His Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to section 76 of the Canada Consumer Product Safety Act, chapter 21 of the Statutes of Canada, 2010, hereby fixes June 20, 2011 as the day on which that Act comes into force.

EXPLANATORY NOTE

This Order fixes June 20, 2011, as the day on which the Canada Consumer Product Safety Act, chapter 21 of the Statutes of Canada, 2010, comes into force. The Act repeals the definitions “advertise”, “controlled product”, “hazardous product”, “prohibited product” and “restricted product” in section 2 of the Hazardous Products Act (the “HPA”) as well as Part I and Schedule I of the HPA. The Act also adds the definition “controlled product” or “hazardous product” to section 2 of the HPA and makes a consequential amendment to paragraph 12(f) of the HPA.

The Act modernizes the regulatory regime for consumer products in Canada. It creates prohibitions with respect to the manufacturing, importing, selling, advertising, packaging and labelling of certain consumer products, including those that are a danger to human health or safety. In addition, it establishes certain measures that will make it easier to identify whether a consumer product is a danger to human health or safety and, if so, to more effectively prevent or address the danger. It also creates application and enforcement mechanisms.
