CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Notice with respect to the draft Implementation Framework for the Right to a Healthy Environment (subsection 5.1(4) of the Canadian Environmental Protection Act, 1999)

Whereas S.C. 2023, c. 12 Strengthening Environmental Protection for a Healthier Canada Act (Bill S-5) received royal assent on June 13, 2023;

Whereas subsection 5.1(1) of the Canadian Environmental Protection Act, 1999 requires the Minister of the Environment and the Minister of Health, for the purposes of paragraph 2(1)(a.2) of that Act, to develop an implementation framework to set out how the right to a healthy environment will be considered in the administration of the Act, within two years after the day on which Bill S-5 received royal assent;

Whereas subsection 5.1(3) of the Canadian Environmental Protection Act, 1999 requires the Minister of the Environment and the Minister of Health to consult any interested persons in developing the implementation framework;

Notice therefore is hereby given that the Minister of the Environment has published a draft implementation framework in the Environmental Registry of the Canadian Environmental Protection Act, 1999. The draft implementation framework and other relevant information can be found on the CEPA Right to a Healthy Environment page on the Government of Canada’s website.

Public comment period

Any person may, within 60 days after publication of the draft implementation framework, file with the Minister of the Environment written comments on the draft framework. All comments should cite “Consultation on CEPA Right to a Healthy Environment Draft Implementation Framework” and be addressed to the Legislative Governance Division, Department of the Environment, Gatineau, Quebec K1A 0H3 or by email to healthyenv-envsain@ec.gc.ca.

Any person who provides information to the Minister of the Environment may request that it be treated as confidential under section 313 of the Canadian Environmental Protection Act, 1999. The request for confidentiality must be accompanied by reasons taking into account the criteria set out in paragraphs 20(1)(a) to (d) of the Access to Information Act.

Publication of the proposed Plan of Priorities (subsection 73(3) of the Canadian Environmental Protection Act, 1999)

Whereas Bill S-5, Strengthening Environmental Protection for a Healthier Canada Act (S.C. 2023, c. 12), received royal assent on June 13, 2023;

Whereas section 73 of the Canadian Environmental Protection Act, 1999, requires the Minister of the Environment and the Minister of Health to develop, consult on and publish a plan with timelines no later than two years on which that section received royal assent;

Notice therefore is hereby given that the Minister of the Environment has published a proposed Plan of Priorities in the Environmental Registry of the Canadian Environmental Protection Act, 1999, and shall give notice in the Canada Gazette.

Public comment period

Any person may, within 60 days after publication of the proposed Plan of Priorities, file with the Minister of the Environment written comments on the proposed plan. All comments must cite “Proposed Plan of Priorities 2024” and be addressed to the Plan of Priorities team, Chemicals Management Division, Department of the Environment, Gatineau, Quebec K1A 0H3 or by email to substances@ec.gc.ca.

Publication of the proposed Watch List Approach to compile the list of substances under section 75.1 of the Canadian Environmental Protection Act, 1999

Whereas subsection 75.1(1) of the Canadian Environmental Protection Act, 1999 requires the Minister of the Environment to compile and maintain a list that specifies substances that the Minister of Health and the Minister of the Environment have reason to suspect are capable of becoming toxic or that have been determined to be capable of becoming toxic (the Watch List).

Notice therefore is hereby given that the Minister of the Environment and the Minister of Health have published the proposed Watch List Approach that describes considerations and processes associated with adding and removing substances from the Watch List.

Public comment period

Any person may, within 60 days after publication of the proposed Watch List Approach, file with the Minister of the Environment written comments on the proposed Approach. All comments must cite “Proposed Watch List Approach” and be addressed to the Chemicals Management Division, Department of the Environment, Gatineau, Quebec K1A 0H3 or by email to substances@ec.gc.ca.
