the owners’ property as a result of the exercise of the servitude of works in hydric environments, Her Majesty in right of Canada shall have the option of either repairing such damage or compensating the owner.
- l. In the event that additional works or improvements have been constructed, installed or laid out on land constituting the servient land hereinafter designated in paragraph 2.2, such as the installation of culverts, the owner of such land shall acquire ownership thereof by accession without further formality.
2.2 The lands required as servient land for the servitude of works in hydric environments referred to in paragraph 2.1. are known and designated as:

ARTICLE 3. SERVITUDE OF RIGHT OF WAY
3.1. A real and temporary servitude consisting of a right of way on the existing roads located on, in and over the lands hereinafter designated in paragraph 3.2. as servient land. This servitude is required for a period not exceeding ten (10) years regarding the lands shown as Parcels 226, 228 and 220 and hereinafter designated in paragraph 3.2 as servient lands, and for a period not exceeding twenty (20) years regarding the lands shown as Parcels 233, 234, 235, 236, 249 and 250 and hereinafter designated in paragraph 3.2 as servient lands.This servitude includes, but is not limited to, the following rights:
- a. A right to access and circulate on said existing roads on foot and in vehicles, machinery and equipment of any kind, including heavy machinery, capable of transporting any type of material, tools, construction materials, soil, equipment, vehicles, machinery and other substances or materials;
- b. A right to carry out and execute on said existing roads any works of improvement, alignment, lowering, raising or widening that would be required or necessary for the exercise of the servitude of right of way (such as building crossing bays, digging ditches and installing culverts);
- c. A right to cut, trim, remove and destroy, in any manner and at all times, all trees, shrubs, branches, bushes and roots that are located on, in and over the servient land hereinafter designated in paragraph 3.2 and that may interfere with the exercise of the servitude of right of way;
- d. A right to move from the servient land hereinafter designated in paragraph 3.2 any objects, furniture, constructions, materials, snow, works or structures that are located on, in or over the servient land hereinafter designated in paragraph 3.2 and that may interfere with the exercise of the servitude of right of way, specifying therefore that any objects, furniture, constructions, materials, works or structures so removed will be, to the extend that it is practically feasible,, replaced or relocated;
- e. A right to authorize any persons, servants, employees, security services, companies, directors, officers, agents, consulting firms, contractors, suppliers, subcontractors and guests to access the servient land hereinafter referred to in paragraph 3.2 if their presence is required for the purposes of the construction work and activities of the Lac-Mégantic railway bypass and its facilities and related infrastructures. In particular, the entity responsible for carrying out the construction works and activities of the Lac-Mégantic railway bypass, namely Central Main and Québec Railway Canada Inc., as well as its directors, officers, agents, employees, consulting firms, contractors, suppliers, subcontractors and guests, shall have the right to exercise the servitude of right of way;
- f. A right to take all necessary, useful or expedient measures, including the right to install temporary fences and barriers and the right to use flagmen, to protect, secure and limit access to the servient land hereinafter designated in paragraph 3.2 to authorized persons only;
- g. A right prohibiting the owner of the land constituting the servient land hereinafter designated in paragraph 3.2 from erecting or installing, or permitting the erection or the installation of, any building, construction, work or structure; from altering, or permitting the alteration of, the existing elevation thereof; and to place, or to allow to place, any object thereon that could in any way interfere with the exercise of the servitude of right of way, unless previously authorized in writing by Her Majesty in right of Canada.
All subject to the following conditions and rights:
- h. The owner of the land constituting the servient land hereinafter designated in paragraph 3.2 shall retain access to the existing road on his or her land, but shall not interfere with or obstruct the exercise of the servitude of right of way and shall comply with the safety measures in place and with the instructions, if any, of the flagmen on site.
- i. In the event of the relocation or modification of the site of the existing roads located on the servient land designated in paragraph 3.2, all rights established by this servitude shall be exercised on the new site.
- j. Her Majesty in right of Canada shall indemnify and save harmless the owners of the lands constituting the servient land hereinafter designated in paragraph 3.2 from and against all claims, demands, actions, suits or other proceedings arising out of the exercise of the servitude of right of way.
- k. Upon termination of the servitude of right of way, the lands constituting the servient land hereinafter designated in paragraph 3.2 shall be restored to a good state of cleanliness and to a condition similar to that prior to the exercise of the said servitude, including their environmental condition, except for improvements to the lands, if any, provided therefore that crossing bays shall not be considered as an improvement. In the event of any damage to the owners’ property from the exercise of the servitude of right of way, Her Majesty in right of Canada shall have the option of either repairing such damage or compensating the owner.
- l. In the event that additional works or improvements have been constructed, installed or laid out on a land constituting the servient land hereinafter designated in paragraph 3.2, such as the installation of culverts, the owner of such land shall acquire ownership thereof by accession without further formality.

ARTICLE 4. SERVITUDE OF WORKS
4.1. A real and temporary servitude of works, for a period not exceeding ten (10) years, on, in and over the lands hereinafter designated in paragraph 4.2. as servient land, allowing to carry out any construction, improvement or redevelopment works that are required in connection with the construction of the Lac-Mégantic railway bypass and its related facilities and infrastructures. This servitude includes, but is not limited to, the following rights:
- a. A right to carry out and execute on, in and over the servient land hereinafter designated in paragraph 4.2 any construction, improvement or redevelopment works, including but not limited to, the laying out, alignment and connection of roads, including the digging of ditches and the installation of culverts, as well as the lowering or raising of ground;
- b. A right, on, in and over the servient land hereinafter designated in paragraph 4.2, to excavate, clear, backfill, revegetate and take any other action that would be necessary to carry out and execute the construction, improvement or redevelopment works;
- c. A right to carry out and execute on, in and over the servient land hereinafter referred to in subsection 4.2 all works and activities for the modification of existing private electrical systems, including but not limited to, the burial of the electrical lines;
- d. A right to access, occupy and circulate on the servient land hereinafter designated in paragraph 4.2 with all materials, equipment, vehicles and machinery of any kind, including heavy machinery, that would be necessary and useful for the exercise of this servitude of works;
- e. A right to cut, trim, remove and destroy, in any manner and at all times, all trees, shrubs, branches, bushes and roots that are located on, in and over the servient land hereinafter designated in paragraph 4.2 and that may interfere with the exercise the servitude of works;
- f. A right to move from the servient land hereinafter designated in paragraph 4.2 all objects, furniture, constructions, materials, snow, works or structures located on, in or over the servient land hereinafter designated in paragraph 4.2 and that may interfere with the exercise of the servitude of works, specifying therefore that all objects, furniture, constructions, materials, works or structures so moved will be, to the extend that it is practically feasible, replaced or relocated;
- g. A right to take all necessary, useful or expedient measures, including the right to install temporary fences and barriers, to protect, secure and limit access to the servient land hereinafter designated in paragraph 4.2, to authorized persons only;
- h. A right which includes a prohibition to the owner of land constituting the servient land hereinafter referred to in subsection 4.2 from accessing and circulating, or permitting the access or circulation, on, in and over the said servient land, unless previously authorized in writing by Her Majesty in right of Canada;
- i. A right which includes a prohibition to the owner of the land constituting the servient land hereinafter designated in paragraph 4.2 from erecting or installing, or permitting the erection or the installation of, any building, construction, work or structure on, in or over such servient land; from altering, or permitting the alteration of, the existing elevation thereof; and to place, or to allow to place, any object thereon that could in any way interfere with the exercise of the servitude of works, unless previously authorized in writing by Her Majesty in right of Canada;

A right to authorize any persons, servants, employees, security services, companies, directors, officers, agents, consulting firms, contractors, suppliers, subcontractors and guests to access the servient land hereinafter designated in paragraph 4.2 if their presence is required for the purposes of the construction work and activities of the Lac-Mégantic railway bypass and its facilities and related infrastructures. In particular, the entity responsible for carrying out the construction work and activities of the Lac-Mégantic railway bypass, namely Central Maine and Québec Railway Canada Inc., as well as its directors, officers, agents, employees, consulting firms, contractors, suppliers, subcontractors and guests, shall have the right to exercise the servitude of works.
All subject to the following conditions:
- k. Her Majesty in right of Canada shall give prior notice to the owner of the land of the commencement of the works and, if possible, advise of the timing of the works.
- l. Her Majesty in right of Canada shall indemnify and save harmless the owners of the lands constituting the servient land hereinafter designated in paragraph 4.2 from and against all claims, demands, actions, suits or other proceedings arising out of the exercise of the servitude of works.
- m. Upon completion of the construction, improvement or redevelopment works, the lands constituting the servient land hereinafter designated in paragraph 4.2 shall be restored to a good state of cleanliness and to a condition similar to that prior to the exercise of the said servitude, but taking into considerationthe construction, improvement and redevelopment works carried out under the servitude of works.
- n. In the event of damage to the owners’ property from the exercise of the servitude of works, Her Majesty in right of Canada shall have the option of either repairing such damage or compensating the owners.
- o. In the event that structures or facilities have been constructed, installed or developed on any of the servient land hereinafter designated in paragraph 4.2, such as the installation of culverts and any new electrical system, the owner of the land shall acquire ownership thereof by accession without further formality.
