Ministerial Instructions Amending the Home Child Care Provider Class Ministerial Instructions and the Home Support Worker Class Ministerial Instructions
The Minister of Citizenship and Immigration gives the annexed Ministerial Instructions Amending the Home Child Care Provider Class Ministerial Instructions and the Home Support Worker Class Ministerial Instructions under section 14.1footnote a of the Immigration and Refugee Protection Actfootnote b.

Ministerial Instructions Amending the Home Child Care Provider Class Ministerial Instructions and the Home Support Worker Class Ministerial Instructions
Ministerial Instructions Respecting the Home Child Care Provider Class
1 The definition home child care work permit in section 1 of the Ministerial Instructions Respecting the Home Child Care Provider Class footnote 1 is replaced by the following:
- home child care work permit
- means a work permit that is issued to a foreign national subsequent to and in connection with their application for a permanent resident visa as a member of the home child care provider class and that authorizes them to work in an eligible occupation. (permis de travail comme gardien d’enfants en milieu familial)
2 (1) The portion of subsection 2(3) of the Instructions before paragraph (a) is replaced by the following:
Application for permanent residence – less than 12 months experience
(3) Subject to subsection (3.1), an application for a permanent resident visa as member of the home child care provider class for a foreign national who has acquired in Canada less than 12 months of full-time work experience, on the date of the application, in an eligible occupation during the 36 months preceding the date on which the application is made consists of the following steps:
(2) Subclause 2(3)(a)(iii)(A) of the Instructions is replaced by the following:
- (A) it is made by a single Canadian employer who has a Canada Revenue Agency business number and who is not a business or an embassy, high commission or consulate or an employer referred to in any of subparagraphs 200(3)(h)(i) to (iii) of the Regulations,
(3) Paragraph 2(3)(b) of the Instructions is replaced by the following:
- (b) they demonstrate that they have acquired, in Canada, at least 12 months of full-time work experience in an eligible occupation within the 36 months preceding the date of the demonstration.
(4) Section 2 of the Instructions is amended by adding the following after subsection (3):
Exemption
(3.1) An application for a permanent resident visa as member of the home child care provider class for a foreign national who has accumulated 12 months or more of full-time work experience in an eligible occupation prior to their having been issued a home child care work permit, but not more than 36 months prior to the date on which their application is made, is exempt from the requirements of subparagraphs (3)(a)(iii) to (v).
(5) The portion of subsection 2(4) of the Instructions before paragraph (a) is replaced by the following:
Application for permanent residence – at least 12 months experience
(4) A foreign national who has acquired in Canada at least 12 months of full-time work experience in an eligible occupation may apply for a permanent resident visa as member of the home child care provider class if they demonstrate, on the date on which the application is made, that they meet the following conditions:
(6) The portion of subsection 2(5) of the Instructions before paragraph (a) is replaced by the following:
(5) The work experience referred to in paragraph (3)(b) and subsections (3.1) and (4)
(7) Paragraph 2(5)(b) of the Instructions is replaced by the following:
- (b) must only involve work that was authorized under a work permit, the Regulations or exemptions granted under section 25.2 of the Act;
3 The Regulations are amended by adding the following after section 2:
Periods — conditions under paragraph 2(3)(b)
2.1 A foreign national must demonstrate that they have met the work requirements in paragraph 2(3)(b) within 36 months of the issuance of the notice that an initial assessment of the conditions under paragraph 2(3)(a) has taken place, if they have not been issued a home child care work permit within that time or within 36 months of the issuance of such a permit, as the case may be.
Ministerial Instructions Respecting the Home Support Worker Class
4 The definition home support work permit in section 1 of the Ministerial Instructions Respecting the Home Support Worker Class footnote 1 is replaced by the following:
- home support work permit
- means a work permit that is issued to a foreign national subsequent to and in connection with their application for a permanent resident visa as a member of the home support worker class and that authorizes them to work in an eligible occupation. (permis de travail comme aide familial à domicile)
5 (1) The portion of subsection 2(3) of the before paragraph (a) is replaced by the following:
Application for permanent residence – less than 12 months experience
(3) Subject to subsection (3.1), an application for a permanent resident visa as member of the home support worker class for a foreign national who has acquired in Canada less than 12 months of full-time work experience, on the date of the application, in an eligible occupation during the 36 months preceding the date on which the application is made consists of the following steps:
(2) Subclause 2(3)(a)(iii)(A) of the Instructions is replaced by the following:
- (A) it is made by a single Canadian employer who has a Canada Revenue Agency business number and who is not a business or an embassy, high commission or consulate or an employer referred to in any of subparagraphs 200(3)(h)(i) to (iii) of the Regulations,
(3) Paragraph 2(3)(b) of the Instructions is replaced by the following:
- (b) they demonstrate that they have acquired, in Canada, at least 12 months of full-time work experience in an eligible occupation within the 36 months preceding the date of the demonstration.
(4) Section 2 of the Instructions is amended by adding the following after subsection (3):
Exemption
(3.1) An application for a permanent resident visa as member of the home support worker class for a foreign national who has accumulated 12 months or more of full-time work experience in an eligible occupation prior to their having been issued a home support work permit, but not more than 36 months prior to the date on which their application is made, is exempt from the requirements of subparagraphs (3)(a)(iii) to (v).
(5) The portion of subsection 2(4) of the Instructions before paragraph (a) is replaced by the following:
Application for permanent residence – at least 12 months experience
(4) A foreign national who has acquired in Canada at least 12 months of full-time work experience in an eligible occupation may apply for a permanent resident visa as member of the home support worker class if they demonstrate, on the date on which the application is made, that they meet the following conditions:
(6) The portion of subsection 2(5) of the Instructions before paragraph (a) is replaced by the following:
(5) The work experience referred to in paragraph (3)(b) and subsections (3.1) and (4)
(7) Paragraph 2(5)(b) of the Instructions is replaced by the following:
- (b) must only involve work that was authorized under a work permit, the Regulations or exemptions granted under section 25.2 of the Act;
6 The Regulations are amended by adding the following after section 2:

Taking Effect
7 These Instructions take effect on April 30, 2023, and apply to all applications for permanent residence under the Home Support Worker Class and the Home Child Care Provider Class, including those that are pending on the day on which these Instructions take effect.

Order 2023-87-05-02 Amending the Non-domestic Substances List
Whereas, under subsection 87(5) of the Canadian Environmental Protection Act, 1999footnote c, the Minister of the Environment has added the substance referred to in the annexed Order to the Domestic Substances Listfootnote d;
Therefore, the Minister of the Environment makes the annexed Order 2023-87-05-02 Amending the Non-domestic Substances List under subsection 87(5) of the Canadian Environmental Protection Act, 1999 footnote a.

Prince Rupert Port Authority — Supplementary letters patent
BY THE MINISTER OF TRANSPORT
WHEREAS letters patent were issued by the Minister of Transport for the Prince Rupert Port Authority (“Authority”) under the authority of the Canada Marine Act (“Act”), effective May 1, 1999;
WHEREAS section 9.2 of the letters patent sets out a limit on the power of the Authority to borrow money on its credit for port purposes;
WHEREAS the board of directors of the Authority has requested that the Minister of Transport issue supplementary letters patent to increase the aggregate limit on the power of the Authority to borrow money on the credit of the Authority for port purposes set out in section 9.2 of the letters patent;
WHEREAS, by Order in Council P.C. 2023-318 of March 31, 2023, the Governor in Council, pursuant to subsection 8(5) of the Act, approved the provisions of the proposed supplementary letters patent for the purposes of increasing the aggregate limit on the power of the Authority to borrow money on the credit of the Authority for port purposes;
AND WHEREAS the Minister of Transport is satisfied that the amendment to the letters patent is consistent with the Act;
NOW THEREFORE, pursuant to subsection 9(1) of the Act, the letters patent are amended as follows:
1. Section 9.2 of the letters patent issued to the Prince Rupert Port Authority is replaced by the following:
- 9.2 Restriction on Incurrence of Borrowing. The Authority shall not incur any item of Borrowing so that the aggregate Borrowing of the Authority would exceed $255,000,000.

Windsor Port Authority — Supplementary letters patent
WHEREAS letters patent were issued by the Minister of Transport (“Minister”) for the Windsor Port Authority (“Authority”), under the authority of the Canada Marine Act (“Act”), effective July 1, 1999;
WHEREAS Schedule B of the letters patent sets out the federal real property managed by the Authority;
WHEREAS to reflect two transfers of administration between Transport Canada and Parks Canada Agency, one section of federal real property described below is required to be removed from Schedule B and one section is required to be added to Schedule B of the Authority’s letters patent;
WHEREAS, pursuant to subsection 9(1) of the Act, the Minister wishes to issue, on his own initiative, supplementary letters patent to amend Schedule B of the Authority’s letters patent;
WHEREAS, pursuant to subsection 9(2) of the Act, notice of the proposed changes to the letters patent was given in writing to the board of directors of the Authority;
AND WHEREAS the Minister is satisfied that the amendment to the letters patent is consistent with the Act;
NOW THEREFORE, pursuant to subsection 9(1) of the Act, the letters patent are amended as follows:
1. Part I of Schedule B of the Authority’s letters patent is amended by removing the following:
- Seventh Parcel: Part of PIN 01590-0086 (R)
- Part of Lots 52, 53 and 54, Concession 1, designated as Parts 1, 2 and 3, Plan 12R-16280, formerly in the Township of Sandwich, now City of Windsor, County of Essex.
- [AND AFTER FIFTHLY:]
- Registry Division of Essex (12)
- Part of PIN 01590-0086 (R)
- Part of Lots 52, 53 and 54, Concession 1, designated as Parts 4 and 5, Plan 12R-16280, formerly in the Township of Sandwich, now City of Windsor, County of Essex.
2. Part I of the Schedule B of the Authority’s letters patent is amended by adding the following after “FIFTHLY” at the end of Part I:
- 3901 Peter Street
- All of PIN 01258-0326 (LT) being PART OF PARKLOT 1, S/S OF text-center RD ON REGISTERED PL 40 TOWN OF SANDWICH BEING PT 1 ON PLAN 12R16475 IN THE CITY OF WINDSOR
3. These supplementary letters patent take effect on the date that both the Transfer and Acceptance of Administration from the Minister of Transport to the Minister of the Environment of the federal real property set out in the first amending clause above, and the Transfer and Acceptance of Administration from the Minister of the Environment to the Minister of Transport of the federal real property set out in the second amending clause above, are effective.
