Pea protein — Decisions

On October 21, 2024, pursuant to paragraph 41(1)(a) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA), terminated the dumping investigation in respect of pea protein exported from China by Shandong Jianyuan Bioengineering Co., Ltd., Yantai Shuangta Food Co., Ltd., Yantai Oriental Protein Tech Co., Ltd., and Yantai Yiyuan Biological Engineering Co., Ltd., as the goods were not dumped. Pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of dumping concerning pea protein for all other exporters from China, for which the dumping investigation has not been terminated.

On the same day, pursuant to paragraph 41(1)(a) of SIMA, the CBSA, terminated the subsidy investigation in respect of pea protein exported from China by Yantai T.Full Biotech Co., Ltd., due to an insignificant amount of subsidy. Pursuant to paragraph 41(1)(b) of SIMA, the CBSA has made a final determination of subsidizing concerning pea protein for all other exporters from China, for which the subsidy investigation has not been terminated.

The above-listed tariff classifications cover both subject and non-subject goods.

The Canadian International Trade Tribunal (CITT) will continue its inquiry into the question of injury to the Canadian industry and will issue its decision by November 19, 2024. Provisional duties will continue to be imposed on the subject goods from China until the CITT renders its decision. However, provisional duties will no longer be imposed on imports of goods for which the dumping and/or subsidizing investigations have been terminated. Any provisional duties paid or security posted will be refunded, as appropriate.

If the CITT finds that the dumping and/or subsidizing have caused injury or are threatening to cause injury, antidumping and/or countervailing duties will be applied to future importations of the subject goods. In that event, the importer in Canada shall pay such duties.

The Customs Act applies, with any modifications that the circumstances require, with respect to the accounting and payment of antidumping and countervailing duties.

Information

The Statement of Reasons regarding this decision will be issued within 15 days following the decisions and will be available on the CBSA website.
