EXPROPRIATION ACT
Notice of intention to expropriate — Lac-Mégantic Railway bypass [Servitude of non-construction]
NOTICE IS HEREBY GIVEN that Her Majesty in right of Canada requires, for the purposes of the construction and exploitation of a railway bypassing the downtown area of Lac-Mégantic, all the immovable real rights, being real and perpetual servitude, hereinafter described, namely:
ARTICLE 1. SERVITUDE OF NON-CONSTRUCTION
1.1. A real and perpetual servitude of non-construction, on the land hereinafter designated in paragraph 2.1, as servient land, and in favor of the dominant land hereinafter designated in paragraph 3.1, under which it is prohibited to construct, erect or develop any construction, structure or building and to deposit or store any materials, debris or other object on the servient land hereinafter designated in paragraph 2.1.
ARTICLE 2. SERVIENT LAND
2.1. The land required, as servient land, for the servitude of non-construction designated in paragraph 1.1, in favor of the dominant land hereinafter designated in paragraph 3.1, is known and designated as being:

A part of lot THREE MILLION ONE HUNDRED AND NINE THOUSAND TWO HUNDRED AND SIXTY-ONE (pt 3,109,261) of the cadastre of Quebec, Registration division of Frontenac, which can be more particularly described as follows:
- BEGINNING at point 373, being the north-west corner of lot 3,109,261, point of beginning.
- FROM said point of beginning, a distance of one hundred and twenty-five meters and five hundredths (125.05 m) along an arc of one thousand two hundred and seventeen meters and fifty hundredths (1,217.50 m) radius to point 528; thence, following a line having a direction of 81°52′03″, a distance of one hundred and eighty-five meters and forty-five hundredths (185.45 m) to point 529; thence, following a line having a direction of 83°22′52″, a distance of thirty-eight meters and three hundredths (38.03 m) to point 530; thence, following a line having a direction of 231°21′12″, a distance of seventy-eight meters and thirty-six hundredths (78.36 m) to point 531; thence, following a line having a direction of 262°44′04″, a distance of one hundred and sixty-four meters and ninety-seven hundredths (164.97 m) to point 532; thence, following a line having a direction of 152°55′16″, a distance of seventy-eight meters and forty-seven hundredths (78.47 m) to point 533; thence, following a line having a direction of 136°14′23″, a distance of thirty-seven meters and seventy-four hundredths (37.74 m) to point 534; thence, following a line having a direction of 180°04′50″, a distance of three meters and twelve hundredths (3.12 m) to point 535; thence, following a line having a direction of 309°52′18″, a distance of thirty-two meters (32.00 m) to point 536; thence, a distance of one hundred and seventy-one meters and ninety hundredths (171.90 m) along an arc of six hundred and sixty-five meters and twenty-seven hundredths (665.27 m) radius to point 526; thence, following a line having a direction of 318°54′34″, a distance of twenty meters and seventy-seven hundredths (20.77 m) to point 373, point of beginning.
- SAID parcel of land, of irregular form, is bounded towards the north by lot 3,396,662, towards the south-east, the south, the east and the north-east by a part of lot 3,109,261, towards the south-west by lot 3,109,264 and a part of lot 3,109,261.
- CONTAINING an area of fourteen thousand four hundred and eighty-nine square meters and five tenths (14,489.5 s.m.).
- Said part of lot is shown as the parcel 264 on the plan bearing number M2022-10812 in the records of Public Works and Government Services, prepared by Maxime Bourgeois, land surveyor, on December 16th, 2022, bearing number 11763 of his minutes, which is attached to this notice.
- The directions shown on the attached plan M2022-10812 and mentioned in the technical description above are in reference to the Province of Quebec plane coordinate system (S.CO.P.Q.), NAD 83, central meridian 70°30′, zone 7; furthermore, all dimensions are expressed in the International System (S.I.).
ARTICLE 3. DOMINANT LAND
3.1. The dominant land of the servitude of non-construction is known and designated as the Lac-Mégantic railway bypass, passing on the lot SIX MILLION FOUR HUNDRED SEVENTY-THREE THOUSAND FIVE (6,473,005), of the cadastre of Quebec, registration division of Frontenac.
HER MAJESTY IN RIGHT OF CANADA intends to expropriate the immovable real right herein described at the article 1, for the needs of the Department of Transport Canada.
HER MAJESTY IN RIGHT OF CANADA asks the Land Registrar to register in the land register this notice and the plan attached hereto for the land designated above in the paragraph 2.1 as the “servient land”.

Any person who objects to the intended expropriation of the above-mentioned rights may, within thirty (30) days from the day upon which this Notice of Intention to Expropriate is published in the Canada Gazette, forward by registered mail to, or leave at, the Office of the Minister of Public Works and Government Services, Attention: Regional Director General, Place Bonaventure, South-West Portal, 800 de la Gauchetière Street West, Suite 7300, Montréal, Province of Quebec, H5A 1L6, an objection in writing stating the name and address of such person and indicating the nature of his or her objection and the nature of his or her interest in the matter of this intended expropriation.
